  1. Thanks for this. I've been contacting different companies and reading through a few websites. They seem to point to getting the SSN as a kind of loophole? So getting the insurance never became an issue down the road (public charge, relying on gov't assistance or whatever they call it now)? Healthcare.gov does state that the following statuses qualify: Applicants for any of these statuses qualify to use the Marketplace: -Adjustment to LPR Status https://www.healthcare.gov/immigrants/immigration-status/ They require the following documentation to prove status. But it's not clear combination of documents they are looking for. For example, any visitor will have an I-94 but that doesn't qualify you for insurance. https://www.healthcare.gov/immigrants/documentation/ Adjustment to LPR status sounds exactly like AOS. I'll have to call healthcare.gov again. Every agent I talk to says something different. So far, all the healthcare.gov insurance brokers say my fiance would NOT qualify for insurance, but maybe they are not used to dealing with immigrants?

  3. Hi, according to USCIS, Nebraska SC is processing K1 applications in 4.5 months!!! So the approvals you see are probably from that office. Can't they transfer applications to Nebraska since CA is taking 3 times as long??

  10. Hehe you make me sound cheap and callous lol All the policies I could find for people with pending AOS are travelers insurance that don't cover stuff like pregnancies.
  11. Thanks! Will do. I'm self employed so I'm on the healthcare.gov Obamacare. I think you have to be GC holder. Need to double check that.
  12. Hey thanks for chiming in from Memphis! I want the shortest AOS possible because fiance would not have health insurance until she gets her GC. No insurance = no pregnancy. But I know what you mean. Need to consider other factors before moving. Memphis is awesome.

Prior to September 2017, such actions were at risk of being classified as fraud only if they occurred within the first 30 days of entry. I can see where they need to have the number of days as cutoff. If someone comes to America and gets married at the airport chapel in Vegas (having made the reservation a week before travel), then I think you can presume they had intent to marry. Like I said, it sounds iffy.
  14. As the lawyer explained it, 90 days is treated as de facto fraud. USCIS automatically treats it as if you entered with intent to marry. Beyond 90 days is not considered fraud automatically, but you do overstay your visa. The cutoff used to be 60 days.

  16. Absolutely agree with this. I had an immigration lawyer tell me to bring my fiance to the US (having already filed a I-129f months ago), wait until day 91, get married and apply with I-130 and adjust status as spouse. Anyone heard of this NOT being immigration fraud? Sounds a bit iffy, but could be a valid loophole?
  17. Right, but spouse is faster than parent or nephew, which are also family. But family is the closest wide spectrum category. Might be worth moving if Memphis is twice as fast as ALbany...
  18. There's no category for spouse of USC under I-485. Only family based. For Albany, it's 23.5 months. Memphis is 13 months.
  19. There is a large variance in I-485 family visa processing times based on which field office is doing the work. For a spouse married to an American citizen, does it make sense to move to a city with faster processing time? Does it really make a difference for a spouse? I've talked to lawyers who say if you are applying for a spouse, it will be fast in any field office. https://egov.uscis.gov/processing-times/
