If the hiring is for immigration paperwork or issues, the state doesn't matter, because immigration is Federal law.

If the hiring is (for example) to draft estate documents (Wills, powers of attorney, etc.), it's important to hire a lawyer in your own state, because laws differ between states.

thanks for your answer! yeah it should be fine then, it’s just for an AOS

  2. Hey,

So, I'm currently on a J1 VISA and I am getting married and moving with my future husband in a month. We are now working on paperwork, filling all the forms etc. I have found all of the forms here on VISAJOURNEY. But my question is: when should we actually create an account on the USCIS website? We wanted to do it now but is it too soon since we're not married yet?

    Thanks

Then it's actually kinda weird to have a joint bank account if you're not living together. The reason behind the joint account is to show how you manage your finances together. Salary coming in, rent going out etc.

If you want to use it as proof of financial co-mingling you have to send in actual statements where USCIS can see the money movements and not just a letter showing that you're both on the account.

Edit: just realized April is soon so it's not too weird to start the account now 😁

THANKS FOR THE EDIT lol yeah, we are moving together in 6 weeks so it’s the perfect time to create an account together :)

  4. Hi there,

I am getting married soon on a J1 visa and will file an AOS. When i get married I will take my husband’s family name, and I would also like to change my first name. But my question is: when is the “best” time to change my first name in a AOS process? I’m concerned that changing my first and last name at the same time as I get married make my AOS more complicated. Should I wait until i get my green card to change my first name?

    Thanks for your help!

It is possible to be approved without any shared finances. My husband and I didn’t have any joint accounts before I moved here. Focus on your strong points. For us, the bulk of our best evidence was my 40+ visits here. For others it may be the financial co-mingling. For others it may be the years they have already lived together overseas. If your husband already has an SSN, did he live in the US in the past? Work or student visa or something? Did he live with you? If so, use that evidence as your strong point.

He is american! And i am here on a J1 visa so i have a SSN. We just opened a bank account together! :)

Not sure if this is relevant to you, but if the beneficiary doesn't have a SSN or ITIN, then opening a joint bank account in the US may take some extra time and energy to do. Every bank is different, but just be prepared to be persistent. In our case it took about 2 months of various document requests and lots of phone calls on my part.

    we both have SSN

  7. hey hey,

My husband is about to add me on his lease for 3 months before we move somewhere else. We have 2 options: I can either be added as an occupant OR as a leaseholder (which is a little bit more complicated, especially for 3 months)

Is it making any difference for immigration?

    Thank you!!

  8. Hi there,

I am currently working on paperwork with my husband and i have a question. We are about to open a bank account together since we’re maries now and we want also to use this as a proof of relationship when we send the papers. But i wanted to know: do we have to share ALL of our bank accounts? Will it sound legit for immigration if we don’t share ALL of our money and ALL of our bank accounts? Or is it ok to just open a joined bank account and keep the rest of our money separated?
Is there anything i should know before opening this account?

Thank you so much for your precious help!

You should have answered in the previous thread you created.

I told you there that you have (1) Call the au pair agency (2) Figure out if your J1 has the 2 year residency requirement. (3) You cannot call DOS to cancel a J1. You have to put that in the AOS package. Why would it make matters more difficult?

    Thanks for your answer.

    2) 3) I called the Au Pair agency and they cancelled my DS-2019. 2) No 2 years residency!

so then, my DS-2019 is cancelled. Should I still include it?

  10. Hi,

I am currently an au pair and my J1 visa expires soon and I just got married.

But a few months ago I had applied to extend my J1 visa (which i don’t want to do anymore since I’m married and I can’t work anyway) and I jut got an email stating that the extension was accepted (and that my J1 is extended until the end of the year) so they just sent me a new DS-2019. My question is: i will contact the DEPARTMENT OF STATE to cancel this new DS-2019, but when I fill out the paperwork for my AOS, do I have to put this one in? Since it’s cancelled.

Because I feel like If I put this new DS-2019 in my AOS application, it will only make things look more complicated than they are.

    Thanks for your help!
