Thank you for the replies everyone! So what actually happens after filing for the AOS is it the exact same waiting time as if I hadn’t been approved for my i130 or would it be quicker? It make me think twice about applying for adjustment of status if it’s going to take a year and it would normally be quicker sticking with the usual route? Thank you for any help

Just to try and explain my situation better and why I’m thinking about adjusting my status. One of the main reasons I’m thinking of it is due to my wife’s mental health and me not wanting to leave her what is being caused by some of the things I mentioned. That was all 😊 I’m sorry if I went into to much detail, just looking for some advice and feedback. Thank you

Thanks for the reply. I did have a return flight on the 26th June 1 week after my arrival with my mum which I ended up not using as I decided to stay for longer. Now I no longer have a return flight but I do have the money for it. That money is not being used for the car, it is getting used on a return flight or my AOS. At the time when I said to the CBP officer I had no intentions of staying, I didn’t. I had my return flight and my travel insurance for a week. But then my plans changed. I didn’t lie to the officer, everything I said at the time was the truth.

At the time I answered them questions I honestly had no intent to stay here I was due to fly back with my mum. Yes my mum did return.

Thank you very much! So it is an option as I didn’t intend to stay at the time I entered? I’ve read so many things saying it’s risky it scares me a little 😅 I’ve also heard you should wait 90 days I’m not sure if you know anything about that? Thank you for helping me and answering my questions! 😊

I was asked how long I was staying and if I intended to stay in the US. Also they asked what my job was. I told them I was only planning on staying a week, which I was and I had my return flight but they didn’t ask to see it and I told them I didn’t work at the minute. I was also travelling with my mum as she was coming for the bridal party too. I really didn’t have any intentions of staying at the time

Thank you for your reply! I used to work but got laid off late last year and have been living off my savings since. Money is tight at the minute as my wife is switching jobs and pay/rent don’t add up but we are still trying to work things out and before diving any deeper we just wanted to see if it was even legal. Thank you 😊

Thank you for the reply! We only have an issue with finances at the minute as my wife has just transferred over from one job to a different one but once everything settles things should be better. We are still trying to figure out if this route would be an option legally. Thank you 😊

Hi everyone. So I was in the US from December until March, we got married, I filed an i-130 and left the country. I came back to the US on the 19th June only intending to stay for a week as our bridal party was on the 25th so this was the reason I was coming. However I decided to stay a little longer as it feels so good to be back with my wife and our cats. Unexpectedly my wife’s car broke down and it’s costing just shy of $2000 to fix and we are already in a sticky place financially. My wife also suffers a lot with her mental health and I really don’t want to have to leave her while she is this fragile. I don’t work back in the UK and I have just enough saved for a flight home which will cost roughly the same as an AOS. Does anyone know if this would be possible? I had no intentions to stay when I first came and I got inspected by an officer who let me through. Another reason I’m worried is I have to come back in November for our main wedding party and scared if I leave I won’t have the funds to get back. Any help is greatly appreciated! Thank you
