    It turns out they did not accept the birth certificate I sent. They want it from the consulate even though DHS's visa reciprocity has a few options available for where I am from. It is a relief that this is a quick fix and I guess there's no need to worry about the pictures anymore. 2 worked just fine luckily.

    You shouldn't be in here guessing though.

    You should wait for the RFE if you actually got a notification for one (which is not clear in your hypothetical post).

    Are you asking because you actually received a notice from USCIS that they will send you an RFE letter, or because you don't see any updates on your case?  If it is the latter, AOS has been taking over a year on average.  EAD/AP has been taking 6-12 months.

    Read the post carefully before somehow deducting that I am asking this hypothetically. It says RFE is sent on I-485 status. I was just asking for an insight here. Thanks for the attitude.

    So I have an update. I just checked the status of my I485 and it says RFE is sent today. I see no updates on the work permit and the travel document tho.. IDK what I missed to be honest..

    I forgot about the pics. I mentioned there are companies interested in my qualifications, but that did not seem to qualify for biometrics situation. I chatted with one through Emma and that person sent me a list of reasons that would qualify for expedited biometrics appointment. They were like DACA, and nothing related to a job offer.. that was upsetting..

    No news for us either yet... We only received the NOA1s and that's it. Waiting on the biometrics appointment letter.. I asked a USCIS rep if they could just use the previously submitted biometrics but they basically said no.

    Just wanted to add my timeline here too. 

     

    K1, married to USC. Filed AOS with EAD and AP. 

    AOS status: Fingerprint fee received on 3/16

    EAD& AP status: Case was received 2/11

     

    How can I create an account to see if they sent biometrics appointment to me by any chance? I read somewhere that you could see that instead of missing your appointment due to mail delays.. Thanks! 

     

    I just wish they would use the biometrics I already gave them many times at consulates .. Life would be easier on many of us and them too!!

    Yes, basically I did a search right here on VJ on how to expedite. There was a poster who posted his success story and I basically took the same draft of his request letter and made it my own. Of course I included the job proposal letter (very important of course) and explained with everything going on in the world, we are fortunate to even have a job offer especially with no certainty on what this year brings. Also in him being able to get EAD, it will also enable him to get his drivers license here in CA. He can start working Uber in the evenings after work. Lots of opportunity. He will then be a taxpayer as the rest of us are. When we made the request over the phone we had to wait for the email which told us exactly what to fax in. We faxed it and it only took 5 days. I believe that him having a social security may have helped. At least thats my opinion. Good Luck.

    I am not sure if it is about the state but in WI I was able to get my state ID with I-797 .. I asked about the driver's license, thinking that I'll need it eventually, they said that I'd just bring in the same stuff basically.

    Hi. I saw someone in a similar situtation as yours in this forum. What people suggested to them was that he would put the NOA on top of the new application so that they could see it was the USCIS itself that opened the medical.

    When did you file I485 ? I'm trying to understand why they sent it back saying it was old because they did not update that form until at least February this year as I had to use an old version also.

    Is this something to be worried about? Any other I-944 RFE filers run into the same issue? We already replied to the RFE back in August.  What's also interesting is on the same day we received an interview date for our EAD.

    I-944s are being discarded as far as I am concerned because even though I filed that in February, they omitted a receipt for I-944, but all the other forms. So this might be why your case status looks like it did before you sent that RFE about I944. Maybe call the USCIS number for some answers.. good luck

    3/18/21 - Completed biometrics

    3/19/21 - USCIS emailed action on case which basically states USCIS is reviewing his case

     

    My husband received a great job offer and they want to hire him as soon as his AOS is completed. He wants to lessen burden on me and help but also wants to be a taxpayer and start paying into his own social security. IS IT TOO SOON TO REQUEST AN EXPEDITE?  I have heard in this very forum in the past that its risky to request it. How can it harm us? Thanks for feedback. 

    Thanks for asking this question. We have asked for expedition on our case before through our congressman for the K1, but idk if it harmed our case in any way at all. 

    I was wondering if we should do the same for EAD for the same obvious reasons as your husband has. We probably will ask our congressman's help once more because this is taking too long already.. On USCIS' website it shows more than 4 months for EAD..  I just received the text message with our case numbers for AOS and EAD. Once I get the paper NOA1, I will ask for expedition also. 

     

    A question for you: How many pictures did you send with your AOS and EAD package? 

    Would be great if you update here.

    I only sent two pictures of me with three forms (I-485, 765,131)  but it turns out most people sent 6 here.. So I have a feeling that an RFE will happen.

    Just got the check cleared today. It shows as pending in recent account activity. Wanted to share. I am almost absolutely sure that we'll get an RFE, but will update once we get any mail from the USCIS.

    Your card will have a little text on it saying only allowed to work with DHS approval or something like that. That refers to the EAD.

    I did this recently. NO you are not to select 'Legal alien allowed to work'. You need to provide your I-94 which tells your story basically. I also attached a cover letter because they denied my application the first time when I selected legal alien allowed to work. You can also always call your local SS Office. 

    This is how it is done before EAD.

    It says NOA1 can take up to 90 days to receive, as someone shared the link to USCIS website above. Be hopeful as much as you can and maybe send it again once you hit the 90 days. Good luck

    Hi! Ours was delivered on Feb 11. It's been exactly 4 weeks and our check has not been cashed yet. It took some people here 6 weeks for that. It looks like this is the general trend nowadays. Will update as soon as the check gets cleared.

    Here is the case history from My USCIS:
    December 13, 2019 Response To USCIS' Request For Evidence Was Received
    November 4, 2019 We sent a request for initial evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status.
    October 8, 2019 We accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or Adjust Status. Our National Benefits Center location is working on your case.
     
    The last communication that I have received (on 12/13/19) was that they received my response to the RFE.
    BTW, my EAD card was approved last week, after 18 months of waiting.
    I understand that I need to have the interview. The normal processing times for Miami are 14.5 Months to 38.
    After speaking with a tier 1, they gave me the impression that something is off in my case. They scheduled a tier 2 officer to contact me within 72 hours, without me having to ask for it. I was told that they schedule a call back within 72 hours if there is an urgent situation.
     
    What do you guys think?

    Your timeline honestly frightens me right now. I was hoping to get my EAD 4-5 months after filing for AOS. I wish you luck and please keep us updated here as yours is an important example.
