  1. For any file that had a paired I-129 with the I-130, the I-130 is moving forward but the I-129F is just filed away. She said they technically do not close the I-129 (by their own internal guidelines they can’t) but they choose one over the other (which she stressed to me was not illegal for USCIS to do).

This is what happened to me. If I log on at USCIS to see my case status, I'd see that my I-129F is still pending although I was told they closed it.

They forwarded my I-130 to NVC and I just chose to go with the flow.

Same thing here, I guess technically I'm a CR1 now. I called USCIS before I began this whole process and was told to send my I130 then the I129f as soon as NOA1 arrived...they can't follow their own rules?#$*

  2. Oh, I see now...I guess I'll file married jointly and get the credit next year for both of us.

I found where you were talking about the tax credit for 2008 at:

    http://www.irs.gov/newsroom/article/0,,id=179211,00.html

Not eligible at the current time? If your circumstances change and you become eligible after you file your 2007 federal tax return, you can always file an amended return using Form 1040X. If you're not eligible this year but you become eligible next year, you can claim the economic stimulus payment next year on your 2008 tax return.

    Thanx Chris.

  3. You are better to file an extension than to file a knowingly erroneous tax return. I am sure your explanation of "oops I didn't know I was married" will raise a few eyebrows.

    Agreed.

Also, the point that the stimulus payment will not be given if a joint return includes an ITIN for one of the spouses was well made. While you could get the stiumus payment next year as a tax credit if you both have SSN's then, if the SSN will be coming shortly, delaying filing could be a better option this year.

Doesn't your other half need to have a SS number by 2007 year end to claim the payment?...thus defeating the purpose of delaying. If not I think I can wait til October to get another $600. And you won't be able to claim the tax credit next year. Its a one time deal-as I understand. Please let me know if I'm wrong.

  4. A low income worker that makes over $3000 a year, retired, a railroad retiree, certain veterans, or anyone not required to file their taxes. If they would like the stimulus package they need to file a 1040 with name and social security number, then ALSO write "stimulus payment" at the top of the form and fill out Line 20a of Form 1040 or Line 14a of Form 1040A.

:reading: This is coming from an IRS employee. We were told to pass the word along. :reading:

These people do not need to call or fill out any special forms. The IRS will figure your payment.

Payments will begin in early May.

Individuals making over 75,000 or couples over $150,000 payment is reduced by 5%.

If you move after filing fill out Form 8822.

If your tax refund is direct deposited then so will your stimulus payment to the same account.

If your divorced but filed together, than you both will need to endorce the check; both parties names will be on it.

  5. i haven't receive my NOA1 yet,i called the uscis and they said that i need to wait,i dont know if they sent it alredy and got lost  .

can i check the status online without receipt number? :pop:

I think you'd be better off checking your bank account to see when they get the check.

You can't check status online without a number which will be on the back of the check or just wait for the notice to arrive.

    Give em some time... :jest:

  6. http://travel.state.gov/visa/immigrants/info/info_1335.html

NVC IS the US State Department.

You really could be doing this yourself, unless you have a "complicated" situation.

In 2-4 weeks NVC "should" have your papers you can call and find out: 603-334-0700.

I suggest calling bright and early to get through the phone lines.

Some people actually talk with someone. When I called I just followed the prompts and inserted my

USCIS number and got my new NVC number, letting me know they had my papers.

I also emailed them to change my husband's (alien) address and they replied that they received it and would be

sending the DS320 to him, although I already had him email them.

    Hope this helps, Good Luck.

  7. I feel a lot better after reading all the replies. I've been using comfi.com-jupiter card and I emailed Sprint for my old phone records even though I haven't been with them since last March. They emailed me back with reassurance to help in any way cuz I told them it was for "immigration purposes". They did'nt even charge me for the 8 months of phone records!

  8. I buy my calling cards online. I can show that I have a receipt for them. But I don't have anything showing phone numbers. My phone bill just shows the 1-800 number < oh dear>. Are phone records necessary? I have tons of chatting, txt messages, and emailing logs.

  9. What's going on July Filers? Any good news around here? As for me, NOTHING. I'm kind of scared that my K-3 will be cancelled. It's been 7 months since I filed and NOTHING. I can't wait any longer...

oh my gosh! Duende! What's going on with your papers. You filed before me!!

I got my I-130 approved Jan. 31. My I-129f is "still in Vermont". I guess I'm now a CR1 case. I got my NVC number and just emailed my husband to email about NVC on the DS-3032. I feel like I'm gonna pee in my pants cuz I haven't hit any roadblocks yet.

Have you contacted your congressmen? Mayor? Senators? :ranting::o Called USCIS since your overdue? ooooh deeaar.
