  1. I'm asking this question for a friend and any help would be greatly appreciated. She got married to a man who's here on a visitors visa this weekend. We're not sure what kind of visa it is other than a visitor visa that's good for one year. What does she need to do now for him to get a GC and be able to stay after this visa expires? I was thinking she would just file the Adjustment of Status like a fiance visa would but $1,010 is pretty expensive to send in the wrong forms and have them rejected! :help:

    they cannot change the fact that he's a visitor and when his visa expires, he's going to be illegal in the USA.

    And the reason i'm saying that, is that my boyfriend and i wanted to get married last summer while i was there, but we've been told at the Federal Court, that the marriage won't change my status in US.

    Plus, a k1 usually goes faster than the k3

    Not sure what the Federal Court has to do with immigration....BUT.

    My husband was illegal in the US for 5 years and adjusted status from a tourist visa successfully. Illegal work and overstay are both forgiven through marriage to a USC, it's written into the INA (this much can't be refuted).

    You could have married in the US and stayed here if you had no intent on entry. Sure, you sometimes have to prove that you didnt want to stay, but it can be done. And is done, daily.

    I wish i would have known that while i was there...

  2. For Moldova particularly. If you are going to get your police certificate do NOT choose it to be in English. The Ministry of Internal Affairs is kinda stupid in Moldova and the translation is wrong!

    Have it done it Romanian since the Romanian embassy can read it and to sleep better at night have it translated and legalized. I would recommend you a specific place. Hotlul Cosmos. On the 4th floor the have translation bureau called "Teodonica". They are good, fast and affordable. You can pick up your translation and legalization from the same place the same day usually.

    Have your Birth Certificate Translated and legalized and please make at LEAST 3 copies of those. You will need one for embassy, one for AOS application and have one just in case. At least. I'm angry I only did 2...I don't have an extra one now if I need it. God forbid.

    PS: Don't get your police certificate now. It's only valid for 3 months and by the time you'll have the approval it might expire.

    When you translated your birth certificate did they give you the translation on a big A4 paper?

    I was wondering is this going to be my only birth certificate i'll have in USA? Just an A4 sheet?

    Or they're going to issue another american-type birth certificate?

  3. Hello everyone. I was wondering if anyone here on these forums has ever been denied the K-1 visa because their income was not enough on the affidavit of support, the I-134. I am wondering because I am a very recent college graduate, actually I have finished all my classes and still have not "walked the line" for graduation. My mother will be my cosponsor because she does make enough for any of the requirements and I will find a job soon. Just concerned on how many people get denied for this.

    for any case you can have a co-sponsor, and that could be anybody(relative, friend, or whoever)

  5. i also think its important to mention here that if the police certificate is in the native language of the country where the interview is to be conducted, it is very likely that the embassy will accept it as is...in other words, my fiance got one police certificate from italy and another from albania...he was only required to translate the one from italy, because packet 3 specified that documents can be accepted in either english OR albanian

    as far as whether or not the petitioner / beneficiary can translate the document themself, i think it varies by embassy...if youre planning on doing so, i would contact the embassy to ensure that they will accept it

  6. Hey there. Ok I am from Moldova and I went through the visa process this fall.

    If you go to the embassy info link you will find the list of the hospitals you can go to in order to have your medical exam.

    My advice is the following:

    After you receive your package 3, send it out ASAP. The same package will include the medical forms and all other good stuff. If you want your date fast, call the embassy (they will post the number for interview appointments) and ask then when they have the earliest available date for the interview. They will tell you the date and make an appointment if you would like. After that call the hospitals and check which one is free the day before the interview. I went with biomedica (or something like that) They are relatively cheap and you get the results at 6 pm the same day. One of the three is just a lady that works kind of by herself and you get the results even faster. If you don't want to travel back and forth just reserve a hostel. They re very affordable. Around 20-25 euro/night and pretty cool actually. i can recommend you one by the NORTH Train station.

    If you don't want to do it the day before the interview (that is if you have a multiple entry visa) you can do it any day because he medical is valid for 1 year.

    Anyways. If any questions ask me. Gotta run to bed...early work day tomorrow

    Did you ,guys,read about the tremendous growth of the k1 petitions lately?

    I'm not sure if i understood right, but did they say it could take up to 15 weeks to receive only the NOA1?????

    i'm freaked out!

    That's old news. The service centers have caught up quite a bit and the mass inrush of applications has died down to much more manageable levels. Most people are seeing NOA1's within a couple weeks these days.

    Can it be done here, or we need to do it there,in Romania?

    And what if all the vaccination records are in russian(USSR,you know), those need to be translated in english?

    If you have permanent residency status in Romania, everything will be done there, include medical and interview. Vaccination records are not provided to the embassy, but may be used by the doctor that is doing the medical. So it may need to be translated if the doctor doesn't know Russian.

  10. I have a friend who is here from Egypt. He came here on a tourist visa that is good for 6 months. His family is very well off in Egypt and much of them do live here or go back and forth - legally through visas that I believe are good for 6 months, as a tourist visa and then they must return to Egypt for a period of time before they can return to the USA.

    My friend is here now and his visa is good through March 2008 but he wants to stay.... What kind of options would he have? Of course people are saying ofr him that he should marry, find someone to marry and stay that way but he does not want to do that - He wants to marry for love and in the time that it happens and not for a visa- and really I repsect him for that soo much! His family here is telling oh we have this girl and that girl you could marry to stay, etc but really he is a good person and he does not want to do it that way.

    What other options would he have that he would not have to return to Egypt? I was thinking is there a way to apply for an extension? Or change it to a student or work visa? Does anyone have any information? Please let me know if you do! Thank you guys so much :) you're all a great group of people and you've been such a wonderful resource. Thank you

    Hi!

    I met my boyfriend while i was in the USA.And we wanted to get married, but at the federal court they told us this is not gonna change my status in the US.

    Nothing can change your visa status in the US. So wew were told even if we do get married i'll be elegally there as long as i don't come back home and don't apply for a visa that alouds me to come back.

    And since we're talkin about marrige, a k3(spouse) lasts much more than a k1(fiance).

    We are just waiting on our K1 interview at the London embassy. We need a co-sponsor, as although my fiance has a good job, he was doing his MBA for two of the last three years so did not file tax returns. We would like to use a friend of ours in NYC, but he is not a relative. Is this going to be a problem?

    no, it's not a rule: the co-sponsor doesn't need to be related(although it could be possible)

    I had another question come to mind that I wanted to pose to the forum....I am a college student, with minimal income. I do have quite a bit in assests saved, however since I a full-time student, I have no real "income". I know that there is a responsibility to show proof of financial ability to support you fiance. Does anyone think that this could be an issue?

    Also, my fiance wants to study here in America as soon as possible after the wedding. Does anyone know the specifics about when she would become a "resident" for financial aid purposes?

    if you cannot provide any proof aof support you need to name a sponsor(this could be your mother for example!), otherwise, you may have troubles at the conulate!
