  2. Well why do lawyers say no don't risk it? It makes no sense that it says no when you read up on it as well.
  3. I've read that as you have shown immigrant intent with your i-130 pending, and O1 visa on file you should not apply and travel on ESTA. You can travel on a B1 visa if it's valid and you already had it but ESTA no. Try it by all means, take lots of proof of your return home but you may get a denial or refusal at the port of entry and of course that would be awful. Applying for ESTA takes 24 hours if that so you'll soon know. Good luck πŸ˜‰
  4. Pardon me for asking, but perhaps they worry that you will have to support yourself and her on your retirement pension? Is there an age gap? Will she be working or retired too? Just thinking perhaps there was more to the reason for the 221g especially as you say they didn't look at the financial paperwork at all. Not meaning to offend just wondering.
  5. If you're in the US and they are consular processing abroad it's about 15/16 months now. Not sure if your previous wait time goes towards that or if they start counting from November once updated. I would guess another 6 months wait though. Good luck πŸ‘

  7. Good luck with your interview, sorry I can't really help with your query but I am sure someone will. Can I ask why has it taken so long?? Purely due to the lawyers mistake on the i-864 and waiting for a FOIA? That's an awful amount of time to wait. Could I kindly ask you how long it was from NVC DQ to London Interview date? Trying to guess a timeline here in the UK... Thanks

  9. Yeah I am nearly 15 months and wouldn't be surprised to wait 16 plus...I am hoping London Embassy won't be a horrendous wait too after all this time πŸ™

  14. Hi, did you have an RFE or a reason for the 221g? Maybe they were waiting for you to send something and it's gone back to USCIS? Hope you get to the bottom of it!
  15. I think you should definitely visit him and his family at least once or twice before marrying and preferably marry him in person. Once your green card is sorted you can move to the US. You need to show lots of evidence of your relationship in photos and conversations to be able to push the application through. It's going to take at least 18-24 months from when you apply. Can he visit you here or is that not possible? You mentioned mobility issues. Good luck to you!

  18. Thank you for your reply. I thought assets that were outside of the US, that belong both to the spouse as well as the USC, could be used however would be 5 times the poverty guideline?
  19. I thought it was 5 x the shortfall if both the USC and the beneficiary are outside the US and earnings are therefore $0 and using cash or assets to make up the difference? Or is that only when the assets are totally foreign based so is that why you say 3 x as your wife has it in a US account? Or assets also owned jointly with the beneficiary ie Property are 5 times.. Honest question, what if a sponsor is impossible to find? Can it be up to the Officer at the interview to accept cash assets? I am having a similar problem 😒 is it a case of no sponsor no Green Cards?
  20. Yeah mine too and I am 2 days behind you. But, there was someone on June or July filers who recently was already approved and her estimate was still saying 10 months or something πŸ€”. I take more notice of what others report on here to be honest.
