    You don’t need a police certificate from the USA.

  2. Hello there, I'm the Canadian beneficiary, preparing to fill out the DS260 and begin gathering documents for the IR1 visa processing.

     

    On March 26 2018, I immigrated to the US on a K1 visa, married my USC, but left on Oct 3 2018, which is six months and one week. I left without receiving a green card.  My googling and internet searching about police clearance requirements for the IR1 visa has left me confused. Some sites say present and former residents of the US should NOT obtain any police clearances covering their residency in the US. However, given the lack of a green card, I am not certain I would even be considered a resident of the US for that period, so would that mean that I do in fact need the clearance?  Other sources suggest you need a police clearance for any country in which you resided, after the age of 16, for more than 6 months.

    Would anyone happen to know if I need to provide a police clearance for the period I lived in the US? Thank you kindly in advance for any assistance.

     

     

  3. Hey all.  My USC hubby texted me this morning that our petition was approved yesterday. 

    So, that was 170 days, or about 5.5 months. I can hardly believe it because all other indicators, including aggregated data from this site and others,  say it should have taken over a year just for approval. In addition, we thought our case was not that straightforward, however, I guess the USCIS thinks otherwise. They probably deal with much more complicated cases but, for myself, though, I half-expected to get an RFE at the very least. 

    But my spouse sent me a copy of the NOA2  and it seems legit LOL so idk...?  I'll add here that we've been down this immigration road before. I first immigrated in the US in March 2018 on a K1 visa. That took a bit over nine months in total. Got married there, ended up abruptly returning to Canada 6 months later,  under not-ideal circumstanes, without a greencard or advance parole. As most here will know, you can't just turn around and stroll back across the border without paperwork.  Long story short, Time and COVID intervened, and it ended up taking three years to get the I-130 application done and sent off. PD for that was March 1.

    Not gonna go into any more detail than that, but that initial K1 visa application took longer to approve than this I-130 application. So, I am happy but kind of baffled and cautious because it seems too good to be true LOL.  Although I expect the NVC stage to drag on now. That was the shortest part of it for the K1 process but this time of course, things are different.

    Anyhow. Who knows, maybe we got lucky or they're moving things along faster now. But I know there are many people who've been waiting a lot longer just for their NOA2.

    Okay so, if anything changes or we get more info that might be helpful to others, I'll let y'all know. :)  Cheers!

    Hi! No I don't mind the question at all. :)  Unfortunately, I have nothing new to report, case status still shows as being actively reviewed.

    It could be based on your service center. Mine is Vermont (transferred from Nebraska) and yours says Potomac. Maybe they don't have enough data on Potomac vases (or Potomac cases from Canada) to make an estimate.

    That's what I was wondering. I guess I thought the data was compiled based on all cases but it does make sense to look at service centers individually if there's a lot of variance. I don't think it matters much that the data for Potomac is insufficient at the moment since movement is still so slow in most cases anyway.

  6. Hey everyone. Just thought I'd add my no-news to everyone else's no-news LOL!!

    But I noticed something which seems a little odd with the site here. When I checked our timeline today, the part at the bottom which shows the estimated processing time says the following:

    There are not enough recent approvals in the timeline system to accurately approximate when your I-130 will be approved. Please see the Timeline Stats page to see recent approvals.

    Huh? I just checked it yesterday (maybe the day before, but very recently) and it said between Nov 2021 - Jan 2022. I noticed it changes once in a while, sometimes pretty wildly, which is to be expected. But usually it's somewhere between Sep. 2021 (the earliest I've seen) and Jan. 2022. This is the first time I've seen no estimate at all.

    So I looked at another Canadian beneficiary in the thread here, @kkeys  *waves* Hi guys!! :P  to see if there's any comparison. And there is, time-wise. Our IR-1 PD is Mar 01/21, which happens to be just a couple days after theirs.  Yet, on their timeline, the estimated processing time says this:

    Based on timeline data, your I130 may be adjudicated between October 5, 2021 and December 1, 2021*.


    So the compilation of data is still working in at least this one (maybe) comparable (ish) case, it seems.

    Would anyone happen to know why an estimate for processing time disappeared completely from my timeline all of a sudden like that?  Am I missing something?

    Is it because of the difference in processing locations maybe? Ours is at Potomac, while the example above is Vermont.
