    It seems like USCIS has approved a lot of applications recently which has created some backlogs in card production. Just hang in there. Good things you know she was approved 😊

    I only got 1 email “we have taken action on your case” early in the morning around 5:41am on march 14. I know there would be a delay on update so I didnt check the status immediately. Around noon, the status changed to “Card was delivered to me by the post office”. Other than that  i didnt get any email notifications for “card is being produced” or “card was produced” at all. 

     

    Just know that they are working on your card production without updating your status lol. At least a bunch of people have experienced the same thing as I have seen. If they do update yours, consider yourself lucky 😅

    Good for you!! Are you adjusting from K1? 
    Mine was delivered yesterday after a whole week of no status updates whatsoever. It went straight from “card was produced” to me got it in the mail.

    The first expedition was on 02/14/23. I got an email requesting additional documents a few hours after referral number was created. I faxed all docs later on the same day. 
    Did not hear anything in the meantime. I decided to fax the same docs 2 more times a few days after. 
    Half a mont went by, decided to give another try. Second expedition was on 03/01/23. Got the same email I got the first time within a few hours. Faxed THE SAME docs I did the first time right away. 
     

    Got it approved on 03/06/23.

Based on our case, I would say yes after receiving my A-file via FOIA. My AOS was approved last month after waiting for over 1.5 years. My husband uploaded a new I-864 when I finally got a US job with evidence as the first one submitted at initial filing was very weak.     Being a "curious George", I elected to see what USCIS has about me so I requested my A-file via FOIA online. I received the ~1000 pages that USCIS has about me 10 days after FOIA request. The file showed that they used the unsolicited evidence to approve our case and waive our interview. We meant to give them an updated I-864 in our interview but I am glad we uploaded online instead. Our case was approved without interview. I always wondered whether USCIS uses unsolicited evidence that you upload and based on my FOIA A-file, they did. All unsolicited evidence that I thought made my case stronger were used. I just wanted to share.

    Did they state directly they used unsolicited evidence you uploaded in the FOIA response letter? I'm still skeptical because a tons of people in this forum claim that USCIS don't even bother to look at those evidence and suggest us to bring them to the interview instead.

    We finally found a joint sponsor with great income and proper W2 tax and all the good stuff.

    We sent our response to RFIE off on Monday 11/14/22. How long does USCIS typically update the status that they have received the mail package on the USCIS online portal? 

    I have seen lots of people get their EAD approved within 30 days. Hoping mine will progress that fast as well but having RFIE in the mean time is frustrating.

    Well, as far as I know, they only consider tax documents for the most recent years which is 2021. If your "TOTAL INCOME line on IRS Form 1040" does not meet the HHS poverty guidelines for affidavit of support (for reference, find it HERE), then you need to find a joint sponsor. Unless you have other assets to make up a deficiency.

    It seems to me that I-864 is the trickiest parts of the whole AOS application because according to people experienced, USCIS is likely to issue RFE in regards to this.

    However, we also got a Request for Evidence on the account of my not being qualified to sponsor my partner? I am very confused and don;t understand why I don't qualify. Has anyone done this? Or had to go about adding a co sponsor? I really want to get this done quickly and effectively but I am feeling way out of my depths.

    I got a RFIE as well. Does your income meet the requirements? Check again if you’ve missed to provide any financial documents? If not, better off finding a joint sponsor to limit any delays. 
    We’ll send our RFIE response tomorrow.

    Do you have an online account? Check your Documents tab, the biometric notice should be there. 
    You can also connect with live chat agent and ask for your biometric appt date. That’s what I did. 
    If not, just wait for the notice in the mail.

  10. Hi guys. I just decided to register for an online account and was able to see the RFIE online. Thanks to @Family , I learned that as long as I dont withdraw form G-28 under "Case Actions", mail notice will be sent to both my address and the lawyer address as stated on the G-28 form.

     

    Back to the main point. As most of yall have already guessed, the RFIE is for I-864.

     So my lawyer did include bank statements showing sufficient amount of more than 20k on his savings account, but she only included January 2022 and the most recent bank statement to show how consistent the savings amount is within a year. According to the RFIE, they mentioned "Bank statements covering the last 12 months" in the first bullet for "Acceptable evidence of assets". So I see where the flaw is now. 
     

    Nevertheless, just to be on the safe side, my aunt will get on board to co-sign for our affidavit of support I-864.

If your attorney FOIAd his file , I will assume he included enough info for his aka ( on his birth certificate, old green card that shows A#..) .     2. Your I-864 and self employment income ( 1099) is most likely the culprit ..even though the tax return showed $x amount and attorney added your $ savings to cover shortfall…it does not sound like she /he prepared the dreaded “ current income” docs for self employed ..

    Basically 6 months of bank statements showing gross revenue/ deposits along w 6 months of profit and loss statement that backs up current income …

    IF you have a Joint Sponsor, get them on board. 
     

     

    3. They will pause processing the case ( I-765/I-131) until you respond to RFE
     

    4. No reason not to set up USCIS online account..assure your attorney it will NOT interfere w her getting copy of notice/ correspondence specific to G-28 legal reps…and you can offer to be her/his first test case .

    4. For some reasons, my lawyer told me not to register for an online account because it may interfere with her getting copy of notice. That sounds odd to me. But I have not experienced this before so I chose not to do so. If I do, do you think it will cause any problems?

    I'm still waiting for the notice in the mail. Since it's a request for initial evidence for I-485, I'm thinking there's something wrong with I-864. Since I'm about 2 weeks away from Biometric appointment, I think we will have enough time to respond to the request. I've seen people get their EAD produced in the same day with their biometric day so I'm really hopeful. How's your process so far? Are your receipts IOE 917?

    1. Yes. My spouse's legal name matches with the certificate of naturalization and US. Passport and all other documents.

     

    2. I know. We have to wait for the physical notice in the mail now.

    My spouse actually acquired a copy of certificate of Naturalization through FOIA request. We also included my spouse's US. Passport along with the certificate copy as well. Do you think those aren't sufficient enough? 
    I know I'm now stuck with RFIE. Can't make any move until receiving the notice in the mail. However, according to your knowledge, are you aware if NBC still go ahead and process work authorization and travel document after biometric appointment is taken while we prepare for RFIE response?

    I understand what you say.

    However, there are different information floating around saying US. Passport is sufficient enough for proof of citizenship. I'm hopeful if that is the case so my spouse wont have to file for N-565 which costs another $555. 

    Do you know if I-485 RFIE could prevent USCIS from issuing work authorization and travel document in the mean time?

    1. I should have included this in the original post because it’s one of my concerns as well, but my lawyer didn’t think it’s big of a deal. Long story short, my spouse lost his original certificate of Naturalization during the Passport application. So he filed for FOIA request, and thankfully, USCIS was able to find the record. (They sent us 2 letters and a digital copy of the certificate) I’m not sure if this could cause any issue or not. Nevertheless, we included all the FOIA responses from USCIS plus a copy of his US. Passport. Should those be satisfied? 
     

    2. We do have a co-signer ready if need be.

    October 2022 AOS filer here!

     

    USCIS just issued a Request For Initial Evidence for I-485 today 31/10/2022. I know we have to wait for the mail to know the detail of what initial evidence USCIS is requesting for. But in the mean time, I would like to ask some of ya'll who have been through this situation to know what could possibly be the reasons for the request? Should you guys have any inputs, please do give me a response. 

     

    I'm adjusting my status from F-1 (senior year now). Married to US Citizen.

    My timeline:

    • 10/13/2022: AOS package submisson to Chicago lockbox. Concurrent filling (I-130, I-485, I-131, I-765)
    • 10/17/2022: Case was received and a receipt notice was sent
    • 10/24/2022: Received 4 receive notices in the mails (we didn't file for E-Notification)
    • 10/28/2022: Biometrics appointment was scheduled (for 11/17/2022 I was able to ask Emma)
    •  10/31/2022: Request for Initial Evidence was sent

    I have not signed up for an online account because my lawyer advised me not do that. She said having an online account may prevent USCIS from sending notices to both my address and the lawyer office instead they will only send notices to my address. As far as I know, some of yall have access to Document tab on the online portal to see what the RFIE is for right away without having to wait for the physical mail but on my end, I have to wait for that. 

     

    According to my lawyer, my evidence is very solid. We have gathered as much evidence as possible for the initial submission along with medical exam. However, for the income requirement, my spouse only made 22k (after deductions and everything 1099 form) last year. However, my lawyer was able to use my spouse's saving account of more than 20k to prove for assets to make up for the lack of income. She said only 10k is enough to make up but having more is much better. So we ended up not having to file for co-sponsor. Could this be a reason for RFIE? 

    My spouse also change his name during Naturalization but he didn't keep a record so we didn't include evidence for name change in the submission. To better prepare for possible future request for evidence, my spouse has submitted a FOIA request for this. It's still been under processing. Could this be a big issue?

     

    My ultimate concern is: Could this RFIE for I-485 prevent USCIS to process my I-765 and I-131 in the mean time? Do they stop and wait until they receive a response for evidence from us so they can continue to process my work authorization and travel document?  

    I'm aware this process can take a long time. But as long as I receive the work authorization and SSN or travel document, I'm fine to wait for the interview or green card after that. 

     

     

     

     

  18. Just an update guys 

     

    Got a notification from lawfully app that my biometric appointment was scheduled on October 28th. So it’s only been 12 days in 😋 I’m excited!! 
     

    Can I possibly ask Emma regarding my biometric appointment day? Otherwise I have to wait for the physical mail to come in.. 

    My lawyer advised us not to register for an online account because that may cause uscis not to send notices to both the lawyer office and my address so I dont have access to the account to see any documents.
