My 90 days K1 visa will expire on July 26 and of course employement autorization will also..Few days ago we filed for AOS,EAD and travel document...I found a job and want to start to work...Can I work that period of time when my K-1 work autorization expired and I didnt received EAD yet??? That few months???Of it will bring troubles with immigration later?

    My employer just looked at my military ID card(it also has my SSN on it) and thats it..I mean they didnt ask for other documents yet...

  2. Hey guys...We filed paperwork for AOS everning on the 1 of July..I was tracking ups and unfortunatly ous pacakage is still on transit in Chicago...4 days long weekend.. Well.I hope we will get somenews next week and soon I will join you and together wait for the interview...

    I wish everybody luck and speed process...

    Oh yeah...and one more thing...We filed the paperwork to Chicago lockbox...and I live in Texas..Question is..where uscis will transfer a case,California or Vermont? Or it depens?

  3. Yes, she has to be a greencard holder before she can apply for citizenship but what I understand is that she does not have to wait for 3 years (from issue of her greencard) to file for citizenship. Is this correct?

    OK...Once she recieved her immigration visa in Korea,she has to come to the states and recieve her GC...

    Once she received her GC and her husband in order to change of duty station( not deployed) and if she has that form ,yes,she can file for naturalization no matter teplorarly GC is it or permanent..

    Long story short...Yes,she doesnt have to wait 3 years to be aple to file for citizenship only if hyer husband is leaving USA and his wife is following him...

  4. I met my husband in Korea as well and I have alot of friends who got married there...

    Your brother and his wife have to prepare paperwork and file Direct Consular Filing in US embassy in Korea..

    It wont take long,like 5-6 months...

    No,she cant file for US citizenship yet...She only can file for citizenship if she already has a GreenCard and her husband is CHANGING DUTY STATION and SHE IS IN HIS ORDER..

  6. U.S. citizen can file for K-1 ONLY 2 times..And thats it...

    And also has a waiting period to file a second K-1(in same cases they will also need a waver)..

    You cancelled your K-1,petition went back to uscis thats it...

    Your x-ukraine fiancee can get K-1 visas as long as someone filing one for her...

    Actually there is no actual limit on how many times a US Citizen can file an I-129F petition for a fiance(e). They simply must request a waiver if they file (according to IMBRA) more than two petitions in two years. USCIS seems to interpreting IMBRA to require a waiver be filed with the second petition in two years.

    If the USC wants to file 10 petitions, they can but they'd have to spread it over decades.

    The OP can file the petition if he wants to. Getting the visa is another issue.

    I defenetly know that U.S. citizen could only apply for K-1 2 time ...And thats it...Check uscis website or call them..

  8. I know alot of K1 holders who did AOS and didnt need full physical because they did one just before an interview date!!!

    I didnt expecting to do one too( thats why I got receipt from Medical Center),but the INS doctor in Waco told us that they DO NOT DO I693A NO MORE...I693 AND I693A IT IS A SINGLE PACKAGE THAT IS NOW DONE AS ONE.

    We called another INS doctor in Austin,she said the same thing...She said since I dont have a copy of my physical results(usually K-1 holders dont have copy of physical results,its only in yellow immigration packet which we have to give in POE) I need to do a skin test,and if it will be positive I will have to do chest X-Ray...And they need all K-1 holders do the same thing since 1 of May...

We went to INS doctor in Waco this morning..I had my vacination sheet (that they gave me in my medical examination before interview) and I took a receipt from that medical examination also(so I can prove that physical is not older than a year)..I asked them to complete I693A form so we can file for AOS...But doctor said that since 1 of May they do not complete I693A any more,they do I693...And that I693 is on 3 pages include 2 pages for physical report...

    Now we are online on uscis website trying to figure out what to do next...

I heared that in JFK K-1 visa holders can get Work Permit in passport,so they can work in the states...But in a same time I was reading that K-1 visa is giving right to work within 90 days...I dont understand,if I want to work do I need to fly to New-York and get work permit in my passport..Or I can just work without having work permit??? :blink:

  12. A few examples of my confusion:

    1. Form FS-257a (One for you and one for each of your dependants)- Who is "you" and who are the dependants?

    2. Form DS-156K (One, only for the fiance)- I believe this means only for my fiance and not any dependants if she had any, am I correct?

    3. Form DS-157 (One for each applicant between 16 and 45 years old)- Who is the applicant?

    I realize these seem like simple questions but I just want to be sure. Basically, as fas as I have understood, all the forms except the Affidavit of Support are for her to fill out correct?

    Now some questions regarding the neccessary documents:

    1. Birth Certificate- Do we need to bring the original and a common copy of her birth certificate?

    2. Police Certificate- She is 17 years old and it says in the packet that the Brazilian government only gives police certificates to people 18 and older, she is emancipated however. Does she still require a police certificate? If so do you think the Brazilian Police will give one to her if she shows that she is emancipated?

    3. We need to bring her passport and a copy of the page that contains the biographic information inside her passport correct?

    4. How strict are they with all the photo requirements? I mean does everything have to be exactly perfect in the photo, it seems very difficult and unneccesary to me.

    Now a more personal question which I hope I will receive good answers to, I am in College and am not working at this time, my father will be filling out the affidavit of support. I will support us after I finish my studies but am just not able to do this now, do you think this will be a problem in the interview? I really hope not.

    I will try to help you with information that I have...

    1) Form FS-257a ..Have no idea about what it actually is...I didnt have it for my interview...

    2) Form DS-156K...Yes..It is for your fiancee...She has to fill out this form,BUT she has to sign it before consular at her interview...

    3) Form DS-157 ...Never heard about that form either..Did you mean DS-156??? If yes, she will need two of DS-156...This form is on 3 pages with barcode...She can find it here http://evisaforms.state.gov/

    4)Yes,you have to fill Affidavit,she just has to show it at the interview...

    1)Birth Certificate....She has to bring original birth certificate alone with copy...If it is not in English,it has to be translated to English...

    2) She has to have a valid passport and copy...Also she has to have pictutes 5sm/5sm( 2/2)...

    3)If your father will support you...he has to be a co-sponsor...You will need letter from employer,bank account,his W-2 2007,and also Affidavit of Support from him...

  13. I was reading somewhere that good time to apply for SSN is after 2-3 weeks since you arrived to US...Also that we have to apply for SSN before we got married and after marriage apply for a new SSN...I dont quit understand...Isd it okay to apply for SSN a week after I arrived??? Or what?

    And next thing...Will it coust problems with paperwork(change of status) if I will get my fiance's surname or where is no differents at all??? :unsure:

  14. ,,the interview went very well and the woman spoke fluent Russian. She asked many questions and really wanted to verify that there was substance to the relationship.,,

    There at the embassy they dont really understand why fiance(e)s dont want to be interviewed in English and of course asking them,how are you communicating to your man if you dont understand English?Thats why they ask many questions and want to be sure that applicant is in love with petitioner...

    ,,My girl is Russian not Uzbek so I think that counted in her favor as well.,, Wrong statement..It doesnt matter Uzbek or Russian..Here in Tashkent Russians ,Uzbeks,Mixed..everybody...I am half Russian/half Uzbek and I had no problem in my interview...Consular only wants to make sure that all paperwork is correct,applicant doesnt have criminal records and that fiancee will marry petitioner within next 90 days since she arrived to US...You need to come with smile,good attitude and all paperwork that they need..They are humans too and just doing their job!!!
