  1. While entered to the US using VWP:

    You can stay in the United States for 90 days. You cannot extend your status (stay longer than 90 days). You can not change to another visa status.

    You cannot study or work on the VWP. You can get married to an American citizen, but you can not adjust status to permanent resident (get a green card) after your marriage.

    I think, in this case better if you hire a lawyer.

  2. I think the purpose of the upper, smaller barcode is to be able to scan the document while it is in a window envelope. NVC can quickly identify or track a package without typing in the name or opening the envelope. Consequently it seems to have a purpose only before it is mailed to you.

    But do not leave it unchanged to make sure they do not scan the small barcode by accident instead of the large one. If you cannot manage to create and place the small barcode I think it is better to have no smaller barcode on the coversheet than have the wrong one.

    OK, I got a problem here, I'm reading the instructions, and when I generate the barcode and I'm ready to paste it into the 'Coversheet' accordingly, his instructions are not clear as to where to paste this barcode.

    First of all, on the link for the MS Word copy of the coversheet, there should only be one page, right? The one that says on top, centered, "National Visa Center BARCODE SHEET, You MUST RETURN THIS PAGE with your....", correct? Yet, in his instructions he says "Then go to the MS Word copy of the DS-230 coversheet and left click on the old barcode that's already at the top, to the left of the words "INSTRUCTION PACKET AGENT." Hit the Delete key. Then click on Paste under the Edit menu (or hit Ctrl + V on the keyboard). The barcode may be underlined -- left click on it again and then de-select the "U" underline button in the MS Word Toolbar."

    I don't get it - the file from this link does not have a barcode on top of the page, and nowhere does it say on this sheet "INSRTUCTION PACKET AGENT" - ???? I am thouroughly confused by these instructions, there seems to be a disconnect somewhere...can anyone please help with this??? I am trying to generate this barcode for my DS-230, but am quite frustrated by the confusing instructions.

    After all, the page that I have described above, is the only page that we should be generating a barcode on and sending back with our Form, correct??

  4. Hi guys, called the operator, real cheeky of me, but i really wanted to know about this.... i said i received my checklist coversheet, hahah unfortunatly i "spilled" coffee on the very bottom part that had the 3 digit code A2D 10/04/2007 casen number etc etc.. What a blag.. hehehe

    She then proceeded to tell me, don't worry about that stuff at the bottom, its only the barcode and case number we need to get it to the right person. Then repeated to say, don't worry its just the barcode and case number we use to scan it in a get it done :)

    Awesome! But still being weary of the operator i'm gonna just delete mine completly and send the goods in!

    So does this mean that we can go ahead and send in the DS-230 without the Barcode sheet?? Will they accept it?

    No. You should include the cover sheet, otherwise processing may take more time or stuff may be discarded.

    A2D, if I understand it correctly, only shows up on RFE cover sheets.

  5. OK, sure, it is nice to come home in the daylight . . . but 3 weeks earlier?? Doesn't make much of a difference cause it is going to happen soon anyway. As for me . . . I have a hard time getting up in the morning, so I have a really hard time with this one!!! It always seems like a cloudy day!! and what was worse . . . it was mainly cloudy the first 2 weeks of this anyway . . . so it made it worse!! :crying:

    Actually on Marc 10 (a day before daylight savings time started this year) at my location the Sun rose at 6:15AM and set at 5:56PM

    while on Nov 4th it will only rise at 6:29AM and set at 4:47PM. It means that in March when the change occurs the days are 1 and a half hours longer than in early November!!

    Only difference is that the average mean temperature is only 44 F in March 10th while in November 4th it is 55F.

  6. I have had the same messge "a packet of info was generated on October 8th..." since October 8th. How do I know if it was actually sent? I have received nothing yet...

    The operator said it was sent, but hmmm.....???

    In my case after acknowledment of IV fee payment I got the following one:

    "NVC is expecting return of the biographic forms by the... " It was on Oct 15th and as of today it is still the message I am getting from IVR. I think this is the new message for DS-230 generation. Better it is because I sent out my response last week and they received it this Monday. :)

    My P3 was generated on Oct 15, so I am not sending in anything earlier than requested. I just don't want to wait one or two more weeks to receive it in the mail. I made the cover sheet based on the instructions on this website and gathered the required documents.

    I just wanted to know if the envelope is any special.

    Can someone who is not from an English speaking country help me clarify the translation requirements for documents need to be sent to NVC with DS-230? I did not have receive Packet 3, yet but it is likely that it will be generated tomorrow. I would like to get everything prepared before it arrives in the mail.

    RE: Translations

    Translations

    Applicants must obtain English language translations of any documents that are written in another language.

    The translation must include a statement signed by the translator that states that the:

    Translation is accurate, and Translator is competent to translate.

    RE: Certified Copies

    Please obtain the original documents or certified copies from an appropriate authority (the issuing entity)

    * This means if you get a copy of a document, IT MUST BE CERTIFIED BY THE SAME DEPARTMENT WHERE YOU GOT THE ORIGINAL DOCUMENT.

  9. Thanks Chris for the detailed information. My original question meant to find out the actual policy of NVC regarding document that are on the official language of the country where the interview takes place. The website indicates that it is NOT necessary to do a translation.

    Was any of you instructed by the NVC (in a form of an RFE or verbally) to provide an English translation of such documents?

    NVC is a bunch of contractors in New Hampshire charged with collecting and reviewing documents in advance of submitting the case file to an embassy abroad. The official language in New Hampshire is English, so I think a document in any other language will need a certified translation or else NVC will not be able review it.

    I called NVC today because they processed my choice of agent form incorrectly. Althouh it was a no-brainer they managed to do so.

    I also asked the person about the translation requirements. She insisted on English translation of the documents although she could not tell me why the website informs applicants differently. I may send an email asking them to fix the problem.

    My general advice: Translation should be certified by a disinterested party competent in both languages.

    That doesn't mean the third party has to necessarily prepare the translation, though most professionals would insist that they do the translation so they know exactly what they are certifying (translation errors can be hard to spot). However, the third party can just review the translation and then certify it. The translation can be attached to a photocopy of the original document, but NVC will still want to receive the original document to compare the copy to the original in that case. I have not tried submitting certified copies of the original.

    The third-party and certification does not have to be in the U.S. Ideally, the certification should be in an affidavit format at the bottom or the back of the translation or attached to it, executed before a notary. The affidavit statement I've been using, taken from professional translations done for me in the past (I haven't received a decision from NVC accepting this yet):

    This link is common for all Appointment Processing consulates. If I click on the links that deal with documents all have the same note I quoted:

    "All documents not in English, or in the official language of the country in which application for a visa is being made, must be accompanied by certified translations. "

    But I keep reading here that people are sending in (or requested to send in) translated copies to NVC with their application.

  13. Can i fedex my documents to the NVC??? usually my wife sends them visa USPS...

    Yes, private carriers like FedEx can deliver to NVC in NH. It is P.O. Boxes like St. Louis that FedEx and similar are no-nos.

    Wicked news, i'll have the new bits off tommorrow then, its just the A2D thing thats bothering me, i might be the guinea pig here and remove it and see what happens! haha

    We already have two guineau pigs on the A2D thing, and I am one of them! Unfortunately, it will be a few more weeks (until my I-864 review is completed) before I know fully and completely if using the wrong code there had any effect. In any case, I'd rather use an invalid code than a correct code that is wrong for the case.

    I am sorry to hear that NVC is messing with people about the documents.

    Did we come to a conclusion regarding the English translation, yet?

    Does anybody know how the DS-230 cover sheet looks like when there is no agent appointed by the beneficiary?

    Did any of you actually see that version of the cover sheet?

    It's still the same thing, the name and address is written exactly the way it was written when the beneficiary received the hard copy of the DS3032.

  15. My DS3032 was generated on the same day. It took 16 days to receive it. My friend sent me a regular air mail from NYC recently. That took 4 days to receive, including the weekend. I do not know why NVC mails are so slow.

    Did you compare the dates? IE the date they said they mailed the DS-3032 to you vs the actual post mark on the letter?

    They do not even have the decency to put a US postmark on it. There is only a german postmark (Deutsche Post) that lets you know that it came through Frankfurt. No date whatsoever on the envelope. As part of the german postmark there is a tiny 3-letter word: EWR (that is Newark's airport code) So what I can reconstuct is minimal: at one point in its way here it was flown from Newark to Frankfurt. I am about 1000 km from Frankfurt.

  16. As of October 1st, 2007, all embassies will be NVC appointment processing posts. Original documents will be required to be included if the package is received on or after October 1, 2007.

    This is really horrible :( It looks more and more like what we've been seeing this past year is complete and total centralization of the immigration process, so that it will move slower and (seemingly) discourage immigrants :( More control, less flexibility, less information for the masses.

    I called NVC again tonight. The answer this time is, yes, as of October 1st NVC will begin doing appointment processing for almost all the embassies, however because they sent the DS-230 package to me already (I guess they did if he's saying so, the IVR never did though), I may not be subject to NVC review of the civil documents, but if I am, they will send me an RFE. Operator also said, if I send the original documents now with my DS-230, they will be accepted and put into the file, and they will go to the consulate, however NVC might not review them.

    Therefore, I am sending out my DS-230 package tomorrow with the original documents included, at least that way I know they'll get to the consulate safely and I'll avoid an RFE as much as I can.

  17. If they said that the DS230 has been generated and has been sent out, then you are OK sending the DS230 packet already.

    They don't say it has been generated, they just say it will be mailed out this week. I would have to presume this means that it was generated, as how could they mail it out if it hasn't been, but since there was no IVR message for it I am somewhat concerned.

    I suggest to call NVC again and let them know that the information of change with the Standard or Appointment Processing was from their own website and that you are calling for verification. Sometimes you need to talk to not just one NVC operator to verify things with them.

    I will call them again a few more times to see if any consistency arises... I think NVC is going to be very unprepared for collecting civil documents from this country (Russia) if they are, as even today, they are handwritten! Maybe NVC knows about the local policies for countries like this now, but I tend to doubt it.

    How does NVC know if the documents are the right ones if they are not translated to English?

    I guess they need to be at least marked in English.

    I called NVC today and the automated machine said that "DS-3032 was recieved by the NVC and will mail further instructions in next few weeks"

    What does this messege means? does it mean that they have entered DS-3032 into the system?

    and if they did entered it in system then when do u guys expect them to generate IV-bill?

    NOTE: I sent out my DS-3032 on Sep 25 2007

    I am only one step further on than you.. DS-3032 has been recorded.. now machine says "IV bill has been generated and will be mailed in the next few weeks"... well it was generated on the 3rd of Sept and we are still waiting so i think there are a few delays..

    You should give them a call if you are worried.. but i think that message sounds about right to me.
