  1. @PaulaCJohnny my bad we moved overseas in 2014. baby is 8.5 years now. I just pulled up the file from our FOIA request response. I-751 was stamped at the VSC 08-25-2015..denial letter was sent 09-01-2016. date on 'action block on original I-751 shows a date of 08-22-2016.
  2. @Dashinka Great point. No, she never filled out and signed an I407. figured the consular officer would refuse her a B1. So it seems we are back to the refiling I-751 again with a long brief, but then if I-751 gets approved, any idea what happens next. Thanks.
  3. thanks again, @mindthegap she has an appointment to apply for B1/B2 visa to accompany me and my daughter during an upcoming trip. we will see what happens from then on.
  4. @mindthegap Thanks for the tips. checked status via link. 'no case found for this A-number. Our daughter was born in the US, she is 8.5 years now. the denial letter clearly stated that there was no record of that my wife appeared at teh SC as scheduled. Also, mentions that PRS is terminated as of the date of the letter. not sure a judgment for removal was ever considered because we never received a NTA. We did however mail the 2GC back in the mail years ago. The letter said that they attempted to notify us of the new biometric appointment and the notice was returned undeliverable. Thanks All.
  5. Appreciate the tremendous pouring of insight and thoughts. having consolidated all your feedback, it seems the consensus(unscientific) is to go ahead and file an I-130 form. We contemplated a B1/B2 visa for her when we plan to visit Florida this year, but not sure what the outcome would be at the US Consulate's visa officer's hands. Many thanks, AM
  6. Hi friends, Looking for some insight, advice on how to proceed. Here is the debacle.... at around the time my wife's appointment for biometrics was confirmed, we moved overseas wife had health issues and couldn't make it to the US with a newborn baby. we wrote them asking for a postponement, we didn't hear back from fast-forwad to today, my wife and I wrote to the USCIS and requested our I-751 file back, which we found out that the motif of denial was no show for biometrics We-still married- and contemplating a move back to the US, want to restart the process, but we are not sure where to start. we were told to consider refiling I-751 but other advised to to file a I-290B We are confused and we believe it's got to be a way to file a motion and explain our hiatus for 6 years. Thanks All for your anticipated insights. AM
