I apologize we got the alert that they are sending us an RFE, is there a way to check online exactly what they are looking for?

You can’t do that. I was desperately hoping there would be a way to see it online. Even tried calling USCIS, apparently they will only send it after two weeks via e-mail if you don’t end up getting physical copy 😒

You have to wait for the physical mail. Most people get it in 4 days once the website updates.

Should be something small! Good luck!

hi, thank you for sharing. y, too many rfes, i asked so i can be prepared.

just a few Qs if you don’t mind… did you both sign the same letter or different letters… first and second time?
how did the beneficiary sign if in different country, did you submit copy?
thank you and wish you get your approval very soon.

First time, we wrote separately. Signed electronically though. Forgot to state “90 states”

Second time, did the same thing but did wet signature (printed and signed). I’m the beneficiary. I scanned and sent.

I think like somebody else they are looking for explicitly written 90 days on the paper and signed. Then again, it depends on the CO.

I've been lurking for a year, and this makes me super nervous. We thought we dotted our Is and crossed our Ts. 3 weeks before we sent our documents/app, I had her signed the letter of intent before I came back home. It wasn't until I was back in the states I discovered there was a typo. It was a standard letter, and we said we'd get married within 90 days under k1. But I'm dreading an RFE over that mishap.

I've traveled consistently, every 4 months or so to see my fiancé. So since last April, its been 3 trips thus far, and I'm heading back next month. Every trip since last April, we've gone ahead an signed a new letter. We're anxious to find out if that affected us.

Relax! It totally depends on the CO looking at your case. Somebody I know personally never included 90 days and got approved without any RFE
So there are chances you might too!

Worst case, if you get RFE, At least you’ll see some movement. Honestly I thought my case was stuck in a black hole. I was glad to see some movement.

Its also weird how inconsistent it is. Someone in the March group did their letter of intent, stating in 90 days, but they got an RFE because they did both the petitioners letter of intent and beneficiaries on the same page. Like having both signatures at the bottom

Apparently its supposed to be separate

but I was approved with them together. ive also heard of RFE's due to scanned signatures but my friend did hers scanned with no issue.

I guess it’s depends on the case officer who is looking at your case. We got unlucky.

The first time, we did digital signature. Maybe because of that? I think wet signature is always better.

It’s also frustrating how one needs to wait for the physical mail for 3-4 days to actually find out what was missing. 😕

hi, you could submit inquiry if the system will let you, but since it’s only been a few days, i would wait.

can you share with us what documents were asked in your rfe?
    thanks

So, it was about intent to marry within 90 days.

We still aren’t sure why that was asked because we wrote a detailed letter on how we met and how we will get married along with boarding pass, pictures. My guess is we didn’t explicitly state “90 days” but I thought it was self implied. Turns out it’s not.
So, this time, we wrote a letter again and sent along with pictures and financial support documents.

It’s strange how a lot of people are getting RFE for various reasons.

I got the request for initial evidence. And I did respond for it. Anyone here has experiences that how many days USCIS work on my case again?

    thank you ❤️

Same here. We sent the documents asked for a few days back. Haven’t heard anything from them so far.
I also wanted to know if I can submit an enquiry when my NOA1 date passes in the website or wait for 60 days since date of response of RFE
    Thanks in Advance!

    What You Can Do
Please see the "Online Services" below to check the status of your case in the near future. We apologize for the delay.

We hope this information is helpful to you.
Has anyone received a response like this before? ~ I just want to know if it is a generic response.

I received the same response for my first inquiry. I’ve seen this a number of times for other people as well.

Only the petitioner, their attorney, or someone from congress can contact USICS about the case. Because they changed the processing times on the website you won't be able to submit another inquiry, but you can have your fiance call USCIS to ask them questions. They may not be able to give much information, but unfortunately it will have to be the petitioner.

    Thanks!

Looks like I wasted an enquiry. Now we have to wait for two months to our date. Sigh. 😐

Hello my NOA1 is on April 24, 2020.

The processing time for California service center is June 10, 2020.

I submitted an outside normal processing time inquiry last week.

    They sent me this email:

    "

The status of this service request is:

On 01/23/2021, you or your representative contacted USCIS concerning your I129F to notify us that you believe your case is outside of our normal processing time. Below is a summary of what we found and how the issue has been or may be resolved.

Our records do not indicate that you are authorized for access to information related to this case.

Title 8 Code of Federal Regulations 103.2(a)(3) and the Privacy Act of 1974 prohibit release of information to persons other than the petitioner, applicant or legal representative identified on Form G-28.

    What You Can Do

Please contact the petitioner or attorney of record for information regarding the  petition.

    "

Does anyone received this kind of reply? And what did you do if you have received it?

    Thanks

Hi! what did you do for this? My NOA1 was on April 5th, 2021. Filed an inquiry, got a similar response.

    I'm wondering what to do.

With a job offer, definitely, you can expedite.

For the driver's license you'd need to look into it as it differs from state to state.

And take this waiting time looking for programs, requirements, gathering your academic documents -originals and translations if needed- and working on your CV and the essays that are required for graduate applications.

Thank you so much. You give me hope.

I see that you’re currently processing AOS. I also see that there is no NOA2 in AOS, I guess getting biometric is the big milestone. How’s that done? Do you schedule one on your own or do they do it?

Just curious about this as I hear they only process EAD after biometrics is done. So even if I try to expedite it’s useless. Please do let me know if you know how to expedite.

When you move to the US get your SSN as soon as you arrive and go to the DMV to get your driver's license/ID. That will be proof of your residence while you wait for the GC and it might be helpful when you apply for scholarships that in some universities are just for residents -plus it will make your life easier-

Is it possible to get license with K1 visa

Also, is it possible to expedite EAD with job offer/university TA offer?

  12. 6 hours ago, Coco8 said:

You don't need EAD to study. You can enroll when you move there with the K1, marry, and submit the AOS paperwork.

I don't see how F1 would make your timeline faster because you want to start studying Fall 2022 or Spring 2023.

That's in addition to the problems of having the K1 already. They are going to realize that you withdrew because you are applying for an F1, your F1 will be denied, and you'll have an uphill long battle getting a spousal visa, which takes 2 years.

You haven't even applied to graduate programs which is time consuming and competitive. Many have already closed applications for Fall 2022.

    Hi! Thanks for responding!

I agree to whatever you’ve said except this one. You can study with K1 visa but you cannot take up any kind of work that will make you earn. So with that being the case, I cannot work until I get EAD. So I was a little skeptical about getting it on time.

But ya’all are right, it’s too late to do it now. I’ll just stick to K1 and hope for the best.

  13. Well, I thought both of them were Non Immigrant visas, I could establish dual intents. But it makes sense, I’ll just wait patiently. Don’t want to take a chance now.

    Thanks guys!

    F1 is nonimmigrant visa

    and a long process

applying to the university that is approved by US customs and Enforcement

showing you have sufficient financial support to complete the studies

    getting accepted

getting the 1 20 from university

U must prove u have no intention to abandon your home country residency

the I 94 when a student enters the US is marked D/S for "duration of status"

the requirement for a student visa is to depart the US 60 days from  the completion of the studies

coming with intent to marry and stay is fraud

  14. Quick Introduction - I’ve applied for a K1 visa (NOA1 on 5th April 2021) No signs of NOA2 so far. Tried submitting two inquiries, all generic responses.

So, my plan is to do a masters there by next year spring/fall (considering I get K1 visa by July) I realised I won’t get my EAD until 2023 mid (I’m considering worse case scenario) and I cannot apply for any kind of college jobs which could reduce my tuition fees.

Thinking about all this, we were wondering if we could withdraw K1 visa and apply for a student instead. Is there any consequences to it since I have an intent to immigrate?
    Has anyone done this?
