So I received my RFE. It has to do with the sponsor. I am trying to figure out what they really are asking for. My husband (the sponsor) is SELF EMPLOYED and has filed tax extension for this last tax year so we have submitted evidence of him filing the tax extension. Now, the letter from USCIS says:
The petitioner/sponsor on Form I-864, Affidavit of Support, indicaes they are self-employed. In order to process your application further, submit one of the following
-IRS- issued transcripts of your Federal income tax return for the most recent tax year
OR
-All Federal income tax schedules filed with the IRS
We can not submit the most recent tax return because he hasn't filed that yet (the extension) so we have the second option. What do they mean by "ALL FEDERAL INCOME TAX SCHEDULES" do they mean all since he was 16?????????????????????????????? All is a very laaaaaaaaaaarge number of years we would have to go back to...........
Please advise!

Agree...Patience. RFE's can be nervewracking, especially when you think you've sent everything. In our case, we got an RFE for something that we had already sent. It's crazy I know...but we just sent it again. That's all you can do. If it's for something you forgot, send it. If it's for more proof of this or that, you just do it. I understand the frustration...but really what can you do but comply? At least at this stage you are with your spouse...you're able to wait out the AOS phase together. That's what we kept in mind as we waited...and waited...and waited...Visa journey is the only place for myself to express the frustration...nobody else will truly understand
I mean the only place that I know of!!!! I trust visa journey...I've been here long enough...

Actually, the guidance from USCIS to the CS is that they can continue to use the previous version of the form for all patients that they see prior to August 1, 2008. Previous version of the form, means previous rules, means previous list of vaccination requirements.

Yes but the TB skin test and X ray requirements went into effect May 1st form edition from 04/02/08/. The vaccinations can be waived for pregnant women but the X-ray cannot be waived. And I will nooooooooooooooot get the X-ray no matter what, I'm 6 months pregnant!!!!!!!!!!! They are nuts
Well, I completely agree that in general, "They are nuts!". We were 4 months pregnant when TinTin had her Physical in the Philippines. That said, since I see you are a K1 and therefore had your physical in your home country prior to arriving...AND you are filing for AOS within a year from that physical, the only part of the I-693 that applies to you is the VACCINATION requeirments - not the Xray or TB Skin test or other such parts of a "physical exam". Again, you have already had your physical exam and there is no need to redo that.

I agree... I still don't know what they are requesting from me... but if in the RFE letter they say something suggesting that they have lost my medical from Ireland... then one of the ways of solving the problem is to have the medical redone... That means new TB test requirements, and since I had the BCG vaccine the test would come positive (last time I had it the result was 7mm which is completely normal for BCG vaccinated person) and therefore I would need the X-ray (which they now require even from pregnant women if the test comes out 5mm or more- they specifically say it cannot be waived for pregnant women)- and I refuse to get it no matter what- even if they told me they would deport me.
I am really just trying to be prepared for any kind of RFE this might be... It might be something smaller... I would be screwed if it was about redoing the medical...
I am just speculating, preparing for the worst... I apologize if my approach bothers anyone of you guys! I know I am a freak...but I feel like many of us- IMMIGRANTS become freaks after a while of dealing with the biurocratic USCIS system!!!!!!!!!!!!

Ok. So I got an e-mail saying "request for initial evidence" on Monday. Since then I've been watching the postman, his every step, almost herrassing him...he did'n have any mail for me... and since I am leaving for the whole weekend (starting tomorrow) and will be back home on Tuesday I will not be able to find out what the h... they want from me!!!!!!!!!!!!!!!!!!!!!! ARRRRGHHHHHHHHHH!
I am very anxious to find out, because...I have had this whole AOS documentation rechecked many times before mailing it............

I feel like starting a thread made only for COMPLAINTS! A thread for staying sane while waiting for USCIS to approve our petitions, whatever they are. A thread to help us keep sanity! For expressing frustrations when we get the e-mail saying "We have sent you a REQUEST FOR INITIAL EVIDENCE", and other #######...
I know...nobody said the visa journey is going to be an easy one...
THIS IS FOR PEOPLE THAT FEEL FRUSTRATED, FOR PEOPLE THAT FEEL THE NEED TO COMPLAIN, AND CRY OVER THEIR RFE'S !!!!

I would be happy to be in your shoes. Our package went out first of June as well and we are still waiting for the EAD. Granted our Bio was only on 7/11 but my SO is dying to get a job. The rest of it can take as long as it needs. he just wants to work!
I agree with your SO! I just had the biometrics 7/25 and just got an rfe so it will take even longer............................... I am just sitting and

Uh oh - spaghettios!!!
I need my AP by the last week in August, and would really like my EAD asap.
I called the USCIS hotline to find out what is missing in my application, but they don't keep that level of detail on file. Any ideas on if I can find out what the problem is now, rather than wait for the RFI to arrive? If the AP is on hold, I need to get it processing again as quickly as possible - need to be back in England at the end of August for my father who has a long term illness.
P.S: I also asked the USCIS guy about whether my AP and EAD are on hold, and he tells me no. In addition the USCIS status webpage only tells me the AOS is on hold (the AP and EAD are still pending). Who is correct?!!!

I don't know why the gave you a TB skin test and you're pregnant. My friend just went through this. She was told she didn't not have to do the skin test, because if it comes back postive (which it did) because she also received the useless vaccine BCG she will require a chest x-ray, which they can't do because she's pregnant. She did not received an RFE for a skin test
The thing is... when did she have her medical before or after the TB skin test requirement became effective?

I will noooooooooooot put my baby in risk for anyting in the world.....I just need to know how to respond to an RFE like this...If I refuse to take the X-ray the doc will refuse to sign, and there is no way I can send the I-693 because there will be no CS certification. It seems like they (USCIS) don't have everything figured out and I am getting more and more frustrated with this biurocracy.
Why would they want me to put my baby at risk? Harm a little human being before he's even seen the world??????????????????

Lots of hugs and heartfelt wishes. I don't think anyone can realise how it is to move countries. My own move is imminent and I am anxious . But, back to you.
Your husband doesn't realise what a big leap of faith its been for you to move countries. Keep the communication going....sit him down and have a heartfelt talk. Remember, not only have you moved countries, got married...NOW you are pregnant. That's a lot of change in a short time.
My prayers go with you...no harsh words.

Thank you for replies. But how do I send them something that "they" themselves say cannot be signed by the doctor. How do I send them a medical report not signed by the CS????????
It just makes me maaaaaaaaaaaaaad that they require pregnant women to put the baby in danger! I am not crazy!!!!!!!!!! I would rather never get this stupid green card than put my baby at risk.....................So frustrated.
