Seems some online updates came today. But any FRs today?
Not even a first update for me as of now. Docs were delivered to St. Louis on Oct. 20. Do you know whose updates came today?

@yoper13this could be a DoS database/ server maintenance thing. I have read about this issue somewhere on this forum. I suggest to take a screenshot including date, time etc. when you see the FR next time (may be tomorrow or sometime in next week).

Hi all,
I applied for advisory opinion for 212(e) waiver on Nov 2, 2020. The US state portal suggest 212(e) finding letter has been sent on Nov 24, 2020. However, I haven't received the letter yet. I have called multiple times, no one picks up the phone. I have emailed at the given address- no response. Does anyone know how long does it takes to receive the letter once sent. Can I reapply for the advisory opinion?
Thank you,
Assume that you were subject to home-residency requirement (HRR), and apply for the waiver instead of reapplying for the advisory opinion. I think reapplying would waste time. If they find you are subject to HRR, they will let you know that, otherwise process your application to issue or not issue FR depending on your situation. Just an opinion, not sure if it's best.

You can find all organizations in U.S. that sponsor J visa here: https://j1visa.state.gov/participants/how-to-apply/sponsor-search/?program=Professor and Research Scholar&state=any. Just choose your program (intern, short-term scholar etc.) and see if the organization you are interested in pops up. Good luck!

Yes, actually my employer applied for me and at the end, the case was approved, but with a consular appointment, which means that I needed to leave the country and get the h1b stamp in order to activate it. The problem now is that in ds-160 I need to check that I have completed/waived the 212 requirement.
Regarding the waiver update in DS-160: Can you file new DS-160 by paying fees one more time?

Hi Everyone, just an update on my application:
DoS updated the portal saying that they received my documents on January 18, 2022 (which they actually received in September 2021). The portal doesn't show the receipt of the No Objection letter yet. Hopefully, they will update it soon.
Thanks for posting your update, @palvi07. It is such a relief to see that things are moving. Based on your timeline, it looks like that DoS would take at least 17-18 weeks for the first record/update to show up on their portal.
@etcoflife @WGLKID @español1974 @Fictions @erdpin.. hold tight, we would be there soon.
PS: as said earlier, the update was on Tuesday. So most likely DoS is updating their portal once a week, most likely no later than Tuesday of a week.

No update for me as well. I'm in the 13th week since MO was cashed.

You're right! I just checked what my lawyer said, and it's "You will receive the DOS Recommendation and then the I-797 (indicating I-612 receipt and approval) from USCIS."
So my process is done! I got both I-797C and I-797 on the same day. 797C was issued 4 days before 797.
Could you please post your complete timeline? Was it NOS-based application?

For anyone wondering at what stage of waiver can they apply for H1B: My visa advisor (cap-exempt research position) told me she needs I-612 approval notice. Then my DS2019 was about to expire, and she applied for H1B using a screenshot showing DoS FR! My best hope was an RFE for the approval notice. H1B was approved in 8 days, no RFE!
After months of waiver pending, this was the best thing that could happen!
Thanks. I am planning of asking my visa advisor to do the same (if I get FR, and on time)..

Expect a FR batch tomorrow morning or after 2AM est
Really? How do you know that? Received any note from WRD or is it because of the end of the week? As per my research on this forum, DoS update most cases on Tuesday morning (EST) of the week.

No any update.
11/05/2022 DS-3035
11/09/2022 NOS EMBASSY SENT TO DOS
11/10/2022 SENT DOCUMENTS SAINT LOUIS
11/15/2022 PAYMENT CHECK DOS
What date is your DS-2019 going to expire?
-
I think DoS issues recommendation immediately before end date of the DS-2019. It takes longer if you have enough time in your DS-2019. What do you guys think?

No any update

Thanks for sharing. I don't know if you can contact a congressman from outside of US, but giving a try is not a bad idea.

Hi, how did you locate the local congressional office contact? And, are you expecting the sponsor views step as well?

@mitronThanks. It's very clear and detailed. My check was cashed on Oct. 22, 2021. Embassy sent NOS on Oct. 29, 2021. It has been more than 10 weeks now but no record on the website of DoS. I am so worried. My DS-2019 is going to expire on April 30, 2022. I hope to get waiver by that time otherwise I would be in serious trouble. Same like you, DoS is not responding to my emails.

Just an update. I had asked the Embassy to resend the NOS to the DOS and they did so and in about 10 days, the DOS gave a favorable recommendation. But I dont know if the resending had anything to do with it since the day I got it was literally hte last day before their own FAQ-guided timeline of 16 weeks was up. I had emailed them multiple times about an update and they only did so when the 16 weeks was up. The Embassy also made a mistake on the letter due to a typo in the address. But the Barcode and Name, DOB etc at least were correct. Anyway, still waiting for the next steps from USCIS.
From my research, the final USCIS Waiver granting takes a couple of weeks at least. Also: The self-addressed, stamped enveloped I had sent to the DOS along with my Waiver Application still havent been sent back to me. I was under the impression that they send a copy of the Waiver Favorable recommendation to the applicant when they send it to USCIS. Perhaps this has changed since their email informing me said that they had sent it electronically.
If anyone gets the I-612 receipt from USCIS, please let us know the timeline of when you receive it compared to the time since the DOS recommendation was sent.I haven't reached to that stage in my waiver process yet so can't tell anything ... sorry!
Could you please clarify if you counted 16 weeks from the day documents were marked as received on DoS website OR from the date they were mailed to St. Louis?

Congrats to everyone. I got my J1 waiver from USCIS a week ago. I will like to stay in the US but I was unable to get an H1B sponsor. Does anyone mind sharing what their next steps are? I was thinking school. Thanks Everyone.
You earlier mentioned that a cap exempt employer would be sponsoring you H1B. What happened with it? What is your highest educational degree? Area of Study?

As per my understanding you can not fax them unless they ask you to do so. The person/office handling your case would contact and share the fax number if he/she want you to fax something.
