  1. I was wondering if there really is a need for me to go thru Visa Agent ($600+) or a lawyer ($1500+) to actually file paper work for K1. Can I do this my self ? Suggestions/Experiences...

    We used a lawyer in Las Vegas and it only cost 1000.00 US dollars. But I did do research before. I found a lawyer that is talked about and one of the best in Las Vegas for immigration. His office is actually in the imigration building so he knows alot of the people there. My point is make sure to talk to people in your area and get facts before. I used this lawyer because of his status in the area and know he will make big things happen if needed.

    Our package was delivered to uscis on 26th november and still the cheque has not been encashed.

    I am worried that noa1 will be delayed...Does the cheque gets encashed very late.

    As per VJ,the timeline for noa1 is 10-11 days.

    Sometime it can take 2 weeks for the check to clear. I wouldnt worry until then.

    I'm sorry about this little rant....

    As you can see by my sig, we just got our NOA2 approval. We've been apart for 5 months already during this stretch, and before that, we were lucky to see each other 2 weeks out of the year for the last 3 years. It is very hard, as many of you know. What is even harder is that this time, we have an infant. We made the agonizing decision, once we found out I was pregnant, to wait till he was born to file the I129f, because we didnt want to take the chance that things would get tied up to the point where it might have been difficult for him to re-enter the US for the birth while our case was pending. So, he's been away from his little baby for the last 5 months.

    I know many of you can relate to the pain of simply being away from your sweetie for months and months on end, and I know many of you can also relate to having children separated from one parent for months and months on end.

    So, here comes my rant....

    After all of this, with friends and family knowing darned well how long we're always separated for, when we finally get some good news (the NOA2 being approved), we barely get any kind of response. A gentle "hey, grats" is about the extent, and some people could not even muster that much!

    I agree with Adam. I ws also married before and my Filipina Fiancee is amazing. The feelings I have for my Filipina Fiancee are so much more then my ex wife. It an amazing feeling when you really find true love. We all have such a long wait but when the time comes and my Fiancee gets to the US the long wait will be worth it.

    How can these people claim to care so much about me/us, and see me/us suffer for so long, and not seem to care that this waiting is getting closer to being over?

    If people have not been thru this, they simply cannot fathom how painful it is to be separated from the one we love. What's funny is, these same people miss their SO when they go away for a weekend or a week, or they commplain when their SO works too many hours in one week...and I want to say "At least you can see your SO at some point during the week! I've been apart from my SO for 5 months, and last year we were separated for nearly the entire year!". They just cannot fathom it, or do not attempt to think about it I guess?

    Anyone else get frustrated at stuff like this? :ranting:

    They will never understand it.

    They will also never have the amazing bond with their SO that we will.

    I was married once before for almost 8 years... and I can say that the most intimate of moments I had with my local ex-wife do not even come CLOSE to comparing to even the casual moments I have had with my filipina fiancee.

    It's a completely different world to experience the "true love" sensations that people like ourselves have found.

    My advice is not to worry about what others think. Focus on yourself and your SO and worry only about what you think.

    In the minds of others, they think only a few thoughts: "Mail-Order", "Desperate", "Crazy." They use these imaginings to cover up their jealousy--which will be further confirmed when you are finally together WITH your SO and they see your happiness for themselves--then they'll wonder why they can't experience the same love the two of you share... full of trust, fidelity, commitment and appreciation!

    I look forward to spending the next 50+ years with my mahal.

    I have been looking at this forum for a bit now. My fiancee and I are about 75 days deep into waiting for NOA2fr our K1, My question is, I have noticed a few people mentioning writing letters to their senators and congressmen and I just wondered if this helped at all or what the point was? I had thought about it myself even though I wasnt sure if it would make any difference. Good Luck to everyone and I just have to say that it is awsome to have some place filled with people who have been or are going through this same long and ridculious process!!!!!!!!

    At 75 days, no difference. Letters will only will only help you if you get past 6 months of waiting. Current wait times are about 4-5 months.

    I agree, they will only help if its past 6 months.

  5. Gratz to everyone that has been approved this month!!! I have realized that alot of approvals are going on right now at the VSC for July, and I just cannot seem to stay away from USCIS website.

    It's so depressing at times wondering if it will ever happen, I login to check case status, and then I'm almost afraid to look. Then I peek at it and no changes :crying: It's so frustrating right now, and I know we have not even been waiting as long as some of you have. How do you all keep your sanity?

    I know how you feel. I check the BCIS so many times a day and each time I hope there is a change but never even see it touched. It very hard to be apart from someone when you love them and miss them so much. Its been 2 months since I was last in the Philippines to see my beautiful ShaSha and I miss her so much.   6. I brought my first wife over here on a k-1 fiance visa in 1994 and we have reciently got divorced. Im planning to bring another lady over here from the Philippines on what would be my second fiance visa. Is this allowed by USA immigration? Are there any other problems with these circumstances.

    You'll be fine since your last petition was 13 years ago. My husband also brought here his first wife from Thailand through K-1 on 1994. They got married and got divorced after 3 years. When he filed a petition for me last year, we didn't have any problem. I am here now in the USA and already have my Greencard.

    I agree, I brought my ex to the US in 2004 and got divorced in Feb 2007 after she started to gamble to much in las vegas. Anyway I met someone else when I was in Makati to purchase a condo this past March and went back to see her in September. Filed a 129F after I go back so hope its ok for both of us. Spidergirl how long did it take your visa to get approved? My fiancee is from the Makati area so hope we have luck like you and your husband.

    I noticed on several updates that some of you have stated that after the NOA1 was received you show

    a date when your documents were "touched". How do you know this?

    My NOA1 was received on 10/22/07

    I have looked on the USCIS website..all I see is the generic update.

    IS THERE A WAY TO SEE IF MY DOCUMENTS HAVE BEEN "TOUCHED"?

    My 129F was received on 10/23/2007 and I get the same generic update also. I started a online account account the day I received the NOA1 and nothing has every changed for the update status so not sure how this happens

  8. Has anyone gone past the 90 day period without any results ie. no check cashed? I'm on day 71 without a check cashed (I sent recorded and it did arrive at their center).

    What answers did you get?

    The reason i'm concerned is that i spoke with an officer a few weeks ago and he claimed their rules regarding the NOA1 are suspended. They will NOT investigate after 90 days. You are STILL accountable for the application even if they process it 5 months later...ie he told me "dont you dare cancel your check after 90 days because you'll owe the US gov even if they they find it well down the line" ...........and most importantly he told me if the 90 days is up I'm tough out of luck. My only choice is to send another application ie. get back in the December line and risk that they'll cash both checks if they ever find my old application. There is no cut off like there used to be. (ie. wait 4 weeks then wait for a 30day investigation then your safe to reapply)

    Call again. Some those people dont give the correct info. Sometimes you will get a different amswer each time you call. Ask to talk with a immigration officer when you call not just a customer service rep. You can also contact your local Congrees reps office and ask for help. Make sure to tell them what you were told.

    Hope things are going well for everybody here! I am from Hong Kong and am currently on a tourist visa in the US which is good until April 2008 (yeah, I am lucky!). My boyfriend and I are considering tying the knot finally but understood that I would have to go for the K1 visa. My question is:

    Can we file a K1 while I am here on a tourist visa? And I wait until any procedures necessary to be done in HK and go back? We want to minimize our separation time as much as possible!

    Any advice or sharings from anyone who has done the above (whether succeeded or failed) would be greatly appreciated.

    I am not sure being from Hong Kong actually give me an "advantage"... as traditionally/ historically, we are not a big immigrant group to the US...

    No need to go back to HK. Just dont tell them your intent was to marry prior to your arrival in the US. You already in the US so why would you fild a K1 visa in HK when you will have to go back to do it?

    If anyone is up at this time at night would really appreciate an honest answer. I met Salah my fiance in Jan. in May after I arrived, payed for the apartment for a month ( as his job is not providing him enough money to live on) he asked me for 200 euro to pay for a bed with a bunch of guys. As of June I have paid. I understand that work is not good for him, and have asked him on occasion to go back to Morroco where he could live for free. He said he would go if I went with him. He does not care he says about the visa.. and on to go further would rather live in Italy than the U.S. I am the one who thinks he should live here, as my buisness and I think life here is better. Anyway in a nutshell, yesterday, he called me to tell me that the Italian police had confiscated his posters. ( he sells these on the street) I lost it. I told him to move back to Morroco..went on and on about supporting him with his apartment for six months. Anyway, I don't know what to think. Is the guy using me? In my gut I dont think he is..

    any wisdom would be grea!! And I realize this site is for visas and not for relationship help.

    I agree. you have taken care of him for 6 months already. if you keep doing it he will never try to work. You will find out that in many relationships that are like this the person is using the other for money. Jobs are hard to find in some countries but my soon to be wife is from the Philippines and its very hard to find a job there but she has never asked me for money. I also think it should tell you something when he has already told you he doesnt want to live in the US or wont go back to Morroco where its free. You have to stop and think what are his real reason for this. FYI there is a a Yahoo club or group that talks just about relationship scams. You may want to search for it

  11. Our 129 F was approved Sept 12th. As of Nov 11 NVC has no record of it . They say the only way to proceed now is to resubmit my case thru USCIS.

    This is two times for us. Our CR1 has been lost for 4 months now.

    Anyone else in this situation?

    You need to contact your local congress person for help. They will be able to look into it for you.

  12. I need some good advice here... I met a guy in US , I am from China.. he came to visit me once for 2 weeks in China and we talked via phone and e-mail for many months.. he filed a K1 for me and came to my interview at embassy and I got the K1 we left togeahter... I left my job and everything behind tobe with him.. Unfortunatley.. after getting to the US.. I found out he was a alchoholic and drug user.. I do not wish to be with this man.

    I left after 3 weeks.. his home.. and didnt tell him where I went. I feel bad I was so foolish to make a bad choice.. but now I met another wonderful man who also has been looking to meet a nicelady from China. I have been living with him almost for 2 months now.. we get along wonderfully and I want to continue to be with him.. He even said he would apply for me another K1..

    But Im worried to go back .. my 90 days is running out soon.. If I stay I have researched there is no way to adjust my status .. is there a way??

    I am afraid if I go back, and try to get another K1 , I will get denied .... has anyone ever been in this situation where they have changed theri mind and wanted to come back.. and actually got another K1.. what are my odds to get another..

    I see if I stay and overstay my visa and we get married and I go back and try to do consular processing.. it is a 50/50 chance I can come back..

    need some good advice.. is it possible to get a 2nd K1 so soon after coming back to China.. what are my odds..

    Also will my being with 2nd guy living togeather for 2 months be enough proof of evidance for relationship to the embassy in China.. what will they think of me asking for a 2nd K1.. will he need to come to China for a visit or is 2 months with each other enough.. he has handicapped child and will be hard to leave... do we have enough proof togeather.. Any help appreciated

    I agree get a immigration lawyer ASAP. But do not over stay your 90 days it wont look good if you have to apply again. A lawyer will cost money but thats what you need at this point.

    Personal opinions welcomed here ...

    There's 15 years between me and my fiance, which to us isn't an issue, but to an immigration official it might be a biggie that raises whatever flags these things raise.

    Do you guys think this will be an issue to get our NOA2 and if and when we get through that, should we attend the interview in London together so they can see us as a couple?

    I think that they aren't there to judge a couple's precieved suitability rather just that relationship is stable, on-going and, above all, genuine. In which case, we have no problems at all - we have been living together for 2+ years after all.

    Let me know what you guys think!!!

    Its not a problem just make sure she keeps telling them she loves you very much. When my wife had her interview they kept asking her questions to make sure we loved each other. Bottom line age doesnt matter if you love each other thats all they want to see

  14. Just a non-serious question for everyone. How often do you see or visit your fiance overseas?

    For me I met my fiance end of Nov of 2006. Filed for the K-1 on Aug 22nd.

    I will be going Manila this middle of November. Its already my 4th trip since I met her. (trying to see her and spend as much time with her)

    We met when I was in Manila in March and I went back in October for 3 weeks. I plan on going back in March 2008 and every 6 month until she gets to the US. I filed the papers 2 weeks ago so I might just wait for her interview then go back for a few weeks then fly back with her. Makati is a great area I purchased a condo there the last time. Great deals there with interest free.

  15. mailed my I 130 july 27 to VCS..then I called after 90 days they put a trace on it. I was tyold some one personaly would look for my case...greaaate so gave me a ref num and told me to wait a little more ....so i did two days later i called and a very honest phone person told me that they cant do the search with out then having have had imput my imfo and having had giving me a RECEIPT num.....so any advice please help :help::help:

    I had this happen to me in 2004. I contacted my local Congress office for the area I lived in and someone in her office was able to contact the service center and talk to someone. They found out my paperwork was just siting on someones desk and not taken to my case worker. Try doing the same trust me they will help you because they want your votes. I even got a call on Christmas Eve telling me what they found.
