  1. Sorry you are here. What is your visa category? You can see on this spreadsheet for the length of time those of us have been waiting. Without filing a WOM, there have been no cases approved since March of this year. There is no timeline any more unfortunately.   4. Exactly. I haven't responded to that email yet. Doesn't make sense at all. But what at all in this process makes any logical sense??
  5. From my case assistant at Goldstein on attorney/legal fees: "Yes; technically, you can win attorney fees. Under the Equal Access to Justice or EAJA, you can sue to recover attorney fees. And, in every lawsuit, it is mentioned in Paragraph 3 in your draft we ask the judge to award fees. But in practice, recovering attorney fees is extraordinarily unusual. Out of so many lawsuits, in only one single case did we ever actually get an award of attorney fees. So we can say with near certainty that the court will not grant attorney fees. Finally, to be clear, any such recovery of attorney fees would be exclusively retained by our firm as compensation for our work in the case. But this outcome so rarely comes into play since attorney fees have only been awarded in one of our cases, so our goal is not even to come close to Judge but we want to trigger the Defendants action to work on your case and to give final adjudication way before the Judge makes the decision."
  6. Absolutely unacceptable. I feel I will face the same fate as I will need to redo my medical. At this point, I will go camp out at the Dr.'s office and refuse to leave until they fit me in! Can you get to Toronto somehow to do the medical?

While I don't believe anyone here is going with these particular lawyers or participating in a group WOM suit, there is still some valuable information in here regarding how WOM suits work. Let me know if you have any trouble accessing it.
  10. Hi @Mary184. Welcome to the group. We are sorry you have to join us here. When was you interview? I am pretty sure we are all Canadian citizens here on this thread, or the majority at least and we have all been waiting various lengths of time since submitting our DS-5535 back to the consulate. There has not been an approval since April 5 and that was with a WOM suit. Most of us, if not all who are in the process of filing a WOM, are going with Josh Goldstein: https://jgoldlaw.com/ and yes, they do offer a free 15 min consultation (not with a lawyer) to collect information on your case, then they take it back to their lawyers and let you know if they will take you on as a client. I suggest filling out the consultation request form on their website and include as much information and attachments as possible before your 15 min meeting so they have everything in advance. They will ask you for anything additional they need to make a decision on whether or not you qualify for a WOM.
