    Was visiting my BF for the 2nd time in USA when something happened and made us change our plan to do K1 and instead we will go for AOS from B2 visa

  1. why pay extra money for extension if you are planning for AOS? just get married, and sent your AOS concurrently before your I94 expired, therefore you won't be out of status (if this is what you fear of). I also doing my AOS from B2 visa since last October 2021. I was just planning to stay for 3 months visiting my bf when my country close it border due to delta got very bad last year. So we decided to get married not even know about the 90 days things (it's just something people said that USCIS will consider its a visa fraud if its too soon from entry?) we got married 14 weeks after i arrived and 2 months after marriage i sent my AOS. I will do my interview next week. I did everything myself without lawyer help. If your marriage is genuine, if you didn't plan to do visa fraud it's all just change during your visit, i think its fine to do adjustment of status, and you don't need to worry about it.
  2. We initially want to do the K1 this year. But last year during my visit with b2 visa, due to situation with covid in my country was bad we decided to do AOS and i stayed in USA during the process. We got married and submit the AOS before my i-94 expired. Did it without lawyer. Honestly the process these days quite faster (2022 submission) even compare to mine that submitted last October 2021. Even for me i would say its fairly smooth process. These days people get their EAD & AP few days after bio or even right after bio. My PD is Oct 2021 Bio Dec 2021 RFE I-864 (some mistake on filling form on household number) I expedite my EAD on Dec 3 days after my Bio EAD approved Feb 2022 i got a combo card April Interview is scheduled In few days ahead we will have our interview in Dallas (that well known with long processing at least 9 month, but i did it faster 7 months). As long as your marriage is legit, and basically you can gave prove that its just unplanned (i submit my return flight ticket and travel insurance that state length of stay), i think it will be fine. It will be a problem if you intend to stay since before you even enter the country with tourist visa.
  3. just go to the congressman webpage they have that section where you can request their helps with many different federal institution. Just choose immigration. They will request for details on case numbers etc. I just gave them the evidence as well. Good thing then they forwarded it to USCIS. They really do help me massively.
  4. So, after multiple times back and forth follow up as they told me to (7 days, 14 days, 30 days) but they never even contact me back, never asked me to upload any evidence on the 38th day my expedite request was denied. But, thankfully i did backup plan by also submitting expedite request help from my congressman that really help me out. In january a month after i request, few days after i received the email that they denied my expedite i was about to request expedite again through EMMA when the congressman office called me back and said that my EAD is approved and told me to wait until a week if theres no change in my case to call them back. Indeed the status changed to Card being produced at 14th of February. I got the EAD combo card 5 days after. So highly recommended to have backup plan to also request help from your congressman.
