  1. Was there a particular reason you filed 'in this fashion' ?

    I ask, because folk wanting 'faster' file concurrently, not serially.

    when you write 'visa' here, did you mean I-94 ? I hope so, as it's the I-94 dates that govern her time in the USA, not the visa.

    No there was no real reason for our method. Probably just lack of knowledge. We weren't in a hurry at that time.

    Yes, I did mean 1-94 when I wrote visa. I mean she got the b2 visa and then received i-94 when she arrived. I guess none of this matters now but that is how we got here.

  2. She needs to file for an Advance Parole (I-131). It will be free based on her pending I-485 application (fees are waived).

    If she leaves without the AP, her I-485 will be considered abandoned.

    One thing though, did you guys file for I-130/I-485 while her tourist visa was still valid? If not, and if you filed after 180 days of overstay, I would not suggest filing and using an AP, as she may not be allowed back to the US. In that case, she would need to wait for her green card to travel out of the country.

    Thank you so much for the information. We filed the i-130 while the visa was still valid. We did not file the 485, though until a few months ago. She has not overstayed her visa by 180 days yet, but it expired early november so it is getting close. Not sure how that affects our situation. hopefully you know. :)

  4. If anyone has any knowledge or experience in this subject, my family will be greatly appreciative. We are at a loss, and unable to find anyone that knows anything.

    My wife (now a US citizen) and I filed an i-130 and i-485 for my mother-in-law while she was visiting on a tourist visa. She has so far received her approval letter and had her biometrics done. I have no idea how long it takes after biometrics for the green card to arrive.

    Our question is about whether or not she can leave the country before the green card arrives. She needs to return home for a funeral shortly and will probably need to be there for a few months. Can she travel using her approval letter? Can I mail her the green card when it arrives? Does anyone know? Her tourist visa is of course expired and she was allowed to stay pending approval but can she travel pending? I am afraid that if she tries to go through customs they will see her expired visa only and perhaps give her a hard time (she speaks no english) or put her name on some sort of block list in the computer system for the future to keep her out.

    I called USCIS twice now and of course neither person knew anything about anything. They can only read what I already can see on the website. One told me that he wasn't sure but he thinks we need to file for a re-entry permit but that it would probably take a few months to get that. I thought that the re-entry permit was necessary for people that were leaving the country for an extended time anyway and it wouldn't apply here. But how can I know anything when USCIS workers don't even know? The last guy just told me to call Customs and border control and ask them. Unfortunately they are closed until Monday, but I'm not holding out much hope that they'll be any better.

    And believe me, this is not the first time I've had these issues, it's every time. I'm sure you all know what I mean. I called to ask for help with the instructions on the i-130 and the young man told me that he can't help me and if I don't understand the instructions I should call a lawyer...

    But I digress.... So does anyone know anything about this? Or do you know of anyone or any organization that I can reach out to? My poor wife is a wreck over this

  5. Hello. My wife immigrated from China in 2009 and is now a US citizen. We are now applying for a green card for her mother. We are now at the point where we need to send in the form i-864.

    My wife, who only works part time, is the petitioner. She will submit form i-864 and I will submit form i-864a as a member of her household. My question is how do we fill out our incomes? We file our taxes jointly so our adjusted gross income is listed as one number. Should I break it down so that each of our incomes is reflected on our own sheets? Or should our two sheets show the same numbers, like it is on our returns.

    To be more specific:

    On our tax return our AGI is X. This figure is a combination of my wife's income, y, and my income, z. So on my wife's form i-864, should she list figure X or figure y? Likewise, should my form i-864 list figure X or figure z?

    I was wondering if anyone might have some help here. My mother-in-law will be coming for a visit to the USA for the first time this weekend. She doesn't speak any English. I had an idea that I could provide her with a letter to carry with her that she could show people at the airport explaining where she is from, where she is going, her language issues, etc. That way she can maybe get some help when she feels lost. We are picking her up at the POE so there is no flight changes but I know how crazy it can be to come to a new country for the first time and it must be worse for her because she can't speak English and she has never even flown before.

    My wife also had an idea that maybe we should give her a letter to hand to the customs officer? Does anyone think this is a good idea? I am not really sure what I would write in there.

    If you have any examples of either of these types of letters that I could use as a guideline I would really appreciate it.

  7. Good afternoon everyone. Please read my experience and offer any advice you can. We truly appreciate it. I'll try to stick to the pertinent facts but if there are any details you'd like feel free to ask or PM.

    I am an American citizen. My wife came to US from China on CR-1 visa in 2009. Everything is fine with that. We got our AOS a few months ago.

    We are having a baby in September. We were hoping to have my wife's mother (my MIL) and sister (my SIL) come for a visit around this time to see the baby, and visit USA.

    They had their interview yesterday at Guangzhou consulate. MIL passed but SIL did not. The reason was that she did not provide sufficient evidence that she will leave USA. She brought with her an invitation letter from me with an offer to pay for travel and housing in USA for a visit. She has a good job and brought a letter from her employer authorizing holiday time and verifying her employment, etc. Her insurance card, retirement savings account, wages and job contract. Apparently, the officer didn't really look at any of these things though. I've heard some horror stories about these interviews but complaining about the officer isn't going to help our case.

    MIL is retired and widowed. She "owns" a house but still owes a lot of money to pay it off. SIL lives with her along with one other sister. SIL is age 30, not married and we think this is probably the biggest issue. This is a problem because MIL doesn't speak any english, and SIL was going to help her in travelling. In fact, MIL has never even been on a plane before.

    I know that we can reapply, but does anyone here think she stands a chance? Is there anything we can bring that will help to prove her case? I spoke to my Senator's office and they said that they can provide a letter of support but I don't know that that will really help the case. I feel like it won't hurt to try again, but it is hard because we have to pay for the application fees, travel back to guangzhou 10 hours away and all the hassles involved. I want to be optimistic and offer hope but I don't know if I can.

    If anyone has any advice on this, we would greatly appreciate it.

  8. Ok, I'll try to give enough detail without putting everyone to sleep. I'm really confused here, as I always am with government forms.

    My wife is a Permanent Resident from China that came on a CR-1 visa when we were married. She has been living here since May 2009. We are applying for visa's for her sister and mother to come for a visit later this year. I am filling a form I-134 for each of them but I am confused how to answer the following:

    9. I have previously submitted an affidavit of support for the following person(s):

    a. Should I list my wife, because i filled one for her when she was immigrating? b. On my sister-in-law's, should I list her mother and vice versa?

    10.I have submitted a visa......for the following person(s):

    I need to list my wife for this one I am pretty sure, right?

    Please help if you can. I'm waiting for the day that I can fill out a government form that is easy to read and makes sense.

  9. My wife passed her interview and we are heading to the states in a few days. It is our understanding that there is a second batch of vaccinations required. Can we do this in Guangzhou where she had the first one or is it required to be done in the U.S. We have a very very long layover in GUZ so we thought maybe we could get it over with now.

  10. the automated system says, "you're case was completed on..."

    does this mean they sent your case to the consulate? i thought that is what happens as soon as your case is completed. my wife insists that i need to call and ask someone to find out.

    the problem is that everytime i call, they say line is busy and hang up on me. it usually takes an hour to finally get to speak to someone.

    can i assume our case was sent or will be shortly or should i call and find out the date it was or will be sent?

  11. my parents volunteered to co-sponsor my wife because i didn't make enough money last year.

    i guess the first question is, can they sponsor her as a couple? or do they each need to fill their own?

    The reason i am asking this is that my mom filled out the forms with her name. on line 24 where it asks for total household income, can she include my dad's? if she does, does he have to fill an i864A?

    can someone please explain this? we are really confused.

  12. we are having my parents co-sponsor because i didn't make enough money in 2006. my wife says besides their i864 they should write a statement letter saying that we are much in love and chat all the time, i talk about her often, etc etc.

    now, i know this letter will help, but i don't think it is a requirement for joint sponsor. maybe i am wrong, please tell me if so.

    but now she says the statement letter needs to be notarized. is that ridiculous? it sounds like it to me. a personal letter needing notarization?

    please tell me what you think. i know she is overly worried about her interview and i want everything to be right

  13. ok, i am not to this point yet, but i am trying to help my wife's friend. if you know anything at all, please respond.

    Her package was sent from NVC to GUZ consulate (i don't htink the particular consulate is of importance). she says that there is a tracking number on the package that should help her track it to GUZ. she believes that it is far too long and maybe is lost. maybe she is overly worried, but i said i'd ask anyway.

    question 1. is this true? is there a tracking number on the package from nvc to consulate?

    question 2. if it is true, is there any way to find out that number if you don't have it already?

    question 3. if it is true, and you have that number, how do you track it? i mean, where to go on the net to track that package.

    i appreciate any information at all, even if you can't answer me directly.

  14. Hi everyone. i know everyone is different, but i am wondering if anyone with NVC experience can share theirs with me.

    I paid the aos fee bill jul16 (70 usd) and of course, i haven't received the packet yet. my wife is really getting upset and thinks they should have sent it immediately after payment. i have told her repeatedly that this may not be the case.

    Can anyone tell me how long it took for you? i mean, how long after payment did the i864 packet reach you?

    I'd really appreciate it and hopefully can help my wife calm down a little.

  15. hey everyone! i heard on my last post that i need to call and get my iin number first before paying my AOS fee bill online. i spent the thirty minutes that i was on hold searching nvc website trying to find where to make payment. After i got through to the operator this is our conversation exactly (after she got our info)

    Sarah: What can i help you with?

    Mike: Yeah hi. i'm trying to pay my AOS fee bill online, which i heard you can do. But i'm having a little trouble. i can't seem to find how to do it.

    Sarah: i can give you the invoice number.

    Mike: Please.

    Sarah: it's XXXXXXXXX

    Mike: thanks. but how do i get to where i make the payment. i am on NVC website and i can't seem to find it anywhere.

    Sarah: oh, i don't really know. i am not sure if it is even working.

    Mike: Ok.....well......thanks.....I guess i'll just keep trying to find it myself

    Sarah: is there anything else i can help you with

    Mike: (Sighs loudly) i guess not.......thanks
