UPDATE: We received an RFE letter this week asking for a completed form I-693 and a copy of our marriage license. Deadline for submission is August 18th.

    @mrveg

We got a request for the marriage license as well. No request for I-693 though. I dont get why seeing as though we literally sent a marriage license already.

  2. I went to a tax professional and they told me to just wait to get her SSN and just file then. They said the penalty won't apply to me cause I don't owe(been paying as single, would file as MFJ). However, I'd lose what I would have gotten as a refund from her, which is around 3k.

My other option is to just file MFS, then amend it later. With this option, I'd have to file twice and I still lose the credit.

The tax person said because she didnt have a SSN in 2022, that I can't receive anything from my wife? Something like this.

    Is this correct?

    We got the same update.

And this was after we went to see the Civil Surgeon.

In the I-693 medical exam, the doctor said the foreign spouse needed an extra particular vaccine dose not listed in the DS-3025.

We hope this will avoid any future I-693 RFE.

And we plan to submit extra evidence of our marriage as instructed in the courtesy email.

Whether this was a waste of money or time or whatever, we see it as an opportunity to submit more stuff in hopes to get our case moving.😂

We also got the same update on the 7th of April and no RFE yet. We're still just going to wait for an update/RFE unless our congressman can contact them and see otherwise.

  4. I'm from the Atlanta field office as well. I just got this same email with the same thing as OP. This is the official notice we received.

Your Form I-485, Application to Register Permanent Residence or Adjust Status does not include a completed and signed Form I-693, Report of Medical Examination and Vaccination Record.

Please submit a completed Form I-693, Report of Medical Examination and Vaccination Record.

Civil Surgeons and the Form I-693

A USCIS civil surgeon must complete and sign the form, and you must also sign the form. If the civil surgeon refers you to a specialist, the specialist must include his or her medical exam results and complete the proper sections of the Form I-693 before the civil surgeon may sign the form.

Important: Only a designated civil surgeon authorized by USCIS to conduct medical examinations is qualified to complete the Form I-693. The civil surgeon must sign and date the Form I-693. Signatures by a nurse, physician’s assistant, or a doctor not designated as a civil surgeon are not acceptable. You must sign and date the Form I-693 when instructed to do so by the civil surgeon. The original completed Form I-693 must be sealed in a separate envelope by the civil surgeon. The sealed envelope must be returned, unopened, to this office.

A list of designated civil surgeons can be obtained by calling the USCIS Contact Center at 1-800-375-5283, or via the USCIS website at www.uscis.gov and using the MyUSCIS Find a Doctor tool at my.uscis.gov/findadoctor. You will need to provide your zip code or address. If you are hearing impaired, please call the USCIS Contact Center TDD at 1-800-767-1833.

Civil surgeons must use the current edition (07/19/2022) of Form I-693. You can find the current edition of Form I-693 on USCIS’s website at www.uscis.gov. In addition, the civil surgeon must ensure that all parts of Form I-693 were properly completed.

Important: All Forms I-693 signed by civil surgeons on or after October 5, 2022, must use the 07/19/2022 edition of Form I-693. USCIS will not accept the 09/13/2021 version (or any previous editions) if the civil surgeon signed the Form I-693 after October 4, 2022.

Reminder: Effective October 1, 2021, applicants subject to the immigration medical examination must complete the COVID-19 vaccine series before the civil surgeon can complete an immigration medical examination and sign Form I-693. This applies to Form I-693 signed by civil surgeon on or after October 1, 2021.

Additional: If your application is based on your marriage to a United States Citizen (USC) or a Lawful Permanent Resident (LPR), and you or your spouse have not yet submitted evidence of the bona fides of your marriage, you may submit this evidence at this time to accelerate the processing of the decision on your case.

If you wish to submit supplemental documentation, you may do so by bringing the documentation to the Atlanta Field Office. You may drop the documents off on Saturday, April 15, 2023, or Saturday April 22, 2023, from 09:00 am to 01:00 pm. Our address is as follows:

    USCIS Atlanta Field Office

    2150 Parklake Dr. NE

If your application is based on your marriage to a USC or an LPR and you would like to submit evidence of the bona fides of your marriage, please submit that evidence, with a copy of this notice, either:

o   To the field office address above, or,

o   If available, online by uploading the evidence through your USCIS account.

Option 2 is "Married- Filing Separately"...not single.

You summed up the situation pretty well.  I would choose option 2.  When I filed MFS in 2015 & 2016, no software package would allow filing electronically using the "NRA" annotation.  I think that has changed.

    Calling tax expert @Wuozopo

Yes, typo, thanks for the correction. I'm leaning towards option 2 as well for the convenience. Do you know how state taxes work? I've seen people who chose option 1 saying they had to wait ~12 weeks for the ITIN before they were able to file state. What's the process for people who choose option 2?

  6. I've done a ton of research but obviously everyone's situation is slightly different. So, let me summarize and see if I'm right or not. My wife came over to America April 2022 on a K1 visa. We got married and then applied for I-765/I-485. Neither got approved yet. She's been living in America since. I see people saying we have 2 options.

    1. Married filing jointly with a W-7 application.

    2. Married filing single and then amend after she gets her papers to MFJ.

To me, option 1 will get you the better return quicker, if you need the money. It requires more effort though because you'll need to go to the IRS for someone to send your documents (passport).

Option 2 is easier because less paperwork now and filing an amendment will be far easier once you get a SSN. However, you'd lose an exemption so owe more in taxes now.

However, when I look up option 1, the W-7 application says "If you have an application for an SSN pending, don’t file Form W-7. Complete Form W-7 only if the SSA notifies you that you’re ineligible for an SSN." Doesn't that mean anyone currently in AOS can't apply with a W-7? I checked the box to get a SSN when filling out the forms.

If I choose option 2, are there any services that allow me to efile without a SSN/ITIN?

  7. My case was supposed to be the BGT embassy but because my fiance is also the citizen of a different country and the case was still at the NVC, we emailed the NVC with a photo of my fiance's passport and requested they transfer her case there instead and they accepted.  So, we now have our case in a country that is actually moving along more quickly!  We also contacted our house of representative member and they are FAR more responsive than senators, so give that a try if you're trying to transfer.

Do you know if this is also applicable to the SSS islands as well? I am from St. Maarten and I listed Curacao as my embassy but I saw that they do not process the K1 visas. I am not sure if my embassy will be Columbia or Barbados or even Dominican Republic. Is there any way to know for sure where my interview will be held when the time comes? Thanks!

Think youll be in Barbados.  When the USCIS finishes and gives you your NOA2, theyll give your application to the NVC.  The NVC will give you a case number after about a month (call them to get it).  Theyll also tell you where your interview will be.  The case number will be based on the country.  For example, mine is BGT and then some numbers.  BGT stands for Bogota.  Yours will be whatever Barbados's 3 letters are.

Nothing can be done. Only thing they understand is lawsuits unfortunately. I will contact my Congressman to help transfer out of Bogota. My reasoning will be this embassy refuses to open and the limited cases they are processing are not done as specified. Other embassies are processing two months after NOA2. Bogota is getting to two years at this point. There are effectively a non-entity now.

You cant just transfer can you?  You need to be a resident of any nation you want to transfer to?  It is so dumb because there are tons of other countries nearby (Caribbean, other south American) that are processing like normal.  They should shift all of Colombia there if Colombia isnt doing their job.

Has anyone here looked into suing the Bogota embassy regarding K visa delays? They are not following the priority schedule as laid out. K visas are tier two, but business visas are being processed much faster at tier 4.

While our consular sections, where possible, are scheduling some appointments within all four priority tiers every month, the following lists the main categories of immigrant visas in priority order:

    • Tier One: Immediate relative intercountry adoption visas, age-out cases (cases where the applicant will soon no longer qualify due to their age), and certain Special Immigrant Visas (SQ and SI for Afghan and Iraqi nationals working with the U.S. government)

    • Tier Two:  Immediate relative visas; fiancé(e) visas; and returning resident visas

    • Tier Three: Family preference immigrant visas and SE Special Immigrant Visas for certain employees of the U.S. government abroad

    • Tier Four: All other immigrant visas, including employment preference and diversity visas

Many embassies and consulates continue to have a significant backlog of all categories of immigrant visas.  This prioritization plan instructs posts to maximize their limited resources to accommodate as many immediate relative and fiancé(e) cases as possible with a goal of, at a minimum, preventing the backlog from growing in these categories and hopefully reducing it. However, the prioritization plan also instructs posts to schedule and adjudicate some cases in Tier Three and Tier Four each month.  The Department recognizes that visa applicants, particularly those in Tiers Three and Four, will face continued delays.  We further acknowledge that certain programs, including the diversity visa program, operate on a fiscal year basis as required by law.  The Department values the diversity visa program and is making every effort to process as many diversity visa cases as possible, consistent with other priorities, despite the severe operational constraints and backlog resulting from the COVID pandemic.  However, as a result of COVID the number of visas issued in lower-priority preference categories or in such programs as the diversity visa program likely will not approach the statutory ceiling in Fiscal Year 2021.

Yea, that's absurd.  They've done over 4000 tier 4 visas a month.  It shows they have the capacity to finish all the K1 visas in a month if they wanted to.  Is there anyone we can contact?

  11. Hey all, I received my NOA2 July 2nd and I called NVC on August 2nd and they gave me a Case number and invoice number (think invoice number was maybe 9 digits long).  I try typing it into the CEAC site but it just says can't find it.  My case is in the Bogota embassy, which is currently not opened, so basically there's nothing for me to do at this point right?  I can only check the CEAC site once it opens up the and the NVC forwards the case over?

  12. So, I'm American and applying for someone from Curacao.  I'm trying to research where the interview will take place and it seems like it is in Colombia for all 3 ABC islands.  I looked on the website and it said "immigrant" visas will be in Colombia but nothing about nonimmigrant visas.  However, Colombia looks like it is shut down due to Covid right now.  Is there any way to transfer it to another embassy?  Thanks.

Can you please show me where you get this information cause I don’t see things moving anywhere faster than before. My petition is still sitting there since nov 24th with an unbanked check and no receipt.

Check back in pages 4-7 of this exact thread.  Someone posted a method to manually check every USCIS case.  Basically things went dead around Dec 19th.  I don't think a single person received a NOA1 during Dec 19-Jan 19 more or less for I-129F.

However, starting last Friday, there's been dozens.  There's people still a month ahead of you so you probably won't get yours for a little while but from what that one post showed, some late Octobers finally got theres and some Januarys got theirs within a week (I know, this sucks).  So yes, it definitely is moving far faster than it was the past month, which was literally not moving at all.

While I don't know how this user aggregated the data, all case statuses can be queried by anyone here: https://egov.uscis.gov/casestatus/landing.do

For the 2021 fiscal year (which began October 1st 2020), there currently seems to be statuses available between receipt numbers WAC2190000001 through approximately WAC2190023000 although increasing in number by the day. I'm still learning about this stuff myself so would be glad to hear if anyone knows anything about this data that I have missed out, as I still don't quite get the the logic in how receipt numbers are allocated or if there are any others outside of this range.

Did he just manually type in those numbers and check their dates?  Like just guess numbers in order and see when their send in dates were?
