I'm happy to provide you with what we've submitted. Our consulate is located in The Netherlands, Amsterdam.

We got approved (NOA1 April 15, 2021) yesterday, and this is what we've submitted (again, we were not sure if everything that I'm listing right now is required, but we wanted to be safe than sorry):

    1. Cover letter that describes
    2. The filled in I-129F
    3. Petitioner's birth certificate
    4. Petitioner's passport with stamps
    5. Beneficiary's birth certificate + translated (I wanted my full name for my k1 visa, and my dutch nationality doesn't include this, that's why)
    6. Beneficiary's Brazilian passport + dutch passport with stamps
    7. Previous ESTA applications that show that I traveled to the US + my old J1 visa
    8. Flight tickets from both of us
    9. Flight boarding passes from both of us
    10. Letter on how we met from both the petitioner + beneficiary (signed by both of us)
    11. Letter with meetings in the past 2 years (just 1, signed by both of us)
    12. Receipts from hotels, Airbnb, parks, aquariums, museums with both of our names on the receipts / confirmation emails (basically to prove to them that we spent time with each other)
    13. Letter with intent to marry from both the petitioner + beneficiary (signed by both of us)
    14. Photos of our engagement
    15. Letters to each other
    16. Text messages and phone call screenshots
    17. Our wedding preparations (back and forth emails with some venues)
    18. Photos of proof of our relationship (we submitted around 40 photos with date and location written underneath each photo)
    19. US passport sized photos of both the petitioner + the beneficiary
    20. A PMO check to the USCIS
    21. Form G-1145 for e-notifications

Again, most of this is probably redundant, however, I assume some of it can be used during the interview as well, which is where they decide whether your relationship is real or not.
For our consulate interview I basically copied my entire petition to bring with me, and:

    1. I added recent photos of our relationship
    2. I added recent flight tickets
    3. I re-dated all letters (intent to marry, meetings in past year, letter on how we met)
    4. Added letters of support from our pastor and the petitioner's mother

Additionally (FOR THE INTERVIEW, so after my NOA2), I also have my:
    1. Police certificate
    2. I-134 affidavit of support attached with the petitioner's last couple of pay stubs, the beneficiary's savings statement, the petitioner's savings, the petitioner's job contract, the petitioner's tax returns, the petitioner's 401k summary
    3. Around 8 new passport photos (i need them for the medical i think + the interview for sure)
    4. Proof of my vaccinations to give to the physician during the medical test, and I also made sure I have all vaccines before the medical (check the travel.gov site for the full list of vaccines)

I think this is pretty much what we have submitted, and what we are bringing with us to the consulate. I hope it helped, and again, this is what helped me get approved, do whatever you want with it
    :)

Thank you very much for the help, do I need to submit my birth certificate as well? But is the beneficiary birth certificate required when filing the i129f?

  2. Hello everyone,

im applying for the K1, I have to enter my child’s name and details, however I don’t know how exactly the details of child are written in English in the passport because I don’t have a copy of his passport, the mother of the child doesn’t cooperate.

I’m not going to take the child with me, I never lived with the child, and never paid any support because the mother doesn’t want anything and she doesn’t want me to contact them.
I only have a copy of the birth certificate, and I don’t possess the original.
Since I’m not going to take the child with me, and I’m not able to reach to the mother regarding any documents, will that affect me in anyway of getting the K-1? And what documents they can ask for?

    do your K1

    and don't stress over this

just list the child and he can answer any questions if CO asks

its not that big a deal for your K1  (its happened before and will happen again)

but i will ask "why not go and marry and do the CR1 for spouse ?"

    it is best

We wanted to do the cr1 my fiancé even planed to do the ceremony in Rome, but my family won’t be able to come, so we decided to do k1 and do the ceremony in the US!
but out of curiosity, why would you suggest us to do the cr1?

    do the DNA

How?  if u don't know where the mother is??

your fiancee should try to find her on a social media site to get this done

otherwise , like i said  ,  she can change the rules and say he really is the father

You’re right, he called the police in Ukraine and they refused to help, he called the court and lawyers, they advised him to come to Ukraine and do test, he was going to go this month but the war started.
and she seems like afraid of the consequences,

and the weird thing, she never asked for any support and she even refused taking it, when my fiancé gave her some money before he left Ukraine.
but my question is, how should we proceed now with the K1? How the child will affect the k1 process? After my fiancé gets his k1 then we’ll still continue with court and the DNA test

the child needs to be listed on all paperwork u send to immigration

and unforunately,   he needs to be included in household size of your intended family

I stand corrected by more experienced VJ members if i say this in error

and it doesn't matter that what she says now / he is on the birth as father

sounds like she plays games and since she is the major player ,  she can change the rules at any time

    so be prepared

    so,  forget all that

just know,  now,  how it affects u and him

Thank you very much for the response

however, what I don’t understand now, if we are not going to apply for K2, why the child has to be included in household size? And after my fiancé do the dna test, and he proof that he’s not the father, will the child still be in the household?
can the mother affect our relationship or the k1 process in anyway?

Us government will not make him

but CO at interview may have many questions about the baby and they have been known (this is at casa embassy ) to ask about support

and u say not his child but he had reasons to believe it was and signed the certificate so until and if a DNA test is done,  he has to claim the baby

and i had to provide birth certificates for my husband's RFE (but this was for Casa and a big age difference between us) Germany is a lot different in the interview stage

and u don't usually have these for a K1     / u asked about k2 for the child and that was answer to that

The mother reached out to him in 2019 told him that it wasn’t his kid and she kinda apologized for that, and asked him to send a document to forfeit the rights and remove the kid from his name. IDK if he should tell the whole story at the interview.
And yes I don’t want to apply for K2, so if only K1 then they shouldn’t ask a lot about the child?

  7. Just now, JeanneAdil said:

If u do not apply for a K2 visa for the child , he won't get one

and if u have no contact with the mother,  u would not have the birth certificate or other info to apply for K2

but if this is his child, he needs to support the baby

What do you mean by support the baby? Do you mean that the US government will ask him to support the child, and no child is not his, but the case is still on hold due to the war in Ukraine at the moment.

He doesn’t know the current address of the child and his mother.
If he doesn’t provide the birth certificate of the child will that cause any problems for my fiancé getting the k1 or the petition get denied?

The answer is Yes since court proceedings/DNA test did not happen yet.

Do you know if the kid will still get K2 visa, because I don’t want to make K2 visa for the kid, especially when it’s not my fiancé’s kid and is the mother of the kid will get any kind of visa?  Thank you

First question, is this someone you have met. Physically.

He is on the birth certificate until he is not.

Sounds like he is not a Ukrainian resident.

My BF is from Morocco, he lived in Ukraine and now he’s living in Germany with a refugee status,  working as an engineer. He’s on the birth certificate of the kid and still trying to remove his name.
He doesn’t know where the kid is living now and hasn’t any contact with mother.

  10. Hello everyone,

I just started filling the I-129f with my partner.

there is a question if the fiancé has children.

well it’s really difficult to answer this question.

the fiancé is from Morocco lived in Ukraine, then moved to Germany and applied for refugee status in Germany, he now has a refugee status and residence in Germany.

back in Ukraine his ex GF, claimed that she’s pregnant from him and they registered the kid on his name, however after he moved to Germany the same GF called and told him that she wrong and he’s not the father, and she wants to remove the girl from his name.
He sent a document from Germany, declaring that he agree to forfeit his parental rights.
Due to the situation in Ukraine now, court is not working and girl with the kid moved to Slovakia.

Now what should the fiancé answer in the I129f form Yes or No , to question does the beneficiary have children?
Also, the fiancé lost his Ukrainian permanent residence, should he still answer yes for question in D-160 “do you have a permanent residence in any other country”?
if he answer NO, will that be an issue.

    please help

    thank you in advance
