  1. The way I understand it, US sees your first marriage as legal. US doesn't allow being married to several people, thus second marriage is not valid.

  3. Yes, updates are not always accurate or up to date. The same goes for processing times and estimates. And "Ask Emma" or talking to an agent sometimes results in more confusion than help - those agents make things up half of the time. E.g. people get told their interview is waived, where in fact it wasn't etc etc. I knew my GC tracking number from USPS Informed Delivery few days before it got updated on case status page. I'd only believe in NOAs / RFEs and what they tell you. Everything else is unreliable.

  5. Can you submit an inquiry? Are you sure the card wasn't mailed / lost? Sometimes the status doesn't reflect the reality.

  7. Sure. I think thi evidence may not be as important, compared to joint taxes, utility bills with both names, joint bank account statements. But you can take it just in case, it won't hurt. If it shows history of purchases, why not.

  11. @JD2 I'm taking my words back. I checked the forms (since I have the full copy). There are two G-28 forms. One for me and one for US citizen spouse. It amazes me how I didn't remember this, because I checked these forms multiple times throughout the process.
  12. Yes, you are right about spouse signature. But lawyer represents the immigrant. I went through I-751 with a lawyer and joint filing. Speaking from experience. The rationale is: the Green Card holder can remove the conditions without the spouse if divorce occurs or spouse dies etc.
  13. No, there's only one G-28. The petitioner and beneficiary for I-751 is both the green card holder! Lawyer represents the person removing conditions. Lawyer would typically prepare the forms, you just have to read them and verify everything is accurate.
  14. Looks like the priority date for F2A category is 22JUN20 Meaning you CANNOT adjust in the US for another few years, until they start processing cases file in December 2022. Also, what about I-130 for the child? Is it on file already?
  15. You have an approved I-130 in order for I-485 to be approved and Green Card issued. What was the reason for denial? Is this what you mean by "unapproved" I-130? Or do you mean I-130 is still pending? If pending, I-485, I-765, I-131 and other forms can be filed with a copy of that pending I-130 receipt. This will link the two cases together. How long ago did you enter the US? Also, are you sure you're eligible to adjust status? Your priority date may not be current! Make sure to check visa bulletin for your category before attempting to adjust.
  16. Before changing names, did you research how easy it is to change her name in the country of origin and get a new passport? There's nothing more annoying than mismatching names on different documents. The best opportunity to change name is either at the time of marriage or at N-400 stage. It can also be done when filing I-130 or if adjusting status, I-485 form. You can probably change name now, but it may involve filing forms, paying fees etc to get GC in correct name.
  17. I think typically one is expected to use emergency passport to get to Honduras and then sort out the normal passport there. That's how most of countries percieve the use case for their emergency passports. I think many countries issue emergency passport for single use, e.g. it won't be valid for travel after entering Honduras. It's something to discuss with consular officials.

  19. I'm sure it hurts, and I'm sure it matters to you a lot. To immigration - not so much. Marriages fall apart sometimes, unfortunately. And cheating / infidelity is pretty common, sadly. Unless you have clear evidence she never loved you and only used you to get an immigration status - there's not much you can do. Even in this case, if you have evidence of her marrying for GC, the logical question would be: why did you stay married knowing it was the case? Did you involve in immigration fraud? This is a possible thread of thought in somebody's head at USCIS if you were to accuse her of this. Now, to affidavit of support. Yes, you signed those papers and you're still liable. From what I understand, if she has an income of $24,650 or more a year, you don't have to write any checks. I'd think you need to be in contact with her to write any check if required. How else would you be fulfilling the obligation? Unless she comes to you asking for it, I won't sweat too much. ~ Not a legal advice ~
