  1. I understand the timeline might look suspicious, we hadn't planned to get married on that visit (I was supposed to start my sophomore year in March) so it took some time to get married.

  4. South Korean national here looking to apply for a B1/B2 visa. ESTA got denied on the grounds of past overstay. I have previously overstayed on ESTA before getting married in the US (us citizen) and adjusting status successfully. But I ended up getting divorced so I came back to South Korea. It's been 3 and a half years and I'm looking to visit as a tourist, maybe next year. Lawyer's asking $2,000 for the process but I'd like to do it myself if it isn't necessary. Also, I have no intention of staying in the US. Currently a freshman in college at the age of 27. Here's some relevant dates. 12/20/2018 - Entry to the US (I-94 expired on 03/19/2019) 07/2019 - Marriage 10/2019 - I-485(AOS) filed 01/2020 - 2 year conditional GC approved 01/2022 - Left the US before GC expiration 03/2022 - Divorce finalized (Zoom court) 06/2023 - Surrendered GC with I-407 2022-2024 military service 2025 started college Is a lawyer my only shot here?   5. I know it won't be an easy process. I just wanted to know if I had a ban or if I could give it a try at least. So was I forgiven when I got my green card? Thus, no ban?
  6. Sorry, should've been clearer in the post. I filed for I-407 and gave up my green card after I left the US in 2022.
  7. I left the states in 2022 and am looking to visit as a tourist now. This is my timeline : 12/20/2018, entered the US on ESTA. (I-94 expiration date was 03/19/2019) 10/10/2019, filed for Adjustment of status(family based) 01/29/2020, green card approved 01/05/2022, left the US before green card expired I'm aware I can't use ESTA anymore. Do I face any reentry ban if I want to go back as a tourist? It says reentry bans apply when you leave the US after more than 6 months of unlawful presence. Does it still apply if I left the country as a green card holder with an overstay history? If I do get a reentry ban, will it be a 3 year one since I got my green card before the 1 year mark? My understanding was that when I got my green card, I was 'admitted' as a green card holder so I never left the country as an overstay but I'm not so sure anymore. Any answers will be much appreciated.
