  1. I am preparing to file to remove conditions this week. I was just reading instructions for the I 751 form and feel confused... It seems like affidavits from at least 2 people are mandatory??? This is a surprise to me. We just moved from PA to NV and all our friends that knew us in the relationship are in PA. It will be a pain fir them to have to write affidavits and have them notarized... Can I file without these????????????????????????? Has any of you done it?

    I'm a USC and now filing I-485 for my mother who overstayed her tourist visa for 9 years. I-130 was approved. The question is do I need to worry about the waiver? Also, we just got a Notice of Appear regarding the deportation :( . I think it's the beginning of the proceeding. The dates are not set. What effect will it have on her status if she skips the interview (or hearing)? Is it true that the overstay and deportation issues will be forgiven when the beneficiary is the immediate relative of the petitioner :unsure: ?

    I know...waiting is so frustrating... I don't even have my EAD yet, and I have lived here since March... I am soooooooooooo freaggin' frustrated when my husband goes away for 4 days twice a month and I can't even drive to get away from the house. Not mentioning that I don't know anybody.

    she may travel freely domestically w/out advance parole. you need to make sure that you booked the flight in the name matching the identification she is travelling with, my husband has travelled domestically w/ his state issued i.d. no problems. she does not need her passport nor her noa's (i recommend against taking them in case they get lost) since she has a state id it's sufficient.

    I took my NOA's since I didn't have the state ID, just a passport with an expired K-1 visa in it for my ID. I took the backup docs scared of the things I have read on the Internet about TSA stopping and questioning people they had doubts about being here legally. Just to be safe.

  5. My wife wants to book a flight within the U.S. to see family. We have already completed the biometrics for the AOS. At this point just waiting. Can she travel now? I hoped just taking her Florida ID, marraige cert. and all the Notice of Actions, and of coarse her passport. Can she travel with these documents? thanks

    Yes she can. I would take all these docs. That's what I did traveling Philly to Chicago in the beginning of August. They only wanted to see my passport but I was "insured" with the other docs- in case they asked. Oh and my visa was expired- but we were of course already married (K-1), I understand your worries.

    No, she can´t. She needs an Advance Parole. If she leaves the US she will be denied when she comes back.

    Notice of Action are useless in this case

    We are talking about a DOMESTIC FLIGHT! Yes she can fly within the US with these docs.

    I quess thats a good thing! I am soooo happy, and excited!

  7. Hi, we sent in things the same way not including a 2007 tax transcript as I filed for an extension. We however have not received an RFE yet (fingers crossed!)..

    but I am just curious did you also send in 2 or 3 years of previous transcripts? letter from employer, bank, pay stubs etc...?

    im getting my taxes done right now so just in case i need to send in the 07 transcript i can, but curious if sending extra stuff takes care of this issue? probably every situation is different...

    Yes we did send them everything we had, all the info from 2006 and 2005. And also 4868- extension, but they wanted us to send the 2007 taxes so we actually needed to file them...

    Every situation is different so just hold on there and wait...

    I have received RFE for my husbands 2007 taxes. He's filed an extension back in April. We sent the AOS in June, received RFE July 28th. The USCIS requested 2007 tax transcripts so that meant we needed to file now. We did send them electronically today.

    My question is how long does it take the IRS to process those taxes so we can order the transcripts. I know it takes around 10 days to receive the transcripts, but since we just filed them today do you know how long it will take altogether-having them processed by the IRS?

    Thanks for the heads up...this is soooo frustrating...I'm sure it's nothing serious but It's almost like receiving a death penalty when you see one of those things...as humans we always expect the worse...but my God is greater than any RFE and he'll work whatever it is out...

    It sucks but hey it's all part of the USCIS mission to frustrate us LOL...Just try to stay calm & positive and send them whatever they asked for...If you don't mind me asking what was yours for? I'm still waitin for mine to come in the mail...

    Mine is for my husbands taxes. They are not satisfied with him filing extension this year, so they want him to file his taxes now (even thogh the IRS is giving him time until October) and send them the IRS transcripts for 2007.

    I am feelng low because it will take us around 2 more weeks to get that stuff done.

    I am also affraid I will get an RFE after this one, and it will be for the medical... Who knows... I just stopped counting that it will be a fast one...

  11. OK so I think the best option is to just file the taxes and get this over with. My husband says that the accountant has them ready, but he only needs to give him the expense reports (which I will prepare to make it faster). Hopefully we can do this within the next week. It's not that bad then...whatever we have to do...Jeeeeeeeeeeez I can't wait to have nothing to do with them (USCIS) :clock:

    I understand your frustration. The adjucator that is working on your case is the one that decides all this. It's very unfortunate, i am in same boat kind of. I sent in more than enough evidence for Assets then got an RFE, then resent everything with additional info and now received another RFE (that i have received the actual reason for yet).

    I want to punch something sometimes becuase what they say on the USCIS instructions is completly ignored by the Adjucator.

    I feel for you, and unfortunatly you may have to send them exactly what they ask for in order for the case to be approved.

    All the best and I am right here in the frustated with USCIS line.

    Seriously lets start a club for people frustrated with the government! I feel for you too...

  12. You are getting very good advice here from Urge To Race and likes2ride. I entirely concur with their advice that your husband file those 2007 taxes asap and send a copy in response to the RFE. As long as no material changes happen, he can always amend his tax return at a later stage.

    He has three (3) years to amend the tax return and if he owes $$$, he can set-up a payment plan. At least the return is filed and it can be submitted as the Govt has requested. The only negative effect this may have is if there is a BIG problem with income and tax liability, but that, again, is something your husband has to deal with.

    Wow. This is starting to really become a big issue. Thought it would be simple, now I don't know. He owes money for sure, I don't know how much exactly. This was the toughest year because he just became partner and his tax rate is a lot higher than the previous years, I think that't the reason he couldn't file in April, his accountant is a pain in the a.. too... Wow...

  13. So U are telling me they are going to make him file taxes even though the extension is a legal way of putting it off... That doesn't make sense-like a lot of other things by the lovely uscis. :angry: ?????????????????????????????????

    You can "put-off" paying your taxes, but it is doubtful that you can put-off satisfying the USCIS requirements without more grief. Without getting too personal, the Govt wants to know if this guy has the means to support you. Did he submit the previous two (2) years returns? What did they look like? Were there extensions and did he owe big $$$? That is the stuff they look for. Redflags. We are headed toward Sept. Tax returns are due on April 15. In a few months, he will have to gather info for 2008 taxes. What will they look like?

    I am not trying to be harsh - just realistic. If he has tax and $$$ problems, you two need to start thinking about Plan B to get the Affidavit of Support approved. Evidently he filed the Affidavit for the K-1 and it went through. Were there problems and, if so, how did you handle those?

    Get some rest and start fresh in the morning. Believe me, I know this ####### can weigh heavily on a person.

    There were no problems at all when filing for K-1. He proved income waaaaaay above their requirements... With the AOS he submitted the 2 previous tax returns and the proof for filing extension. This stuff is giving me a headache...since I have never had to file any US taxes and have very little understanding of what those forms look like I don't know how to help myself right now... I am also not sure if I can trust him in reading the instructions properly since he never has time for anything... It's just something that he was born with...I love him very much but don't trust that he will do this correctly without my help... Just happen to know him this way...

  14. OK. So on their website here: http://www.uscis.gov/propub/ProPubVAP.jsp?...f85680eca9562d3 they say this about tax extension:

    The sponsor must submit with the Form I-864 the sponsor’s U.S. Federal income tax return for the most recent tax year (that is, the completed tax year immediately preceding the date the sponsor signs the Form I-864). USCIS may generally expect a sponsor, after April 15 of any given year (or April 16 or 17, in a year in which April 15 is on a Saturday or Sunday), to have completed his or her tax return for the previous year. If the sponsor requested an extension, the sponsor should provide proof of filing fo r the extension. If the sponsor did not file a tax return, the sponsor must prove that he or she was not required to file. If a sponsor should have filed, the sponsor must file retroactively and provide proof of filing. Note that U.S. citizens generally have an obligation to file a tax return on non-U.S. earnings even if there was no tax liability.

    We have proof of his extension (sent it already, but may resend) Anybody????????
