I forgot to tell about the pickup of the VISA:
Dec 13th - arrived 1:30 at the Consulate. Different Security Guard, not very friendly - must have gone through this since the beginning of his career as a Guard at the Consulate. He said to return at 1:45. So we again went for Starbucks. I had the kids wait with my purse (with electronics) there. I arrived at 1:45 and was about 6th in line. Didn't want to tick anyone off, so I got through security and they advised to tell that I'm picking up my fiance Visa, so was actually expedited. We got the Visa, Ms. Ophelia was there to greet me at the window and reiterated her instructions with the pending K2. All is done, and I skipped back into Starbucks to collect my kids, coffee and purse and we walked back to our hotel to get our bags and onto the aiport.
Did I mention my best middle school friend took us out for lunch? It was a grand day.
So we got to the airport in hopes that we could catch an earlier flight to catch a connector home, to the Arctic, no chance, we had to book a hotel in Edmonton for an early morning flight, I wanted to party with my friends, bid my farewells and have a drink since it's been a few weeks. I think I lost about 7 pounds, but oh well, at least if I find a white dress it would feel not so big and white...... But white really doesn't have to be anymore right???? Sheesh!

congrats on ur visa! did u request the date for ur interview? i heard on here that vancouver only interview k -visa on tuesday and thursday?then i heard that the doctor also only give appoinment on wednesday for immigrant medical?so the two days in ur post shows tuesday for medical and wednesday for interview how come.please i will need more insight here

So I'm the mom and doing leg work for the "kids" son meets beautiful Bulgarian woman this summer while home on leave and she is in the States working with Student Work Visa, son proposed from an undisclosed deployment location Christmas Day....beautiful girl had already gone to the Bulgarian Embassy for Visitor Visa. Could they get married in the States next month while she visits? What should she do? Has meeting with Bulgarian Embassy Jan 22....thanks for the guidance!
She can get married, but can't stay, and would have to return to Bulgaria and apply for a K-3 or CR-1 visa. If she stays, since they're already talking about getting married, they may have a hard time proving there was no intent to stay and adjust status, which could cause a lot of problems, mainly, visa fraud which is a deportable offense.
I'm a little confused. The OP says "she's here..." but that she's gone to the Bulgarian Embassy for a visa. If she's here, she doesn't need another visa now and she wouldn't get it from the Bulgarian Embassy. So, let's back up and get the facts. Where is this girl now, and if in the US, just what kind of visa is it? If she's still here on a student visa that allows her to work, then as long as she doesn't overstay, they can simply marry here and file to adjust her status to permanent resident. On the other hand, if she's gone home to Bulgaria, any new visa would be obtained at a US Consulate in Bulgaria, not a Bulgarian Embassy.
So, Mom, what's the scoop?
more elobaration please, i guess she came on a student visa, then she went to bulgaria for visit when her student visa still valid, once she had her valid visa to return to usa she can get married to him and adjust status she does not need to go back and wait for CR1 or K3. then back to Q that she does not need visa to go to bulgaria she could need one some student visa will not allow u re-entry so if u want to visit ur home country during ur study u need visa. talking from canada student visa experience dont know about usa tho.

I am a newbie so please be gentle.
This visa thing is a bit of a nightmare and very involved. I have read a lot of info on the web and I think I have a general overview but would like someone to "sanity check" my understanding of it, if anyone would be so kind.
My situation is as follows:
My wife is a US citizen. I am a UK citizen. We got married in the US seven years ago and she moved to the UK the week after we got married. We have both lived together here ever since. We are now contemplating moving back to the USA. She still holds a US passport and has indefinite leave to remain in the UK.
As I understand it, my wife has to file an I-130 to start the ball rolling.
Obviously at the point of entering into the US neither of us will have jobs. We don't have much in savings, however, we have plenty of equity in our current house here in the UK, enough to satisy the "3 times 125% of the poverty line figure" rule for the 48 contiguous US states as described
here.
the best option for u is to file direct filling consulate, wish is faster, but i guess u still need co-sponsor, i guess someone will put more insigth to ur Q
Questions:
1) As I understand it I can't use the K-3 visa method as the US citizen filing the I-130 resides outside the US. Is this correct?
2) In the absence of any relatives who would be able to file an affidavit of support, would the I-130 petition be likely to be successful -
2a) before selling our house (if we could prove the amount of equity, in dollars)
2b) only after selling our house (in other words our capital would be "liquid")
3) Are there any other options open to me?
4) Any other general advice?

Hi everybody,
My original plan was to mail my I-129F packet tomorrow, collect and notarize info for affidavit of support over the next month, and then go through with my longstanding travel plan to go to India to be with my fiancee from early Feb to mid Jun.
So I called USCIS earlier, and the person I spoke to said that my forms should be notarized and filled in only after I receive the NOA2. So then I thought, okay, I can have the NOA2 mailed to my address in the states while I'm in India, and then when I come back in June I can get things notarized and submit the affidavit. Looking at the timelines on here, I figured I could expect to receive the NOA2 in about April. So I called USCIS and asked what the grace period for submission of the I-134 is, and the person I spoke to said that there is no set amount of time, but that it is usually between 30 and 60 days. Which would be while I'm India, most likely, and then the case would be considered "abandoned" and be rejected.
What should I do? Is there a way around this? Should I cancel my travel plans and wait?

I'm hoping to get some information for a good friend. My friend's fiance arrive here legally about 7 years ago on a tourist visa. She overstayed and has built a life here. They met and feel in love and now they want to get married. I know a overstay is forgiven ( AOS ) if married to a US citizen and the foreigner entered the US legally. The problems is all the documents proving legal entry were destroyed in accident. Any advice on how legal entry can be proven?
She has to prove that her evidence was destroyed in an accident. One of the proves may be something like an accident report
if he has copy those or his passport that he use to travel to states, it can help in some instance. all his information will be with uscis either through the port of entry or through the embassy where he got his visa from,

I am preparing for DS-230. I have a question. I got a speeding ticket and paid almost 180 dollars in Japan in this May. Of course I only had to pay fee and nothing else. No arrest or anything. And now I am filling out DS 230 Q31. It says Have you ever been charged, arrested, or convicted of any offense or crime? I called up the embassy in Tokyo and asked if I had to say yes or no. The lady had no idea what she was saying. All she said was to attack paper and explain. Well, what should I do? Should I simply say yes and explain? or should I just say no, but attach explanation with receipt of payment ? Please help me.
i dont think u need to put yes at all, speeding ticket is common, here in canada it does not matter, since u re not charge or arrested even convicted why putting yes. if u apply for ur police cert is going to show on the report that u got a ticket, so i dont think u realy need it.

In my Approval Notice, it says that if we want them to, they can forward our case to another Consolate abroad as well!!
I am wondering if this is advised in my case? My fiance is a Nigerian citizen but living and working in Ghana...
He has a legal WORK PERMIT IN GHANA but does not have offical GHANA RESIDENCE... He has applied for Ghana Residence but has not heard back yet....
So my question is, although he lives and works and is settled in GHANA, should he ALSO have our case forwarded to Nigeria in addition???? Would this complicate things? Or could it get him to me sooner???
Anyone Know????
he can continue the proceesing in ghana once he has work permit there, means he is legal

hello everyone,
I have a question. My 1-130 petition has been approved at NVC since october 2 2007. The case has not been scheduled for an interview yet. They claim there is a lot of backlog in my home embassy.
Just today USCIS approved my k-3 application. I am actually ready to pursue the k-3 visa now beleieving it will be faster since the inetrview is scheduled by the embassy. My question is:
How does NVC handle that kind of situation?
Given that my I-130 is waiting for an interview date (God knows when), will that prevent them from forwading my k-3 to the embassy when they receive it ?
How long does it take NVC to receive completed application from USCIS. I originally filed in Chicago. I have no idea where they sent it to thereafter.

I have seen brief mention here of a civil surgeon in Texas, who will transfer the vaccination supplement from the panel physician to an I-693A for $10.00 and I all I need to do is fax him my vaccination supplement.
Is this true? And if so, does anyone have this doctors name and contact info?
I found a civel surgeon close to me who will do it, but they want to charge $50, so I figured if I can save $40, I will give it a shot

Just call them, leave a message, and they will call back shortly. You basically have to mail them a copy of your immunizations and a couple other things, and then they mail back the proper vaccination supplement.

I called today, but I don't think they'll call me back before mail pick-up this morning.

After all that waiting, my fiancee had to move. She has been living temporarily in Canada for 2 years. I filed for K1 in May and finally got approved and the NVC has now forwarded our documents to the US Consulate in Canada. But now, my fiancee had to move back to her country. How can I transfer the documents from Canada to the new consulate? Does anyone know which form to fill out? Will we go back to square one in waiting for her interview or will it just be a continuation of the wait? Our approval notice is only valid til 01/25/08. Will this deadline affect our transfer? I appreciate all your comments.
first which one of the consulate, montreal or vancouver? then what is ur fiancee status in canada and why is she moving when the journey is almost ended? has her status expire in canada? i guess the moves u can make now is to contact the particular embassy in canada and explain the reason of her moving but must be good reason, then she can go to the us embassy in her home country where she is moving to and explain her situation,cos i read about some folks here who tranfered their case from montreal to ireland cos he was on visitor visa here. so contact the embassy in canada and us embassy in her home country

After submitting to the Vermont Center in June 15th, we just got our NOA2 on Dec 4th. Almost 6 months. Now we're expecting the NVC to process quickly and then send the info to the US Embassy in Japan. Crazy, my fiance and I can't believe the process is actually moving.
We have two questions:
1) What is the average wait time from now (receiving the NOA2) to getting an interview appointment? Specifically, we're interested in what people have experience in Tokyo.
2) We've spotted errors in our applications, which we don't know for sure if they were corrected. Should we contact the NVC for this inquiry, or just bring our evidence and explanations to the interview at the US Embassy?
The errors were missing "Other Name" which is her birth certificate name from another country than where she currently lives. Also, there is a wrong "City of Birth" as Hong Kong is a country, city, and we think province as well.

first congrats on ur approval. i think u've ask this Q B4, but good u scape through uscis, i dont think u need to send any explanation to nvc if they dont ask for it, then she can go to the embassy with any document or explanation she might needed.

I recently was married in Mexico and am now trying to prepare the paperwork to file for a K-3 visa. I always knew that my marriage certificate would need to be translated from Spanish to English for the benefit of USCIS, but another potential problem just occurred to me.
I've saved the chats that my wife and I have had over the past 4-5 months in MSN Messanger, as well as our e-mails, with the intention of submitting them with my K-3 application as evidence of an ongoing relationship. However, because my wife doesn't speak English well, all of our written communication is in Spanish. So here are my questions:
1. Do our chat transcripts and e-mails need to be translated into English?
2. Can I perform the translations myself in order to save what will no doubt be a significant amount of money?

We are still waiting for our case to be transfered to the NVC, where it will then be sent to the US Consulate in Calgary, AB. I was wondering if anyone has any experience or any info about what the interview and timelines are like there. I see a lot of postings about Montreal and Vancouver, but nothing about Calgary as far as I can tell. Any thoughts?

sorry, us consulate in calagry does not process immigrant or any k visa, if u live in western canada ur case will be transfer to vancouver, if u live in eastern canada ur case will be transfer to montreal,that is the only 2 embassy that process that kind of visa.

My Colombian wife and I were married here in Colombia 3 months ago.
I am currently completing the I-129 as part of the K3 process (I-130 already submitted).
Since the I-129 (K1 visa) is for single couples intending to get married I have a question.
In line 6 (marital staus), do I state I'm single as well as for my wife even though we are married to each other? How about the accompanying G-325a. Do we state we are single or married? This is confusing!

nope u have to state u re married, any Q, that applies to fiance on i-129f applied to u as spouse, since the form is originally implemented for fiancee and now use for k3, since uscis has not gotten another form for k3 so use it as spouse

Can somebody help me out here please!!! i have a friend who petitioned his fiancee` and got married a wk after the girl arrived in the US. But he found out that the girl really didn't want to have anything to do with him. Basically, she just used him to come over to the US. What do you think he should do? He already filed a complaint with the INS about this incident. It's been 3mos when this happened and i think the girl's visa expired last fri (Nov.11th) What further action does he need to do next? I need some input PLEASE!!! Thank you....
if he does not want to proceed with the application any more he can inform uscis by written, then the case will be closed, the girl will have to return to her home country. but i will imploy ur friend to give it a seccond thought b4 he could take such an action.

Has anyone heard about USCIS 'ICE' Police officers visiting an applicants employer, on a K3 before any NOIA or anything?
A uniformed USCIS armed Police officer showed up to my DC federal job, in a department of 7 people with no other visa people in my department and spent about 15 minutes with my boss, and made about 2 pages of notes on a yellow 5 x 7 pad of paper.
I asked my very stern nontalkative boss about it and he, an immigrant himself, said "oh, that was nothing".
Now I know they probably have to train thier ICE cops and they like our cafeteria on rare occasions for breakfast, but this seems wrong and bizzar. What if my boss hated immigrants, or I did not discuss my reasons for leave being to get married or that I got married at all?
I have not even recieved one single reciept from USCIS yet, they got my I-129 and I-130 on October 24, 2007. On November 19, I was not in the system when I went to the local office. And 10 days later they are doing a job site interview with my boss? Any other similar stories?
let me get u clear, cos this is strange, re u the petitoner in US, does this happen in US.

sure ur fiance is a USC, no doubt about that. cos LRP can not file I-129F , he just need to register ur child at us embassy,ur child is automatically USC.
