    Our I-130 was approved in August 2019, but the DS-260 process got bogged down as they kept asking for other information.

    Thank you for posting your letter. I am a US citizen (dual actually) and my wife is Canadian. We've lived in Canada for nearly 20 years. Our sons live in Brooklyn, and were able to add my name to their apartment lease to establish domicile. I also maintain bank accounts etc. in the US. That seems to have been sufficient because my wife was DQ'd Dec. 1, 2020. Waiting patiently (wish). All the best to you in your process!

    I didn't do my research and didn't realize I (the US spouse) needed domicile in the US. So we accidentally were living together in Canada while getting our documents together and when I realized I needed to re-establish, I sent in my US bank account, which I'd been keeping fully active since I left the US. They accepted that and we became DQ'd in Feb '21 - I had high hopes things would improve quicker, so myself and my daughters moved back to California in May, sadly before I knew about the lack of IL's. Now we are back and without a husband/dad in order to have domicile, but I'm regretting it with a heavy heart as it's looking like he won't see an IR until December the way things are going. We are not sure if we should go back and then re establish when he gets an IL or what.

    Thanks! Sorry for the delay but I’m not on here continuously as I was before we got our approval. We used my income, which was minimal but enough and also posted all of our assets but they seem to be only concerned about the income no matter what your assets are. Luckily they didn’t ask for a co sponsor. We finally moved to the US on June 1 and couldn’t be happier! Best of luck to you, it’s stressful but worth the wait!

    Ours is almost identical situation. My husband's interview was last week and when asked for our US address he gave my brother's which is where we have resided for years when we are there visiting. We also uploaded a notarized letter with that information to NVC with all our other documents. I also uploaded whatever proof of my domicile I have, along with a letter on my behalf stating my intent to re-establish domicile in US,  even though I have lived in Canada for many years with my spouse (I am also a Canadian PR). We also have to sell our house here in Canada and are planning on purchasing a house in the US as soon as we can freely drive back and forth but Covid has put a damper on that at the moment. The CO understood all of that when my husband told him all of that and all was good. His interview only took an hour!
