I do not understand how your situation qualifies, could your Joint Sponsor help?

Yes my joint sponsor is helping it's more of I just wanted to know more about the I912 and if I had to pay for the green card lol. My husband is taken care of. I honestly was just asking for a yes or no and why not. I wasn't expecting the rude comments. The embassy knew my finances they received and gave us the okay. My husband is not on any type of government assistance. I was just confused. But I thank you for actually letting me know it's not about me when it comes to the I485.

although it is allowed,  questions the ability of sponsor to care for the immigrant

And i am surprised that Casa approved the K1

If i was the officer who reviewed a I 912 request,  i would send a RFE asking "who pays her room and board?  Who pays for her health care?

what plans did u make for the care before she came to the US?   When will u gradutate"

it was important to know all that is involved in the K1 proceedure and u have prepared for the AOS

I have graduated already but I want to go for a higher degree so I went back. I only wanted to know if I could file for the I-912 because I am on it currently. I have my own apartment and we are living fine. I just wanted insight you know but I fear that I shouldn’t have asked.

DO NOT file for a fee waiver…it will not only be denied but you will end up shooting yourself in the foot…and future filing be flagged for public charge.

You convinced the Consulate ( w I-134) that you and /or joint sponsor will support your now wife. Time to pony up ( w I-864) so get a Joint Sponsor

Thank you so much!! I will not file for it I just needed clarification.

You,  the USC,  are not the applicant of the I 485

    your new spouse is

The principal applicant is usually the individual named as the beneficiary of an immigrant petition or who is otherwise qualified to adjust status

Is your spouse already getting "means tested benefits"?

No he is not I just wanted to know about it

K1 is a single entry visa good for 90 days so as long as you marry and file within the 90 days you can wait.

Do you have a joint sponsor?

Have you read who is eligible for a fee waiver?

Thank you for replying. I mean do we have to file for the green card within the 90 days they gave us or can we wait? We do have a joint sponsor, but it states I can file for it if I am on "means-tested benefit"( I am a full time college student).

Thank you so much for the clarity! we got to the SS office one week after he came here and filled out the paperwork. We have yet to receive his SS card.

I didn't answer that part because I don't know the answer.  It appears (from reading the same website you pulled your screenshot from) that most immigrants have a 5 year waiting period before being eligible.  K-1 is included in the group that must wait 5 years.  That is 5 years from green card issue date, not 5 years from entry date.

Thank you so much you have been a huge help!

Health insurance is not required for AOS or any other stage of the immigration process.  Health insurance statements are sometimes submitted as bona-fide marriage evidence when removing conditions, but it is not mandatory.  It was a requirement for a short period of time for certain immigrant categories from 2019 until 2021, but even that requirement has been lifted.

What about the Medicaid part of it? It’s saying that he can’t have Medicaid but then the government health site said that he can have it.

  8. Hello everyone I hope everyone is well. My fiancé came here from Morocco the beginning of last month on a K1 visa. We are getting married next week but I wanted some help as I am confused. I saw on a YouTube video that he needs health insurance in order for us to file for the AOS. Is this true? Also I saw that he can not have Medicaid but the health gov website states he can, can someone please explain. We used a cosponsor because I am a full time college student and I want to know what we should be doing next about this. We are in NYC if that helps any.
