  1. Use the expected income from the new job. Be sure you get an employment letter from your employer. Check the VJ wiki for the proper format of the employment letter. You should probably file the 2009 taxes just the get the small amount back that they withheld from your pay during those two weeks in December 2009. Otherwise you have to include a letter explaining why you didn't need to file. You may also want to include a letter of explanation as to why the 2009 income was so low(in the Philippines, etc.).

    The poverty guidelines are for INCOME (from any source eligible source) before taxes, so that would be GROSS. The instructions for the I-864 goes into quite a bit of detail about what information they want.

    You maybe want to consider looking for a co-sponsor in case the consulate doesn't consider you're projected income from your new job to stable/reliable.

    ahhh George you are a life saver! :thumbs: that cleared up the confusion on my part.. if i understood correctly, the I-864A is for a co sponsor living in the same house hold right? say i use my brother, would his income and my income COMBINE to meet the poverty guideline or does his income and his income alone have to be above the poverty guideline.. thanks in advance :blush::)

  2. ok. send an email to the nvc. i think its nvcinquiry@state.gov

    in the subject line put ' atttn pi supervisor sue: expedite request, your case number, beneficiary namw and dob and petitioner name and dob'

    in the main body of the email, put your reasons and attach supprting documents if necessary. i did that as pdf files..

    its not easy when you have to expedite. i hope it goes smoothly for you.

    give them a few days and call. the nvc will request an expedite from your consulate, to be approved.

  3. I have a complicated situation and i need help understanding and clearing things up.

    From April 2008 to November 2009 i was in the Philippines. I came back to the US on Nov 25 2009 and started working 2nd week of December. As noted on the IRS website, Publication 501, Table 1. (http://www.irs.gov/publications/p501/ar01.html#en_US_publink1000220674) “IF your filing status is SINGLE, and at the end of 2009 you were UNDER 65 YEARS OLD, then file a return if your gross income was AT LEAST $9,350.” Since my gross income for 2009 was under $9,350 I did not have to file a tax return for the year 2009. I understand would have to write a written explanation why i didnt file a tax return for 2009.

    Now, I only work on call/per diem with my first job. I now have a 2nd job and i have only been with them for one month. when i submit the AOS package i'll probably have received my 3rd or 4th paycheck. My question is this, WHAT DO I USE FOR MY ANNUAL INCOME? last time i received a paycheck for my on call job was about a month ago. Do i use my full time job as my ANNUAL INCOME? since 2010 is about to end should i base my EXPECTED ANNUAL INCOME for the year 2011 or 2010? the dollar amount under the 125% poverty guideline, is the GROSS or NET PAY? it's very unclear to me so if someone can help explain it i'd greatly appreciate it :)

  4. No the w-7 is what gets the USC to be able to file married on tax return. ... Just send all orginal NSO documents and passport copy by dfa official. If your spouse is from philippines anyways.

    Thanks :) and yes sir my husband and i are filipino. i read from another thread about the w-7 and i've done a couple hour research about it prior to visiting vj. when u mention PASSPORT COPY BY THE DFA OFFICIAL, do u literally mean, going into DFA office and requesting for a "passport copy". i'd have to give details to my husband on how to attain a passport copy so if u can please elaborate on the DFA procedure i'd greatly appreciate it :D

  5. Good luck with everything Sufrank! Like yourself, i also moved to my spouse's country to be with him. i was there for one year and 7 months. i can say it was totally worth it. it was a personal decision i had to do to make things work for him and I. it got too hard on me being away from him. right after nursing school i decided to move to the Philippines. that was back in april 2008. i've been back here in California for one year one and i'm trying to start over. we like to think these are just obstacles for us to test our marriage/relationship. it's not easy but it has to be done...for the future. i like to think that LOVE IS PATIENT and i know when that day comes when my husband and I are together HERE, it will aaallllll be worth it. :D

She is from Davao It was alright cept for the blasted rolling blackouts and water shortages :P i went during election season so all the elected officials were syphoning funds from thier respective offices and doing little to help the people. But it really wasn't a bad experience would not have left if religion wasn't forced into the curriculm at the college level.

    i'm glad u liked it. u said u attended ateneo? in manila? after high school i went to study in the philippines. i went to La Salle. my aunt was the town counsilor of our town so all eyes were on me while they try to kiss a$$ to her. someone ratted me out saying i wasn't going to school. i was, just not my ENGLISH class. hehe. my mom got really mad so i had to fly back to the states after HALF of the semester haha. since i grew up here and my english was "perfect" to them, my english teacher was ok with me not attending as long as i turn all my stuff in and i dont miss test days. but ya those were the days haha.. :ot2: sorry hehe

    I STILL HAVEN'T HEARD ANYTHING ABOUT THE EXPEDITE. I TURNED IN ALL THE SUPPORTING DOCUMENTS A MONTH AGO AND STILL NO NEWS IF IT WAS DENIED OR APPROVED.. :( :( :(

  7. Once my wife arrives we intend to have a larger more powerful boat built for him so he can better provide for his family.

    I don't want to risk hurting his pride by just sending money every month. Much better to give him the tools to make more money himself

    oh oh oh story time I like this game :P Mine goes a lil like this. I am 26 she is 23 we got married on june 1st 2009. First contact was online "social networking site" I was a Marine stationed in Okinawa. We talked online for about 6 months then once i was discharged due to medical and was "allowed" to go see her i stayed with her and her family for a month. In that month I fell in love with her, her family, and filipino hospitality. We got married toward the end of my first stay. I came back tot eh us worked for about 6 months then decided i would go there to make it work use teh gibill go to school and live very well. I went tehere got my residency and accepted to ateneo. Thier curriculm was a little to be desired so I came back here got 2 jobs going to school and now we are have the I-130 in and after a year and half hoping we get her here lol. I would love for her to get here by april or may, but even if it does take the extra month it might be to our advantage cause june 1st is our two year anniversary which would be an automatic removal of conditions ate poe if i have read right :)

    i'm hoping that my husband gets here by may too. our bdays are 10 days apart and i want to take him to Las Vegas. it'll be a blast. lets just hope all goes well for us and our plans :) hehe.. it's nice to see we're in the same age range. we're 24 . where is your wife from in the philippines? how did u like living there?

  8. Great wedding video, my wife & I intended to have one too but we ended up just having pictures.

    when we arrived in Romblon province, My soon to be father inlaw had a huge infection on the back side of his head.

    He needed to go to the hospital RITE THEN!!

    After a couple of day the local hospital said that the wanted him to go to Manila.

    I told my wife to take some of the wedding money & give to parents to cover his medical costs.

    I still think it was a great wedding though

    Expedite Criteria

    All expedite requests are reviewed on a case-by-case basis, and are granted at the discretion of the Director. The burden is on the applicant or petitioner to demonstrate that one or more of the expedite criteria have been met. The criteria are as follows:

    * Severe financial loss to company or individual

    * Extreme emergent situation

    * Humanitarian situation

    * Nonprofit status of requesting organization in furtherance of the cultural and social interests of the United States

    * Department of Defense or National Interest Situation (Note: Request must come from official United States Government entity and state that delay will be detrimental to our Government)

    * USCIS error

    * Compelling interest of USCIS

    if u can give proof what i've highlighted in bold then maybe maybe mayybeeee the expedite will be valid. but then again i might be wrong hehe.

    i filed for expedite due to financial hardship. i've turn in my supporting evidence but still no news :(

  10. THERE IS NO DIVORCE IN THE PHILIPPINES.

    i recently got married in the Philippines and in order for us to get a marriage license, my husband and i had to submit every single document from baptismal papers when we were a baby to our certificate of no marriage. What city/town did you guys get married at. And how come you and your wife didn't talk about this 'issue' prior to getting married? anyway, even if your wife's first husband has already died or they haven't had communication in years, u still need to file a petition for annulment on the grounds of ...psychological incapacity, presumption of death (u have to prove why and how. war zone? battle field, etc), bigamy, etc..

    I'll tell everyone a little about myself due to the fact that all of us will be spending time together in the next few months.

    I'm 40 & i live in New hampshire

    i got married in the Philippines back in June

    My wife is a nurse there she is 27

    we have no childeren at this point but thought it mite be a good idea to have 1 or 2 in a few years.

    We were married in the remote province where she is from & where her parents still live.

    when i say remote I'm talking 20 hour boat ride! ! !

    Hi Piglett! Welcome to "our" forum hehe..and yes u are right we'll be spending the next few months with each other. no one has really introduced themselves here like u have so its nice that u did :) well since we're on that topic let me introduced myself ..and my husband hehe.

    my husband and i are both 24 yrs old. We've known each other since kindergarten. lost contact for about a decade then in 2005 we started talking again. we married last august in the philippines. theres a video of our wedding under my signature. no kids yet, maybe sometime late next year or the year after. i'm a nurse here in san diego and he works for the city from where we grew up at.

    i hope these next few months will fly by quickly so we can all be with our loved ones :)
