    I applied for advisory opinion for 212(e) waiver on Nov 2, 2020. The US state portal suggest 212(e) finding letter has been sent on Nov 24, 2020. However, I haven't received the letter yet. I have called multiple times, no one picks up the phone. I have emailed at the given address- no response. Does anyone know how long does it takes to receive the letter once sent. Can I reapply for the advisory opinion?

    Assume that you were subject to home-residency requirement (HRR), and apply for the waiver instead of reapplying for the advisory opinion. I think reapplying would waste time. If they find you are subject to HRR, they will let you know that, otherwise process your application to issue or not issue FR depending on your situation. Just an opinion, not sure if it's best.

    Yes, actually my employer applied for me and at the end, the case was approved, but with a consular appointment, which means that I needed to leave the country and get the h1b stamp in order to activate it. The problem now is that in ds-160 I need to check that I have completed/waived the 212 requirement. 

    Regarding the waiver update in DS-160: Can you file new DS-160 by paying fees one more time?

    DoS updated the portal saying that they received my documents on January 18, 2022 (which they actually received in September 2021). The portal doesn't show the receipt of the No Objection letter yet. Hopefully, they will update it soon.

    Thanks for posting your update, @palvi07. It is such a relief to see that things are moving. Based on your timeline, it looks like that DoS would take at least 17-18 weeks for the first record/update to show up on their portal.

    PS: as said earlier, the update was on Tuesday. So most likely DoS is updating their portal once a week, most likely no later than Tuesday of a week.

    So my process is done! I got both I-797C and I-797 on the same day. 797C was issued 4 days before 797.

    Could you please post your complete timeline? Was it NOS-based application?

    For anyone wondering at what stage of waiver can they apply for H1B: My visa advisor (cap-exempt research position) told me she needs I-612 approval notice. Then my DS2019 was about to expire, and she applied for H1B using a screenshot showing DoS FR! My best hope was an RFE for the approval notice. H1B was approved in 8 days, no RFE!

    After months of waiver pending, this was the best thing that could happen!

    Thanks. I am planning of asking my visa advisor to do the same (if I get FR, and on time)..

  6. @mitronThanks. It's very clear and detailed. My check was cashed on Oct. 22, 2021. Embassy sent NOS on Oct. 29, 2021. It has been more than 10 weeks now but no record on the website of DoS. I am so worried. My DS-2019 is going to expire on April 30, 2022. I hope to get waiver by that time otherwise I would be in serious trouble. Same like you, DoS is not responding to my emails.

    From my research, the final USCIS Waiver granting takes a couple of weeks at least. Also: The self-addressed, stamped enveloped I had sent to the DOS along with my Waiver Application still havent been sent back to me. I was under the impression that they send a copy of the Waiver Favorable recommendation to the applicant when they send it to USCIS. Perhaps this has changed since their email informing me said that they had sent it electronically.

    If anyone gets the I-612 receipt from USCIS, please let us know the timeline of when you receive it compared to the time since the DOS recommendation was sent.

    I haven't reached to that stage in my waiver process yet so can't tell anything ... sorry!

    Could you please clarify if you counted 16 weeks from the day documents were marked as received on DoS website OR from the date they were mailed to St. Louis?

    You earlier mentioned that a cap exempt employer would be sponsoring you H1B. What happened with it? What is your highest educational degree? Area of Study?
