Hi everyone,
Well our Biometrics letter arrived today and of course they scheduled my appointment for February 15th (I fly to the UK on the 14th) even though I included a note stating I would be away.
So my question is, I have seen some references to people doing walk ins and wanted to know how that works and if I could do that so I don't have to reschedule my appointment.
Thanks in advance,
Luke

It must have changed since I travelled to the U.S. I got denied the B2 tourist visa on Feb 14th 2008 and flew to America on the visa waiver programme on June 11th. I remember that I was told I could still fly under the visa waiver programme. The only reason I thought you couldn't fly using the waiver was if you are turned home at the border/POE. That's at least what I was told.
When I applied for ESTA when that first came out, my application was not approved right away, took a few days to get approved as I guess my denied visa flagged me. Still travelled again though on June 11th 2009 while my K1 was pending. I even told the lady at the POE who took me for further questioning about it.
Like I said though, things may have changed since then, not sure.

Hey, I am also from the UK and after a few 3 month visits to my now wife I applied for a B2 tourist visa so I could stay a full 6 months. I went to the London embassy and was denied under 214b (lack of ties to home country).
I did however fly a short while later under the visa waiver programme for 3 months or so. As I had a denied visa it did flag me at immigration and I did go for further screening at MSP airport but was allowed through. I even visited again after filing our K1 and yet again went for further questioning at POE in MSP but was still allowed through.
So chin up. I don't know if it has changed since the ESTA came about but maybe find out. Bottom line is you can figure something out and maybe have him visit. In the UK you can visit for 6 months (if it hasn't changed) without a visa.
Hope this helps,
Luke

So our NOA1 arrived today with a receipt date of 12/29/2011. One thing though, when I enter our receipt number on the case status website it says:
'Your case can not be found at this time in My Case Status. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1.800.375.5283.
Anyone know why this could be? I'm using the correct code beginning WAC and omitting any dashes.
Thanks,
Luke

Check was cashed today so hoping NOA1 will be here soon!

Posted ours out today. Card expires on the 11th of February.

The passport needs only be valid for the time of your absence from the United States. If you return on a Monday, it can expire at Midnight entering Tuesday. Thereafter you never will need another Aussie passport in your lifetime again, as far as Uncle Sam is concerned.
Can anyone confirm this? My passport expires in August of 2012 and I fly back end of February.
Also, i'm a little confused on this section of the I-751.
Affidavits sworn to or affirmed by at least two people who have known both of you since your conditional residence was granted and have personal knowledge of your marriage and relationship. (Such persons may be required to testify before an immigration officer as to the information contained in the affidavit.) The original affidavit must be submitted and also contain the following information regarding the person making the affidavit: his or her full name and address; date and place of birth; relationship to you or your spouse, if any; and full information and complete details explaining how the person acquired his or her knowledge. Affidavits must be supported by other types of evidence listed above.
Thanks,

Hi everyone and Merry Christmas,
So it's that wonderful time to start Visa applications again after 2 years of peace. I will be submitting my request to remove conditions on my permanent residency based on marriage to a U.S. Citizen. My question is my card expires on February 11th and I am flying out to visit my family on the 14th of February for 2 weeks. What will I need in order to get back into the U.S. without any problems as my card will then be expired.
Thanks,
Luke

Only if you want to leave the country before you get your green card.

Touch means the last date your case shows is updated. No status change but means your case has had something happen or someone look at it.
Transferred means it is moved to another service centre. This is done to speed up processing, well at least that is what they say. If your case is transferred it may mean you will not have an interview.
Hope this helps

It is different for everyone.
Take a look at some other peoples timelines to get an idea of how long it took them. You can search timelines and even see the average time between packet 3 and interview. There is loads of useful information on Visa Journey. Start in the 'Immigration Timelines' section and look at other timelines similar to yours.
Good Luck

Nope, its not there yet.
It will say by the end of today 'Delivered'
Mine said arrival at pickup point at 10am and was delivered at 4pm.
Sometimes they can be slow to update it to say it's delivered.

We were checking ours all the time too at first. But then just we stopped checking ours and had been approved for 2 days without us even knowing.
A watched pot never boils as they say.
Don't rely on the e-mail notices as they never e-mailed us during our K1 process. They have been with the AOS so maybe they got better.
Good luck

Yes you can stay with him.
I visited my fiancee (now wife) for 3 months while our visa was processing. I also was very honest and said exactly my reason for visiting.
Take along your NOA1 as proof you are going the legal route.
Good Luck

How did you pay?
If you paid by cheque you will see the money go out before you get your NOA.
Good luck and hope you hear something soon.

It all depends. Some people get approved quicker than others.
For us we filed in December 08 and I got the Visa end of September, but we did delay some of it to fit in with travel plans. Take a look at some timelines to get an idea of things are moving right now.

I bought a return as it was cheaper. Try having the return date on a Sunday as it was cheap for me. My Outbound journey was on Saturday and returning Sunday. That would have been a short trip had I returned. Ha
If a one way is cheaper then do that.
Happy flight hunting.

Yes, but if you send the EAD first you'll need to pay the fee of $300 odd dollars.
If you send the AOS first, just make sure that when you send in your EAD you include the AOS NOA1 copy or receipt number and you will not have to pay the EAD fee.
So my advice is if you were thinking of doing the EAD first, don't as you will have to pay the fee.
Hope this helps.

I also had the same RFE and just got another I-693 vaccination supplement filled out (only cost $15) and my case was also transferred to the CSC. Doesn't mean it's been approved yet but a good sign. My EAD however was approved so thats good news.
Hope this helps others in the same situation as I know a lot of people got this RFE.

I was merely trying to understand how you managed to go two years without filing. Yes it is frustrating when people work illegally when others are trying to do the right thing, and for you to say that you would do it again only makes it worse.
My wife works part time and I have only just got my EAD approved and things are very difficult financially, yet I do not work illegally. Although we do not have any children to worry about as we want to wait till we are in a better position. This is not a 'my situation is worse than yours' as this process is difficult on lots of couples.
I agree the fee to file AOS is crazy but I knew ahead of time that I would need it, it wasn't a surprise when I got here.
Why is it relevant? I was just trying to get a better understanding of your situation.
I hope that you get this issue resolved.
Good luck.
-
What was your reason for not filing? I don't think you can forget something like that. It does frustrate me a little that people do this. You did all the K1 visa documents and put so much work in to get here then just stop!!
Also taking up work illegally while others (like myself) struggle while waiting for our EAD seems a little unfair.
Good Luck and I hope you get it sorted out for your family's sake.
