Hello,
I know this topic or question was asked many many times, but maybe somebody has a good advice on the current situation.
Our petition got approved recently, something I have not expected at all. There are so many rumors that you should not travel
during your wait times.
Our attorney is telling me how risky it is to actually fly and tells me it puts me into risk of loosing the entire K1 visa and getting banned for 5 years.
Is it true?
Also I am traveling with an ESTA where I stated my current employment situation, where I am staying. I am bringing over my old passport where I never
overstayed and my flight ticket to proof that I am good to get home.
I can not really provide any statement of my work, because its not in English. Is that good above or anything else I should bring?
Thank you for any answer ❤️

Also joining this journey for now :).
NOA2 Feburary 26th, so guess around November 10th should be fine to check. Anybody knows if the I-134 is still good to go, even if its expired :)?

Hey after 249 days or maybe 250 days idk we finally got approved. Noa1 February 19th, never thought it would take that long.
So much pain and patience. I wish all the best luck to get approved asap ❤️

Also got a response of USCIS on our case inquiry, that our case is being adjudicated today.
We sent the inquiry on October 14th, NOA1 is Feburary 19th. So kind of forwarding
Kind of the same as with @lastrose where they got the message and got approved 4 days later :).

Checked about 15 minutes ago and nothing and was coming back to do some spreadsheet updates and it just popped up!
231 days from NOA1.
Will post spreadsheet updates tomorrow and update my timeline now!
Hey awesome :). Congratulation to your approval, thank you for doing the spreadsheets :). All the best for your case 👍

that is right, i was also thinking if it was possible to pull feb data once cases were approved.
You can, but different.
The only way to know if a status has changed on a specific case would be the actual case number. Thats one of the reason why it felt like a struggleto organize the cases by the actual dates... like 1st Feb, 2nd Feb.... and so on. It looks like the easiest way to organize and filter that stuff is by using the
case numbers.

The reason behind the different dates is the last taken action on it by USCIS.
For example:
Case got approved - last status change case september 15th (NOA2)
Case was received - last status change january 28th (NOA1)

Finally some movement today! 29 cases processed so far on 9/13.
- Most in the 49500 to 50500 range
- All are from Feb 1
- 21 approvals
- 7 RFEs
- 1 expedite request denied
Awesome to see some movement, kinda exciting.
I delayed my search of yesterday and set it to today. So I don't know if you still need the cases.
I made a summary of all cases in one file so you can easily copy and paste it.

I just wanted to state that I am giving you a link to my Google Drive, where I pull the entire Data or CSV files of the CaseTracker
App for the month February.
It is for people which are interested in doing a spreadsheet or cooperate together, which is a good option. Due the
limitation of the CaseTracker App of only being able to pull 500 Cases every time, makes it to a total time of over an hour
to achieve an entire month. Thats one of the reason I wanted to participate in the entire process, because it saves a lot of time for the person
which is doing the actual spreadsheet or refreshes it once a week or similar.
I thought of pulling the data every third day, but it is so time consuming that I am doing it every 5th day, unless somebody else wants to
participate.
---------------
I also found out that the cases we (February) are looking for starts with the Case Range
WAC 21900-50000 and ends up with around ....-57500.
That means that in total 7500 cases are going to be processed within February, independent of the K1.
In case somebody is a February filler and is outside the CaseRange should definitely write something to be a part of the spreadsheet :).

Tax returns are an important but not direct indicator of your current income. They put more weight on current income which is shown through employment letter and pay stubs. At my interview they asked for the most recent tax return along with the other evidence, but consulates are different so not sure if it’s the same in Germany. At the same time you can’t present what you don’t have (ie previous years tax returns) so you have to work with what you have and looks like you’re in good shape.
Awesome, that is good to know, also hearing someone else's experience....definitely keep it in mind.
Thank you for your answer and your experience at your embassy :).

Yeah you are right. Doing the K1 Visa takes longer and costs more than a CR1 (Marriage based Visa).
Currently both of the visas take the same amount of time of progressing, because of the Pandemic.
Doing the CR1 Visa gives you a green card right after arrival instead of the K1, which takes approximately another year. I can’t give you an exact amount when you get the green card, but based on the hearing, you get it way faster than the K1.
I think based on both Visas and the professing times it makes no difference of seeing each other. After your K1 Visa got approved you can travel to the US, so I think the only thing you have to consider is the after path, like if you want to wait for a work authorization or a green card.Hope it’s understandable

Hello :),
I am kinda preparing myself for the NVC -> Embassy stage where we have to file I-134 (Affidavit of Support).
A lot of this is actually clear, the only thing which makes me feel worried is the submitting part of the tax reports. In our case we have only one tax report but an actual sustainable income (past 6 months around) which fits the poverty guidelines.
I know this question might have been already asked many times, but maybe somebody can state on this
situation what would be best to do?
Nobody wants to have a denial or anything similar, so in this case if its preventable maybe
there are people outside with experience what they did. Thx ❤️
-
Yes, you can read it on the official website.
A valid K1- Visa by the embassy gives you a "NIE" (National Interest Exemption) which allows you to enter the United States independent of the
travel restrictions. The only thing you have to consider is bringing a valid COVID-19 test :).

Still nothing back on our case... Wondering what we should do...
Guess you can be only more patient or maybe call USCIS to mention your worries and current situation.
Whenever you call them, provide them any information of payment you did. I dont exactly remember if you said they cashed out or not, but any reference could be good.

We sent our petition Feb 10th and we haven't heard anything back yet.
Hoping we get a NOA1 soon thoughDid you use any tracking for the package?
If so and it says "delivered" and signed by anybody, then you should be fine and in the system. We received the receipt or the notice 4 weeks later whenever it was already in the system. So if you have an actual delivering date, I guess that should be the actual NOA1 date.
Correct me if I am wrong.

Usually it would but because of delay they are backdating the NOA-1. I know the lockbox is behind about 4 weeks but about a month ago they were behind 8-12 weeks. I filed in January and didn’t receive the notice until 8 weeks later. Just look at your other feb filers timeline. Also check your case number in the USCIS case tracker. That is your NOA-1 date.
Interesting, did not know that to be honest.
I am having the case tracker app, but good to know of somebody.
Definitely going to change that :).

Your NOA-1 should be backdated to feb not March.
Wait really?
In the letter it says "Received Date: 19th February" and "Notice Date: 19th March".
Isn't the I-797C the actual NOA1?

My fiance got text 23rd March still didnt get the letter yet. Which state do you live btw?
Hm kinda weird, but I guess there might be people which know more about it.
I guess sometimes we need to be more patient about it and wait a couple days more, if not maybe a call could help, but maybe there are more informations for how long you should wait until you can call the USCIS.
I am from Germany btw, not from the States

October 2021 K-1 NOA2 to NVC to EMBASSY

Link messed up
Yes you can track down the packages going to your country. The NVC ships every 2nd week, the last shipping was on the 23rd November. So if your case isn’t in transit it will stay there for awhile depending how your embassy is affected by the backlog.
In order to track down the DHL packages you have to go there:
Type in the shippers reference.
EXP 23 NOV 2021 A
select the time frame and type in your country. Make sure you leave the space in between or else it’s not working. You need the EXP | Date | Month | Year | A
If you leave the country blank you see every package (case) they ship. Maybe use a computer, seems like the link is getting messed up by a phone :).
