Hi All,
Case Category: CR1
Embassy: AbuDhabi
Petition: Spouse
Case was returned from the consulate(June 2021) to USCIS for further review(221g revocation) on September 2021 and now they are saying that our case was returned to NVC on February 2023 and we contacted the NVC but they don't have any information about our case.
I used all my resources to approach them(NVC) but I haven't heard anything about it.
Can anyone suggest...

@Family so even though USCIS states they sent the case back to NVC it isn't there? Is it still at USCIS? Is it in a nomansland never to be touched?
OP says the visa was sent back to USCIS September 2021... nearly 2 years ago! Is it possible that won't act on the revoked visa at all? Or has OP missed some communication?
What if they call for the second interview so what documents you should recommend to take with us and If I'm there with my husband during the interview so will it make any difference.
Need your suggestions

No one is doing anything on your case .Consulate kicked it back and it’s not been looked at by anyone.
I was calling them from very first day and they told me before that they have received the case and after some months I request congressman and according to him the case is in security check and now the tier 2 person sends us the email that the case is reviewed and returned to nvc and we don't know what's going on but I hope everything goes well now.

All denials have a solid reason, and it is not a luck based system.
Pakistan, like other countries with high levels of extremism and fraud, is a rough consulate. Are you originally from there? Has your spouse been married before? Are you first cousins?
Yes I born in pakistan and we studied in the same primary school in pakistan and no any previous marriage and no any first cousins.

Generally your husband will be invited to interview again. In your previous thread you said he was denied in Abu Dhabi… so he should interview there. But, if he is in Pakistan now you will have to request they move the interview to Islamabad. The reason we keep asking for reason of denial is because if they didn’t believe your relationship was real your husband will have to show proof you are in a bonafide relationship.
Generally when a case is denied the petitioner is given the opportunity to refute the allegations made by CO… but you seem to have skipped this step. So, I am confused. But, as long as you have continued to visit your husband in person while waiting for the new interview you should be in good shape.I have a plan to visit him again very soon and I'm collecting all these evidences but even I don't know what exactly they are doing in our case.

ok. Does not sound right. Did you read all the FOIA and it’s about your husband? Did you saw the document or just your lawyer told you about it?
Yes he sends me all the documents and there is nothing about our consular return

So you requested a FOIA for yourself not for your husband? Or did you request FOIA for both of you and you didn’t receive anything from your husband’s case?
If you haven’t requested FOIA for your husband this year I would try one more time… you might discover why USCIS decided to reaffirm your case… paging @JeanneAdil how did you receive information about why your case was denied?
How did you naturalize? Through parents or through a spouse?I applied for both but will try to apply again and naturalize through parents and as per uscis the case is in nvc so what will happen next as per your knowledge and experience.

Can you find the documents that state why they sent the case back to USCIS. Make sure to blackout any sensitive information like names, birthdays, identity numbers and case
Mostly forms like i 130 etc they sends us.

Did they said something about red flags or the Revocation on the FOIA
As per lawyer no any document released from the consulate.
Mostly documents released are from uscis and nvc and mostly old documents of naturalization etc

Did you read the FOIA? Can you upload here without sensitive and person information?
What exactly you need because they have sent too many documents

If the visa is denied though will you divorce or move to a third
Can they denied without any solid reason? If yes so the law allows me to try my luck again.

OP: VJ is a community that provides insight and help in US immigration cases around the world.
VJ has no way of making decisions in any case, but rather can provide valuable help to resolve issues based on the expertise of some members and the experiences of others.
Shopping around for different answers by providing different versions of the story is not going to get you anywhere with your actual process, but it will only get you confusing feedback based on the information you provide every time.
I know some members may be looking for hope and comfort by providing different versions of the actual story, but it will not change the outcome of the case, because only the appropriate authorities have a say on the decision.
Providing not accurate version of the story might get you the wrong
I know the rules and regulations and I appreciate each and everyone who is here to help and share their thoughts and experiences but I only share what I received from the concerning department.
I don't know what's going on their head 😕 but again thank you for your help 🙏

Have you ever contact a lawyer about the “Revocation of Petition” thing? About the marriage fraud or something like this.
What about request FOIA? Maybe this can show anything that you are missing.
What’s your husband country? Have you visited him more times? Have you ever thought about moving to there?
First of all I took advices from many of the lawyers but they told me to wait for them to respond.
FOIA received and according to the immigration lawyer that everything is good and there is nothing to worry. He told me to wait for the response.
It's Pakistan and yes I visited alot in last few years and I don't have any plan to move there.

OP, between your previous thread and this new thread, what have you done to address the consulate's concerns that it is a
The only thing I did is to spend more time with my husband in his country and no one has contacted me so how can I prove anything to anyone.
I didn't receive a letter from any of the department.

The published date for responding to I quirked is one week right now: https://travel.state.gov/content/travel/en/us-visas/immigrate/nvc-timeframes.html
it is a good sign if the case have been reaffirmed by USCIS and sent back to NVC for processing.
but you don’t know if that is the case yet until you get a response from NVC.
Good luck
Thank you for your guidance 🙏

Wait for NVC’s response and then take it from there.
once you have clarity on the status of the case, you can get your congressman’s help
Normally how long nvc will take to respond? And is it a good sign that they have sent case back to nvc?

Did you try contacting the NVC,?

Hello everyone,
After consulate interview in 2021 they returned back my petition to usics for further review and today I contacted uscis and they said that they received the petition for review in 2021 but in Jan 2023 they sent the petition to NVC.
Can anyone tell me what's going on because I haven't received any letter from the uscis or nvc

My question is if the officer could have suspected that you were doing it for financial reasons. If so, what proofs did you submit to prove hem wrong?
This is actually a difficult one for me to explain my situation because I am working here and I can afford my own stuff and I never asked anything from anyone.
But how anyone can prove that? 🤔

Proving a negative is very hard. Close to proving that you were never married. For some reason officer might think that you did it for an economic profit.
So what you want me to do? What options I have now?

Thanks for answering - hmm this was my only thought when saw that you knew your second husband as children.
Hopefully the notice of intent to deny will shed light and you can refute each point with evidence - though as has been pointed out it may just result in a decision of ‘you may reapply’ but at least you can then tailor your new application to address these points early on.
Wishing you the best in your immigration journey.
Thank you for the help

Did your previous husband apply for immigration for you?
If the first husband sponsor you for immigration - when did you marry, immigrate, and divorce?
How soon after divorce did you marry second husband?
For those who marry to immigrate, divorce, then marry someone else from home they can be suspicious that you used first husband to get here when really were planning on bringing second husband the whole time.
As @jorgedig says you could go live with your husband - maybe not the first choice but at least you would be
No this is not the case and I moved to US around 15 years back with my parents
After 7 months of divorce.

Hello everyone,
I received a NOIR says that "the petition was subsequently returned to USCIS as the beneficiary did not establish the marriage was entered into in good faith. Good and sufficient cause exists in the present case and supports the commencement of revocation proceedings", and they asked me to provide bona fide evidence.
I traveled every year to his country and have all related evidences of travel like pictures, tickets, apartment receipts and stamps etc and we traveled together for honeymoon so i can provide that evidence and have affidavits to support and we have one plot which we bought together in installments in his country. Is this enough to submit?
Please share your thoughts and opinions.
Thank you.
