  1. I understand. I meant the financial situation for me/us would be resolved when I said it was a 'moot point.' Thank you for the info!
  2. Another Question, and this might be more appropriate for a different thread but I don't want to get flagged for starting too many threads... The new intended joint-sponsor who is researching whether or not he can do this right now is in the middle of applying for a small business loan and has a kid about to go off to college. He (and wife) are family members as well. They are well off but, understandably wary of the wording of sponsorship. He/they trust me and know I'm good for it. In a year and a half I'll be an RN and all of this becomes a moot point. He's just worried about potential ramifications for the loan application. Does anyone who has gone the co-sponsorship route know if this can affect your loan credibility? I'm not talking about "if the worst should happen, etc.." I mean does just signing the contract somehow trigger credit alerts or anything like that? TIA!
  3. I don't know but it's listed on the website as an "additional fee" so I'd imagine OldUser has the right of it. I would, ofc, love for you to be correct. Either way, I hope to stay clear of this option. He's on vacation for a wedding on a tropical island. I don't think that's going to happen with him sending tax stuff from there, but I'm working on another solution to keep us on set with all of the dates and if that falls through, yes, we will explore filing late but asap. This has now become my sole focus. I hope it's not too late and I get what you're saying.
  4. Understood, thank you. We're doing all we can now to avoid it and I hope we are able to make it work. I appreciate the info.
  5. I'm sorry I didn't update, but I did do the research and came up with the same. Thank you for your sage advice and for taking the time to be sure that I understood it! I appreciate it truly!
  6. I did look into it and have it correctly filled as c9 now. Thank you.
  7. Another question for this form: So the passport that the K1 is attached to expires 10/12/25. He has his new passport already but the passport he came in on is the one mentioned. Item 21b asks for the "Passport number of your most recently issues passport" Would that be the new one? If so then would we put his old passprt number (the one the K1 is attached to and that he came in on in number 21c? where it asks "Travel document number"
  8. Filing Category Paper Filing Fee General Filing Additional Fee: If you file with, or your Form I-485 is adjudicated by, the Immigration Court (Pub. L. 119-21). $1,440 $1,500 I don't understand what the $1500 is for? So the first time I file it's $1440/immigrant? And the $1500 is what? In case we are denied and have to file again?
  9. So with these two things in mind... if I file late (like a week) would they reject it just because it's late if it's complete? Or, if I filed incomplete, could I include a cover letter explaining that a co-sponsor application is coming?
  10. Brainstorming... what if we file the AOS and send in I 864 later (end of month) since that's the main issue?
  11. So because we are down to the wire and bc of a miscommunication with our joint sponsor, we may not have the joint sponsor documents in time to meet the 90 day deadline. My brother is out of the country and won't be back until the 17th. Our 90 day mark is 10/16? Maybe 10/13 actually bc he came into the country 7/16. In any case, unless my brother gets back too late. It's my fault. I didn't fully understand the different deadlines bc I've been running around for school, work and getting all the appointments set up. We got the SSN for him and opened them both bank accounts but this... So, please don't berate me. Trust me I know. I'm sick with it. I know you all get asked stuff like this all the time by idiots like me but what do I do if I'm filing a little late? (like days late) Is there any way to get an extension? I don't meet the financial requirements without the joint sponsor so I'm not sure if filing without his stuff would do any good.
  12. We did file the SSN and he has it. That's one of the reasons we're just getting to the paperwork for the I-864. It took a while to get the SSN appointment.
  13. He can speak English, he juist doesn't always understand what these intense government forms are asking for. We are filling them out together though. He just didn't want to screw something up if he filled it out alone.
  14. Not sure what you mean, but if you mean why isn't he filling it out? It's because the language is tedious and confuses him at points. We tried having him do it alone before and it... was not good. There's a bit of a language barrier and we didn't want to make any mistakes. We are also filing with a co-sponsor. From what I'm reading, I can't go wrong with a6. Also I read the instructions but can't figure out where else to look this up.
  15. I looked it up and it states c09 is Tnonimmigrant for victims of sex-trafficking. It also says we must show proof of this status, so I'm thinking it's a6 ?
  16. Also, on the I-765 form, Part 2, Item #25 "Your Current Immigration Status or Category" Would we put K-1 for him again (it;s the answer for # 24 "Immigrant status at your last arrival" ) Or would we put "Spouse of a US citizen" or something else? Same question for my step-daughter: do we fill out # 25 K-2 or something else?
  17. I'm filing out the I-765 and I-864 forms for both my husband and my step-daughter. I'm unsure which category to file them under for the I-765. Is it "a6" "K1 non immigrant Fiance or K2 dependent" or "c9" which it states to apply under if you have a pending application for adjustment of status. We are in the 90 days now... but *just* as he got here July 16. (I know! but I had school and a ton of stuff to do for it so I'm getting to it now.) TIA!
  18. If my brother meets the 125% income requirement for 4 (him, his wife, and my husband and step-daughter) (they have no kids) does my sister-in-law still need to file an I-864a?
  19. I was confused because when I search for the form it tells me to file for the work auth on-line.
  20. I meant to add that he did get his SSN. We tried for my step-daughter, but were told she'd have to have auth to work first.?
  21. We are filing for my husband and step-daughter here on K1 and K2. We got married August 21. I'm a little short on the income requirements for the 125% with him, his daughter and my own children. (just until I graduate nursing school and we'll be fine once he's working.) We are using a co-sponsor for my husband and step-daughter. Does the co-sponsor file a seperate I-864? He's married. Does he file with his wife? (They file taxes jointly.) Is it correct that we do not need to file a separate I-864 for my step-daughter? What do I check off on my I-864 to indicate that there is a co-sponsor (to cover the fact that I won't meet the % requirement.) The doc from the US embassy in France who did his medical exam gave him a hard time about vaccs that he already had (she marked that he didn't have them when he had proof that he did... it was one of the ones you get in 2 or 3 and he had the 3.) He literally got everything that was on the list but apparently they changed the requirement the day before his appointment. In any case, I think that means we have to get him signed off by a civil surgeon? Where do we go for that? I did do a search and came up with a list of names locally... is it just a doctor with a specific certification from the government? My husband and step daughter won't be active on my insurance until October. I don't know if it's wise to wait so I guess we're paying oop for that. Facts that may or may not be relevant: The co-sponsor does not live with us. He is a family member. Also, for the I-765, (auth to work) do we have to file for the I-864 first?
