  1. Yes Aaron i understand that her husband is lazy. In my case its different we still love each other a lot & we are doing this in consent with each other. due to our age difference we are facing several troubles now & in the future. So yes I have confidence in her. we are taking care of everything regarding money and everything before i leave , so those wont be any problem. This may not be true if couple has hostile relations between each other.

    I am an Australian and moved here in 2006 to be with my husband. Well, it turns out that I am the one supporting him as he can not hold a job, and he also suffers from addiction to prescription medication.

    I was wondering how I go about leaving the US? Can I just leave or is there a procedure that I have to go through? I really want to go home :(

    This is my personal view. I also have to return to India and we have mutually discussed & agreed on this as I dnt feel good here in usa in regards to human interaction & society. Anyways once I leave she will file for a dissolument/divorce based on abandonement. Its cheap and quick. If your spouse agree on that, it can be done. BUt it can never be done, unless & until you dnt leave usa. Thanks.

    I am writing regarding my post at Effects of Major Family Changes on Immigration Benefits : LINK . I am posting a similar question here as I guess there are more Indians visiting this section. I hope moderators wd excuse me.

    I came here in B1/B2 visa and married my wife and then was here for about a year. Recently thru several months we are having disagreement & mismatching regarding several respects. I am also not well adapting to the society & culture and feel very very lonely and away. We agreed with each other that I wd return home. However the main aspect is that There has been an health urgency at home which wd need me to go back at my country as fast as possible. line We have several queries ... i wd be glad if someone guides us ... I googled for these but not finding enough answers :

    1) I have overstayed like 8 months or so.......... I know the aireline staff and airport staff just takes the I-94 and just create any problem while I am leaving, they just look at the passport as an id for the ticket............. right ?

    2) I googled & found they have no right to look into overstay in usa...they only (by law) shd look into a valid passport for a indian citizen coming back to India.

    "Even for re-entry into the country, an Indian national is required to be in possession of a valid Indian passport or travel document issued by Govt. of India" written at Bureau of Immigration-India

    But does anyone know know while we get our passport stamped after getting thru the line in India, do they ever asks for some dollars as bribe, for overstay ?? The polices at customs want $25 to be poked in their hands if you have big luggage, that I know.

    3) I am planning usa-franfurt-india. I googled about the Transit visa thing.... My multientry B1 visa is ok till March,08. Now here I overstayed for 8 months.....So the " thisdate- this date " stamp by POE officer while entering US is over. So wd i need a transit visa in frankfurt ? or has my multientry visa already cancelled due to marriage here ?? but i dnt think i need to tell the marriage thing to the airlines staff. any idea anyone whether i wd need a transit visa ??

    Helmut here has said that i wont need any as long as I do not want to leave the international area of the airport, or connect through another EU country. All international airlines are located inside the customs area. I can just go from the arrival gate to your next departure gate. All I need is my passport, so I can get on to your plane to India. ANy idea anyone ??

    I was here on a B1 visa married, but due to some serious problems of different types I thought of returning to India.

    Now I was in B1 visa and overstayed almost 8 months. Just wanted to know whether leaving usa wd be any problem with airline staff or immigration officers ?

    I am planning from Chicago-Frankfurt-India.....

    Also do Indian POE create any problems ?? Hope not.

    I wd love to hear from some experts here ............ thanks for all the time and all advices wd be appreciated ...

    where it says "Go down to the local courthouse. Tell them your spouse disappeared. It shouldn't cost more than $100 bucks for the filing fee. Ask the clerk to point you to the divorce papers. Fill them out file it with the clerk. You may have to put an ad in the paper and provide his last known US address to give him a chance to respond. If they make you put the ad in the paper, you have to wait 30 days to make sure he doesn't respond. Usually after that, the judge will just grant the divorce on "Abandonment" grounds."

  8. Thanks Minya's wife ............... i know that I may not be allowed to re-enter usa. ANd i wont do so until consulting with some good lawyer in my country. You shd know we married based on a sudden circumstance & with no intention of marriage while i entered. ANyway can some one guide me wbout whther we have to go for divorce / dissolum ent / annulment. We are married for 8 months & at Ohio. As i said i have to leave fast and have no option to stay longer due to an emergency. SO what are the options ?

    i)what taxes are u talking about ? I came in B1/B2 visa and in india also i didnt used to file for taxes as i was a freelancer. Can u pls elaborate what taxes are u talking about ?

    ii) what do you eaxctly mean by "and Indian customs/immigration officers will probably be all-too-willing to let you settle that issue after entry"

    I wd be thankfil more your help .... Can someone also extend their knowledge about the annulment issue

    i dnt know was this to be posted in off topic or here. I am sorry if I have posted it in the wrong forum.

    a) Is it necessary for both to be present, if she applies for annulment aftter I leave ? Can she apply on her own with the marriage certificate and how much wd that cost ? Wd a written statement from me, wd help ? ( I cannot be present for months and have to leave as soon as possible )

    B) I have overstayed like 6 months or so.......... I know the aireline staff and airport staff just takes the I-94 and just create any problem while I am leaving............. anyone has any idea of indian POE officer ?? do they create any problem if they see I am coming back to india after an overstay in Usa ?

    c) If in future we apply for K3, wd this going back & overstay create any problem ?

    I am in USA now in B1/B2 visa to attend few fairs and conferences and lay foundation for my future art in the books of my client. Now after coming here I came across a Bachelors degree in a nearby university .They were advertising.I am quite interested to attend their bachelors course for my further study.Thus as i learned through googling that I have to change from B1 to F1. Now I need your help to know what are the difficulties :

    a) My answer at POE was only to attend conferences & thus there was no preintention.

    B) My I-94 is dated till early July but I have a 1 yr multientry visa.

    c) What is to be done to change ??

    d) How much time wd it take and whats the cost ??

    Can someone help me ?? All advices wd be appreciated

The thing that bugs me is that we've already had our FBI namechecks during the visa and AOS process; we've already had our FBI namechecks during the removal of conditions process; and now they want another FBI namecheck for naturalization. Can they not just put a little sticky in our files saying we were cleared up until suchandsuch a date and they only need to check back a year? Sheesh.

    Nice reply Krikit .I cdnt just avoid from writing this is a total fun going on .Though i am still going to start the AOS process but from what i read and researched this is a total mock .I have listed the mocks below :

    a)FBI namechecks during the visa and AOS process ( as Krikit said )

    b)FBI namechecks during the removal of conditions process ( as Krikit said )

    c)FBI namecheck for naturalization

    [i can understand that they want to update that the person has conducted some serious offences or not in the meantime, thats why so many name checks and also for the terrorists thing. Yes as Krikit suggested they can do it after every year !! But then why do they take so long .From what i read here its taking years almost for people who are stuck in the namecheck ]

    Another big funny thing is as follows:

    D) While people go to their individual US consulates for any sort of VISA there is a FBI namecheck thing run in the software with which the Consulate Officers work.Now if a persons name is put in and if it matches with someones whom FBI is searching for , the name wd get locked and the software wont let the officer proceed with the person.And with hell that clearing process takes 5-6 months .Though the CO knows that the person at the interview is honest and has no connection with it , he is helpless as the system is like that.

    Why isnt there any system of finger print matching or photograph matching ......................and why dnt FBI upload the accused person`s fingerprint into the software thus it can be verified at the spot if the person at the interview is the same person or not......To the contrary they keep on taking your fingerprints at differnt point of time.It has also been upgraded to four fingers from index ones !!!!!

    Whats ur views VJ ers ????

    Dnt really know what to say ......... Hope my thing goes on smoothly and i not stuck anyway .................. :D

    Aren't you adjusting from a B visa?

    In that case, FBI namcheck is wholly appropriate.

    I know that .....and of curse its appropriate .............. I never said its not needed. FBI namecheck is a really good thing and it shd be made for the security of USA .........we are only discussing here the possible changes and flaws in the system. Its nothing personal here.
