    I've been reading forums as well.. in my understanding a lot of people wait a year or longer to receive complete GC but I've seen EAD getting approved within 4-6 months of period. there is possibility that He won't be able to receive it on time but I figured there isn't harm to try. I just didn't want to amend it later and felt like it's so much hassle. His application is actively being reviewed currently as well.

    I have a very quick question and need to get clarification. I've tried to find answer here and there but I was not really clear about this.

     

    my husband has pending AOS and currently waiting for bio appointment. he hasn't received EAD yet.. so no SSN as of now.

     

    I was going to file tax extension and wait until he receives his SSN then file jointly.

     

    but I'm not too clear if I can send extension request with my info only.. should I request his ITIN even if it's a request of extension?

     

    or can I just send it out with my info only and will be okay if I file in future with his SSN?

    Do you happend to know if that 6 months have to be consecutive 6 months?

     

    he was here for 6 months.. but it wasn't consecutive months.

    My husband entered US with B2 visa and we sent AOS application to USCIS including work permit app as well..

     

    we haven't even received a receipt notice from USCIS as of yet and I'm trying to file 2020 tax return.

     

    I couldn't find exact same question so I wanted to ask you guys about this.

     

     

    I understood that since my husband doesn't have SSN or ITIN number. I can file a tax return married but separately.

     

    However, It won't let me file without his SSN or ITIN number. (it won't proceed further from it)

     

    I read IRS and it says that he can only apply for ITIN number if he doesn't qualify for SSN.. but we filed work permit with AOS and I understood as "well.. he is qualified since he applied for AOS.." so we can't apply for ITIN number.. but then, he is technically here with B2 visa which makes him non-resident.. he might not be qualified for SSN at this moment too. (P.S I'm a permanent resident) 

     

    Do you guys think it's okay to apply for ITIN number?

    I also only have something similar to a high school diploma and got it translates by a professional translator. Luckily there was a conversion chart on my diploma already and he added a footnote stating that my diploma equals a preparatory high-school. Apart from that I only wrote a letter with an explanation of the German schooling system... that's it.

    I sent all that stuff back in April, got no RFE and got my Greencard approved at the interview a few days ago. So it must have been enough 🤷🏻‍♀️ hope that helps

     

    I know it has been few months since you commented.. but wanted to ask you where did you get your German diploma translated?

    I'm working on my husband's application (also from Germany) and I was sooo confused with it lol he is even confused how he can explain it. I've watched some videos and I understand Ausbildung but wasn't sure if this needs to be translated or not.

    I own a house with mortgage.. so I won't be able to just add him on it. but like you said, I will ask my bank and see if I can add him or open a joint account :) Thank you for your help !!

    I'm sure a lot of people have asked this questions previously but my search game wasn't strong enough to find one.. so here I am again to ask for advice! 

     

    I'm currently working on documents to apply my husband's green card.. He entered US with B2 visa back in end of August.

     

     

     

    1. Though he has been staying with me since his arrival.  I'm assuming I still need to put his German address as current address and question regarding if we ever lived together would be NONE. is that correct? 

               

    2. I don't believe I will need his travel history but.. I wanted to include it to show them that he has been traveling to US for business and pleasure purposes and departed on time without overstay.. somehow I-94 website. doesn't show his travel history at all. (most recent I-94 is showing thankfully).  is someone else having same issue?

     

    3. Since he never lived in US, we don't have many proof of relationship (though have lots of pictures traveling together, tickets). I recently added him on my insurance plan so he can have the insurance. but wasn't sure if immigration will think this is suspicious to get him the insurance plan. would I be able to submit this as part of proof?

    I always thought since I'm a Permanent resident.. I will have to file I-130 first and wait to be approved.. then go ahead and file I-485. so I'm assuming I was thinking incorrectly.

     

    I would like to ask another questions since you guys seem very knowledgeable! 

     

    What do I need to adjust Permanent resident to US citizen? I've been looking at if there is any info what I need to do but I think I'm missing something! + once I receive receipt of AOS application.. is he good to stay with me?

     

    I've heard that visa waiver is only good for spouse of US citizen.. I'm not sure pending AOS is also sufficient enough for him to stay as spouse of permanent resident.

  10. Hello! I always appreciate kind people here giving me advices in this difficult time. I applied N-400 back in Feb2020 and I just had N-400 interview and wasn't sure how I'm going to proceed with my husband. My husband entered country back in August with B2 visa. It was very difficult to meet him due to pandemic and travel restriction. We decided to get married so that I can visit him and He can visit me as family. I applied N-400 initially so that I can move to Germany and start life with him over there,

     

    but during this visit. I got pregnant.

     

    I have a stable job and it's not feasible for me to wrap everything here and move & find a new doctor etc.. so we decided to stay here and of course I wanted him to stay here with me. my idea was once I become US citizen, I was going to apply AOS for him. I asked USCIS officer how long does it take to get Oath Ceremony and he said I might have to wait 2 months and my husband's 6 months stay will be expired and either he has to go back or apply for extension. I'm not too sure me giving birth in few months will be good reason to apply for extension.. I'm aware of visa waiver for US citzens.. but as I'm not US citizen "YET".. how would that work? if I get a ceremony before his 6 months stay and receive receipt of application from USCIS, is it sufficient enough for him to stay? if you can share any experience or advice I will really appreciate it !
