It was “due to the nature of the crime”. Nothing regarding misrep or ESTA but being denied they did revoke his ESTA.

Good morning,
My husband had his CR1 interview today at the US Embassy in London. He was denied as ineligible for visa “Due to the nature of the crime” which was damaging vehicles when he was 15.
I have 3 questions:
I plan on completing a waiver to move forward. This is the only option to move forward, correct?
Also, the officer marked I-212 but it would be I-601 or am I incorrect? Still gathering my thoughts with this just happening.
Is it okay to continue without a lawyer or should I add one at this point?

I eventually passed but I've found that you will be denied and apply for a waiver unfortunately
There's a similar person I talked to thats going through something very similar and they were denied so they're going through the waiver process now

He was just denied. Looking into the waiver information now. I’m honestly in shock. How long did the waiver process take?

My wife and I were just reviewing our uploaded documents to check everything. One issue that ahs arisen is that she signed the I864 with an apple pen which we assumed would fall under an electronically reproduced signature. But looking again at the phrasing it seems as though we should have uploaded a scanned version of an original handwritten signature.
Given that we're around a month away from our review date, we're wondering what the best next steps are. What we've considered is:
a) Ignore it and hope for the best. It looks like we did the same thing at the I130 USCIS stage and it wasn't an issue there
b) Redo the form with a scanned handwritten signature and upload it under additional documents with an explanation. That way if it's flagged at the review stage we preempt the RFE by having it there
c) Replace the i164. We desperately don't want to do this as it resets the clock if we're headed for a certain RFE we may as well do it now rather than in a month.
Any advice always appreciated.
Hi! Did you decide to re-upload under additional documents? You stated being a month out, have you been DQed or has your submission date not come up yet?

From what I have seen London usually does not make a big fuss of his sort of misrepresentation assuming it is one

Hi! When you say “probably not” are you referring to there probably won’t be an issue with the visa bc of the ESTA selection?

Hello - My husband is a British Citizen and we are applying for CR1. We are in the NVC stage and received his Police Certificate in the mail. It states “No Live Trace”. He had thought since it was spent it wouldn’t show as a conviction, this is how we’ve answered up until this point, as no convictions. I know to move forward we need to obtain the SAR. However, he is worried (and now has me worried) that since he has been selecting No to convictions on the ESTA that this is going to cause issues for his CR1 visa. Has anyone had a similar circumstance or have any advice? It was spent but had gone to court, so I believe unable to expunge. He was 15, damaged somebody’s car with a flower pot..

I can't predict what will happen at your interview, but am aware of lots (over the last 10 yrs) who had similar circumstances as you and there was no ESTA discussion. ESTA is Homeland Security while visas are the Department of State, so maybe it was just a matter of "not my job" to get into ESTA discussion. Good luck.
Of any of those similar circumstances you mention, do any of them have posts or is there anywhere to follow to read their story of events? Thank you!

Hi! Don’t know if you’re still on here but was curious to the outcome as I’m dealing with the same situation. Today is a month from me receiving the K3 denial letter stating my petition for CR1 has been approved when it’s still not..

There is an update that I need to post. I sent the following email to the embassy a few days following his interview as his circumstance fell under not being inadmissible and I asked for further review. They responded 3 weeks later confirming that an error was made by the interviewing officer. They asked my husband to send in his passport. He received visa in hand on 10/25/22!
