  1. My wife's I-485 and I765 (filed together) was rejected and returned due to a error on one of the forms. That's easy to fix but the I-797C Rejection Notice sent to me with my application also states that "your application package was submitted with a single remittance and one or more of the appication petitions were unacceptable in the package for the reason specified on the related NOA.

    I submitted a check for $1,010 since my understanding is that this amount covers both the appication I-485 and I-765. So was I incorrect in the amount I sent or in sending only one check? Very confused. Any help would be appreciated.

    It said in the I-485 instructions that you may submit one check or money order for both the application and biometric fees, for a total of $1010.00. Well, i guess the main reason for rejection is the error in one of the forms and they can't accept it. If you want to be sure make two separate checks of $930 for I-485 & I-765, and $80 for Biometrics. Both paid to US Department of Homeland security.

  2. I am leaning towards filing the I-130 as a stand alone to Chicago and then once I receive the NOA1 then I will send in the 1-29F to CSC. I am afraid that if I send both petitions together to CSC, they will reject it and send it back to me. I am utterly confused!!

    What's the process of speaking to an immigration officer? Everytime I call USCIS, I get a customer service rep. Is there something special I need to do? Do I just request to be transferred to an immigration officer?

    Thanks Spidergirl, but I had already found those. The question I am really posing is that, why were the petitions returned to me? They should have been forwarded to Chicago Lockbox or CSC.

    I guess they want you to send it to the right Service Center by yourself so that you can track it, because there are cases of packets that were lost before and they don't want to be resposible for that, and since it was sent wrongly, they can't accept it and they can't put it in their records and give you a case number in this case they have no way to track it. So its easier for them to send it back to you.

  5. Im thinking that its Not the Medical issue that got her deported, maybe she brought something that is prohibited or did something wrong. Or maybe she opened the sealed brown envelope. If your medical exam failed, the USEM will not issue you a Visa. As long as you have your Visa , you'll be fine and don't bring anything that is prohibited.

  8. Aloha WOF! I just wanna ask for advice about getting a passport....Well, first off... I wanna get a passport before attending the seminar at CFO....my problem is what am i gonna write in the form asking -->purpose of travel ? Which one should i choose --->Tourist, or Others??? If i write *Others Fiance Visa*then they wont issue me a passport if i cant show them the certificate of seminar from CFO so now what am i gonna choose? I'm so confused now. Should i put tourist?? But thats a lie and the truth is me going to US to get married. What am i gonna do huhuhuhu pls. pls. help me...Anyone out there? Thank you so much in advance!

    Get your passport through a Travel Agency, they will know what to do. You'll have to pay more but it will spare you from worries. Just hire the reputable one, just be careful because there are lots of scammers around. If you want to do the processing by yourself do the right thing and follow the rules, CFO is a requirement whether you like it or not you have to take it.

    I'm the U.S.C. and married my wife last Nov 24th. She has a SS# now and we've changed her last name (awaiting new card now). She came in on a K1 and went through immigration just fine--but they took her package of documents that had her BC + translation. She does have her own int'l passport.

    In the I-485 document I only see that it states: "Attach a copy of the fiancé(e) petition approval notice and the marriage certificate" for K1s (our case).

    We are getting ready to send in her AoS application, and the guides here say we need her birth certificate (and English translation). Is that actually true? To get a certified copy at this point would be particularly difficult and would have to be done by her mom back home.

    Yes, you need to submit her birth certificate just sent a photocopy and bring the original on the interview.

  10. Thought we'd give a short update on our continuing amazing journey. It's been quite a while since our last post. We've been unbelievably busy. Milah Jean is absolutely loving her new life in the heart of the Midwest.

    She's been here now 8 months, having experienced the coming of Spring, the unbearable heat and humidity of summer (she actually says it's hotter here than Leyte...???), and now her first major snowfall just a couple of days ago. She's already built a cute snowman on our deck!!! She still wears her jacket inside the house, even though it's a whole lot warmer than outside (yesterday am was 7 degrees!!!).

    She's adjusting amazingly well, has made many, many new local filipina friends, is very active in church teaching action Bible songs to 1st thru 5th grade kids, hasn't quite learned to drive yet, has access to much of her favorite native foods at local markets, laughs every night at Wowowee on TFC from DirecTV, was blown away by the sunset from the top of Sears Tower in Chicago on a beautiful clear day, traveled by car to Atlanta to meet my grown kids and saw "mountains" for the first time (it's kinda flat here in western Ohio), been introduced to all of my relatives in Illinois, tried turkey and pumpkin pie, will soon be experiencing Christmas away from home for the first time ever and will be absolutely amazed next month at Disneyworld in Florida, I'm sure. Every day is an amazing gift for her...and me.

    There's just so much that she has experienced that boggles my mind. I see everything new again when I imagine what she must be thinking...it overwhelms me often...watching her lovingly decorate the fireplace wreath with lights and ornaments last week, the list is endless...I shake my head in amazement and wonder every day....she is an absolute joy.

    And, there's even bigger news...she's with child now...due July 7...so her world has been upended with a recent round of nausea, but she'll be fine shortly. She's so grateful and thankful for this miracle gift...we've seen the ultrasound already and everything is doing great.

    To all who have followed in our footsteps, best wishes and happiness to you. My life is changed...her life is a living dream....

  11. pls people i made this very specific, its questionable how we still dont have our NOA1, we sent it oct 2 2007, still no mail of NOA1 up to now. i checked some of the similar timelines but none have the same EXACT DATE as mine, id like to check if there are some other applicants who sent their app. on the SAME EXACT DATE and still dont have their NOA1..i find it weird that we dont have it yet..is this normal????? :help:

    No, eventhough she will be finished early at the first day, she needs to go back for the result the next day. Vaccinations are included on the Medical Exam Fee (about PHP 6,235), so better let her get the vaccinations at St. Lukes. Vaccinations on private clinics will cost you about PHP 12,000.

    They really need to verify because there are cases in the Philippines that there are people submitting fake birth certificates, NBI clearance or even passports.

  14. hey just wanna add cuz my police clearance just got expired last november? and since i was 16 until now i still live in the same place or address? should i need to get or renewed my police clearance? or its ok. that i have one although it expired just last nov.?

    A police clearance only needed if you lived in other countries for over 6 months, all you need is NBI Clearance for your interview.

    NBI CLEARANCE: Applicants aged 16 years and older must have a valid Record Clearance for Travel Abroad Purposes from the National Bureau of Investigation (NBI). Clearances should be in the applicant’s current name, birth certificate name, maiden name and any aliases or nicknames ever used, including different spellings of all names ever used. An official letter of explanation from the NBI is required for any notation of “No criminal record”, "No pending criminal case” or “With derogatory record.” NBI is located along Taft Avenue in Manila. For immigration purposes, an NBI clearance is considered valid only for one year from the date it is issued.

    POLICE CERTIFICATES: A police certificate is required from a country in which the applicant lived for more than one year (six months if you are applying for a K visa) after turning 16 years of age. As with NBI clearances, foreign police certificates should be obtained in any maiden names, aliases or nicknames ever used while in the country in question, including different spellings of all names ever used.   15. DS-156 does not keep any data on the website, just close the page, and open a new DS-156 and fill it out correctly.

    All the website does for you is generate a unique bar code on page 3 that contains all data entered on the foem.

    I want to put "After getting Visa Approval"

    And Question 26 and 27 Will "Indefinate" and "To get Married To Fiancee" will these answers be ok.

  17. ok is this what is happening. i just got done reading the link to embassy info for the philippines and it says it takes 93 days from when consulate recieves papers from nvc to get an interview this was as of nov.7. i am just wondering if this is whats happening or if it isnt taking that long. i have been betting on about a month and just trying to figuring when me and my wife will be together and if 90 days is what happening then that stinks i will have missed her b-day and our first wedding aniv. it is totaly bogus to have to miss the holidays with out missing more.

    Thats possible, in my case it took more than 93 days. The Consulate received my papers August 25 and my interview was January 11. I received the Appointment letter and packet 4 around November. That was last year though, i hope they are faster this time, just pray that yours will not take that long. Good luck!

    Me and my husband just got married last Nov. 17, 2007... :yes::dance: We are now preparing to apply for AOS ... what we want to know is regarding of changing my last name to my husband's last name before filing AOS or better to change it after filing AOS because we're thinking that if i change it now it will affect with my papers/documents for AOS...

    You have to change your name on your AOS because whatever name you will use in your AOS application that will appear on your Green Card and it will cost you $300+ to change it later. It will not affect your documents and you have the Marriage certificate to prove that you are allowed to change your name. Goodluck

  19. after the approval, it will then be forwarded to nvc? and then what's next? to embassy and then what? CAn anyone tell me the step by step process? Forgive my ignorance. Is it ok to get a passport and police clearance before having the packet 3? and when will the affidavit of support needed? What is the packet 3 and packet 4?

    After your approval and your documents are forwarded to Manila the benificiary and petitioner will receive :

    1.) a Letter of Receipt and Instruction Sheet on what documents to prepare (They said this not a packet 3 because theres no packet 3 in the Philippines and some people didn't get this)

    2.) Your Appointment letter (for interview and medical) and Packet 4 ( you can download a sample packet here:http://manila.usembassy.gov/wwwh3023.html

    After you receive (1.) using the given case number you can check your interview schedule online at USCIS site:http://203.177.135.10/ivappointment/login.asp

    The affidavit of support are needed on the interview

    And yes you can get your passport anytime and also the NBI clearance

  20. we actually have a problem.. on our I-129f forms we accidently left off her surrname (philippines middle name) and used her 2nd name as her middle name. We didn;t realize until we got our NOA2 for some reason... Her birth certificate shows all 4 names. FIRST FIRST MIDDLE LAST (middle being her mothers maiden name)

    NOA2 shows *FIRST* *2ndFIRST as middle* *LAST* (only 3 names) and yes it was our fault..

    Now we are worried that when she gets her passport it will show her moms maiden name as her middle name instead of the 2nd part of her first name (which we accidently filed as her middle name) if that makes sense...

    should we contact the embassy at some point? or should we wait until she gets her passport first to see what it says? So confusing, and kinda scary.

    Please help us if anyone knows. We just got our NOA2 a few days ago! :help:

    In the Philippines, the Official Middle Name for single women and men are their mothers maiden name, that would appear on every documents issued in the Philippines including Passports. I don't think you will have any problem because when she fill out the Form G325a she put her mothers maiden name in there and i guess the Embassy will understand that. But if you want to be sure call the embassy immediately, you don't have to wait for the passport because im sure they will use her mother's maiden name as her middle name.
