    My wife's employer which is listed on her W2 was some sort of holding company or something that neither of us has ever even heard of.   It certainly isn't anything like the name of the business she actually works for and not what she would put down as her employer anywhere it was asked.  I think that is a very normal tax situation and of little concern.

    I couldn’t find a answer for this anywhere so I thought I’ll ask here so it can benefit me and anyone else who will have the same question.

     

    For privacy, I’ll use Facebook as example.

     

    So my employer used to be known as FACEBOOK INC, but since last year they changed their name to META.


    The problem is the W2s still mention them as FACEBOOK but the Proof of Employment letter and Pay Stubs mentions META, the new company name...

     

    When uploading the document to CEAC, I’ve put comments to explain that.


    However in the form I-864, where it asks for my employer name, should I put “FACEBOOK” or “META”, or even “META formerly FACEBOOK” ?

     

    I’m torn here…

    This might be a stupid question, but I had to ask since I want to make things the right way.

    I'm currently filling form DS-260 for my spouse.

    She is from a French speaking country, and over there the capital, Abidjan, has many municipalities such as Abobo, Plateau, Yopougon, etc...

     

    On most adminsitrative documents like Birth Certificate, Marriage Certificate, and even Passport, the municipality is mentioned instead of the city of Abidjan itself.

     

    When the form asks for City of Birth I get confused because I'm not sure if I should put Abidjan, or the municipality where she was born, Abobo.

     

    Thoughts ?

    I did the same thing. Married Sept 03 2016 I file single for one reason. Trying to be honest. My wife never set foot in the USA how could it be fair to accept the tax benefit? Seems like cheating. And married for only 4 months of the tax year.  I think this is something that could be a red flag..... but I am confident with my explanation any red flag will be dropped quickly. Simply explain at the interview and do not stress. This process gives us all enough of that.

    How did the NVC process and interview go ? Was the file single tax a problem ?

    I filed my taxes on 2/7 and a week later the transcript was already there. I submitted that and a letter from the employer and my documents wer DQed. Take into consideration that there’s a size limit when submitting docs To NVC transcrips are smaller in size and have all the information they need. Hope this helps 

    Do you think that I should wait for my spouse ITIN which might come end of March, then amend the 2021 return before I submit the Affidavit of Support and other documents to NVC ?

    Current processing times for NVC is like 19 days after document submissions. I'm thinking I apply now with what I got, then if they dont DQ our case because of the 2021 Single filling, I then amend and resubmit ? 

    I'm thinking of taking a chance and doing that, instead of just wasting a month waiting for my spouse ITIN to be ready...

    You're right, I might have done a mistake while filling the 2021 taxes 😲

    Because I supposed the 2021 taxes were filed sometimes in 2022 right ?

    Whoah, is that going to be an issue ?

    Should I wait for the 2022 Tax Return ?

  8. Hello guys,

     

    Hoping that you're doing well. Can you please help me with some doubts that I have regarding Form I-864 ?

    I am a LPR who entered the country end of December 2019. I have filled and paid taxes for the years 2020, 2021.

    2020 filed single because I was not married.

    2021 filed single because I was not married.

    Got married in July 2021, petitioned for my wife on September 2021

    I-130 approved in Feb 2023, NVC  sent welcome email Feb 2023.

     

    2022 taxes filed married filling jointly by applying for ITIN for my spouse using Form W7.

    And this usually takes longer, usually 7 weeks as per the IRS, that's almost 2 months.

    I filed the 2022 taxes on 31 Jan 2023, so I'm guessing the processing will be done by end of March.

     

    I can currently provide the tax return transcripts for 2020, 2021, and pay stubs and a proof of employment document. 

    My question is, should I wait for this tax return to be process before I submit the AOS ?

     

    Another doubt I have is, I thought tax return transcripts were better than income tax returns, because they encompass everything and with tax return transcripts you don't need to add accompanying W2 or 1099.

     

    But the instruction for Form I-864 says

    A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

     

    That is confusing me, should I submit Tax Return Transcripts or simple Tax Returns ??

    it will ask if you have any current pending petitions, and will link that with the change of address.
     

     

    3. No idea, then.

     

    There's an option to file for Change of Address Online, and when I try it shows my current/newer address as the current one.  Same address I used when filling my I-130 online. 

     

    So I guess the weird part here is why on my receipt notice they put my name as "in care of" my dad's name and his/our old address.

    3 NMN means no middle name. Is that accurate, or do you have a middle name?  

    1 - 2 When I moved I didn’t change my address because at that point I had already received my green card. When filling the I-130 I put my new address + my USCIS online va has my new address. Doesn’t that count ? 
     

    3 - I do have a middle name, weird thing is they put my First name / Family name  / NMN / then my actual middle name.

    I was taking a look at my USCIS online account as well as my Receipt Notice and noticed some weird things that worries me a bit.

    To give some background info. I'm a Permanent Resident who filled I-130 for my foreign citizen wife who resides outside the country.

    I got my Permanent residency after my dad filled a I-130 petition for "Child over 21 years" and I immigrated 3 years ago. 

     

    1) My receipt of Notice list me with my dad name as "c/o", as in It's in the format "My full name" c/o 'My dad's full name. See attached picture Is that normal ?

     

    2) The address listed on my Receipt of Notice, is my old address which happens to be my dad's address, it is different than the address in my USCIS online account, bear in mind that I filed online.

     

    3) Another weird thing is, the letters 'NMN' were added in my name in my online USCIS account. See attached picture

    Like JOHN MNM DOE, which is really weird. 

     

    Any comments or advise will be appreciated.

  12. Just to chime in, the Instructions for Form I-130 file at https://www.uscis.gov/sites/default/files/document/forms/i-130instr.pdf says:

    4. What documents do you need to show that you are a lawful permanent resident? If you are a lawful permanent resident, you must file your petition with a copy of the front and back of your Permanent Resident Card (Form I-551). If you have not yet received your card, submit copies of your passport biographic page and the page showing admission as a lawful permanent resident, or other evidence of permanent resident status issued by USCIS or the former INS.

    Thank you. That brings hope that she can jumpstart her husbands Visa process while waiting for this immigrant packet mess to be resolved.

     

    We've contacted our local CBP deferred inspection facility (JFK Airport), and they allowed us to mail the immigrant packet to their office..

  14. Hi!

     

    Posting regarding my cousin.

    She came to the United States on the 16 December 2021 and still hasn't received her Green Card.

    We found out that it is because the BCP didn't take her immigrant packet at the port of entry. We're working on fixing that.

     

    Meanwhile, to save some time, can she petition I-130 for her husband who is still abroad before receiving her green card in the mail? 

  15. My cousin recently entered the US via JFK airport after her Diversity Visa processing was done.

    She was given her visa and the immigrant packet by the embassy.

     

    She is a French speaker, and was most likely a bit "lost" at the point of entry, she was carrying her immigrant packed as we instructed her, but it seems like the agent did not ask for it, so she got out of processing with her immigrant packet and still has it with her to this day. She did not open it yet.

     

    So its been 3 months now and she still hasn't received her green card by the mail. 

    Is it because USCIS does not have her immigrant packet ? How can she give it to them now ?

    Any help will be appreciated.
