    i prefer to use the most updated address possible to avoid mailing issue. 

     

    Thank you for your fast response! Sorry for not being clear in the original post. We have not sent the package yet because we just wanted to make sure changing the address wouldn't cause any issues.

    We will send it out once we move into the new address on the 23rd. Thanks again ☺️

  2. Hi there! 

     

    My husband arrived in the US on July 2, 2023 with his K-1 visa. We married on September 6, 2023. We were approved for an apartment just recently and our move in date is in 3 days (September 23).

     

    We have finally finished preparing our AOS packet including my husband's I-485 form, I-864 form, I-765 form, & I-131 form + supporting documents today. To avoid having to mail in a change of address form to USCIS after we move into our new apartment in just a few days, we wanted to see if changing all the form sections asking for our "Current Address" to our new apartment address would be acceptable or would that just cause further confusion? Each cover letter of the packet also lists our new address in the letterhead as well.

     

    We don't want to cause any issues and just thought we'd see what the best option would be. We could also attach our lease with both of our names and move in date to the packet as well if this would help USCIS understand our situation.

    I'm In the same boat, about to hit two months and NVC is telling me in emails they still don't have my case and will check with USCIS.

    Okay, didn’t know if it was just the way I worded things but yeah, I’m in the same boat. I’ve tried contacting USCIS and NVC and they just keep saying the same thing. The NVC said they’ll try to locate our petition but I doubt we’ll hear anything regarding that matter.. it’s already been a few weeks since. USCIS is now telling us to wait 90 days for our petition to be mailed to the NVC before we contact them again. It’s all very nerveracking.

  4. My fiancé and I recieved our NOA2 on 2/22. We still have not received any notification from the NVC that our petition has been recieved and we have not yet recieved our case number. We have submitted a few inquiries to the NVC to check for an update and we received the same message each time, informing us know that it can take up to 6 weeks to receive a petition. On the NVC website, it's listed that they are now processing cases that were received on 4/14. We are worried because it has been more than 2 months from our approval date. We also know that our petition will expire after a certain amount of time which is another factor we are worried about. Is anyone experiencing the same delays?

    The RFE you posted requires 2 things:

     

    1. Answers to the questionnaire regarding your criminal record.  You need to fill out the sections they pointed out.

     

    2. Intent to Marry:  A signed letter from each of you that you intend to marry each other within 90 days of your fiance arriving on the K1 visa.

     

    Any other affidavits/letters will be useless.

    We did provide letters of intent to marry with the original petition that was sent in but they need further proof that we have an actual intent to marry.

    Nope, we both signed each of our statements and mentioned marrying in the 90 days upon approval. I thought it was odd too.

    It may simplify things if your fiance just types his father's letter in English and have his father sign it.  That would avoid the issue of having to get something translated.  It would be as if the father wrote the letter in English and signed it.  

    It’s okay for my fiancé to be the one to write the letter even though his father is the one signing it? 

  7. My fiancé is from South Korea and we are working on submitting additional evidence for the RFE we received. His dad hand wrote a letter supporting our relationship to submit to USCIS along with a few other documents. My fiancé speaks Korean, of course, but he does know a good amount of English. I know that whenever we submit a document in a foreign language, this document has to be translated. Is it okay if my fiancé translates my father in law’s letter and we submit that translated document along with the photocopy of the hand written letter? 
     

    I read somewhere that whoever translates any document in a foreign language has to certify the translation is complete and accurate. How would he certify this? Does he just have to submit another document stating that the translated document is complete and accurate? Is he even allowed to be the one to translate the letter or does this have to be translated by a professional?

  8. My fiancé and I received our RFE reasoning in the mail today. I attached the RFE to this post. My fiancé and I submitted letters of intent to marry but we didn’t provide enough proof of our intent. In the examples provided, they said we can submit proof of subsequent meetings and ongoing communications. I am currently in South Korea with him and have met his dad. I will be meeting his sister too. Does this mean we can submit pictures/text messages of our current trip to support our proof of relationship? I thought USCIS only wanted proof of relationship within the 2 years of filing the petition. 

     

    1. Can we submit photos of our current trip together in South Korea? (Pictures with the beneficiary’s dad, pictures with his sister, and of our trip in general together)

     

    2. He proposed to me in Colorado back in February 2022. We have pictures of our engagement right after he proposed (pictures of us together holding up my engagement ring). Would this be good evidence to submit? 
     

    Any opinions would be greatly appreciated! We want to make sure to submit the correct evidence so we can avoid any further issues/delays with our petition. Thank you!

    Ohh so I have to wait until after I receive my NOA2 to update any information? I guess I'll just have to hope and pray I don't get an RFE for the original error I made. Thanks for your help!

  10. Hello.

     

    I submitted my i129F petition back in October for the K1 visa and I just realized that I made a mistake while filling out the information about my fiancé's parents.

    I filled out all of my fiancé's dad's information, but his mother passed away a few years ago, so I didn't include her name or birthday. I just filled out, "deceased."

     

    Should I be expecting an RFE because of this mistake?

    I have a great card here in Korea that gives me up to a 40% discount on Avis or Hertz rentals.

    In Massachusetts you simply need to add him to your insurance policy as a household member. As long he is listed he is covered. Question is will the insurance company honor his international licence. if not a rental may be the way to go..... 

    Thank you for your advice! I will call the insurance company today to verify. I didn't even think about a rental car but if all else fails, that might be the way to go.

    Thank you so much for your advice! I will be calling the insurance company today and if all doesn't work out, we will look into renting a car.

  15. Hello everyone. I have a question regarding temporary car insurance. My fiancé will be visiting me in a few months, for about 2 months, while waiting to receive our NOA2 for our K1 Visa.

     

    He has an international driver’s license. I apologize if this is a ridiculous question but does anyone know if temporary car insurance is such a thing? I work full time and he wants to be able to drive back and forth to the gym while I’m working. I was going to give him my car once our petition is hopefully approved and he gets settled down here. Is there any way he can purchase temporary car insurance for the few months he’s living here for my car? The car is currently in my name and I use it as well.

     

    Again, I apologize if this question is ridiculous. I’ve never heard of it myself but he has been curious about it.

  16. My boyfriend is from South Korea and he came to the US in September of this year for a little more than a month total. He traveled to LA for about two weeks and then flew down to Florida and stayed with me for 3 weeks. When he arrived in LA, he was asked if he was visiting anyone. He was worried they’d send him back home so he told the officer no and they let him in. When I talked to him about it later, he tried to justify it by saying he meant he wasn’t visiting anyone in LA specifically, which was true. We already applied for the K1 visa in October of this year and are awaiting our NOA2.

    He’s planning on coming back next month and he wants to stay with me for 2 months. We’re worried he’ll be stopped again and asked about his previous visit. He wasn’t honest with them and we don’t want our visa case to be affected. I know he can provide proof that he’s traveling back home by providing his return ticket back to Korea. He’s unemployed and lives with his dad. I’m not sure what other evidence he could provide to prove he has ties back in his home country. Has anyone experienced ever experienced something similar before?

     

    1.       What are some pieces of evidence he could provide to prove he has ties back home?

     

    2.       If asked his intentions on visiting the US, should he be honest about our pending K1 visa? I told him that he shouldn’t lie but he also shouldn’t give them more info than they’re asking for. We want to avoid any issues with the immigration officers.

     

    3.       If our petition is approved and he’s asked about this situation at the interview, he should just explain it all?

    Not sure where your lawyer got that information from; the embassy website states nothing about a phone interview.

    Regarding the petitioner attending the interview, some countries allow it, some countries require it but majority don't.

     

    In any case, when the petition is approved and a case number assigned, you'll receive the specific instructions on what's next.

     

     

    Thank you for your response! And yes, we initially sent pictures of us together, conversations between family members and I regarding our relationship, Disney ticket receipts, gifts and letters we've sent back and forth over the past few years, etc. along with the I-129F form. I was just wondering if we could provide more evidence, hoping we will be approved, because we will be meeting again within the next few months.

    We're thinking of setting up a detailed and organized binder consisting of our wedding plans, of our engagement, and pictures of our families meeting. But we don't want to overdue it because I know the officers don't have the time to look through a bunch of paperwork.
