  1. I have to send in my I-864 packet this week, but I screwed up on my 2007 taxes. I filed jointly with the intention of getting a ITN for my wife that has never set foot in the U.S. I wanted to treat her as a non-resident alien, but realized that this is just too much trouble with trying to get the bonifide ID documents that she would have to send me back to get this established so she could get a ID number for my taxes to send in.

    So I was thinking about just sending in my most current taxes for 2008 and just file seperately for myself since she has never been to the US and has absolutely no income at all. Is this the right thing to do? I guess the only other thing to do is to ammend to 2007 return and change it to filing seperately and exlcuding my wife all together until she gets here and establishes a SSN and starts to work.

    I just don't want any delays. It's going on a 1 1/2 years since we have seen each other because of some obstacles along the way. I need to get this done asap since my job is coming to a end in June and mostly likely be on unemployment until I get another job. But with my current taxes, I qualify right now!

    btw, do all taxes have to be certified by the IRS? I am using Turbo Tax and would like to just print them out and sent with my I-864 package.

    Hello visa journy lovers,

    I am asking a questions concerning my father's tax info on our AOS package. He filed jointly with my mother as married on their taxes. Are they going to request for RFE for my mother to fill up any forms since her name is on the tax info? My dad is the sponsor for me to get my wife here. I just don't want to have any delays. Is it ok just to send my dad's tax return info and his W2's or do they also want his tax transcipts as well? Also, will from Nov-the end of March paystubs be enough for the paystub in the the AOS package? I appreciate all your help and God bless!

  3. Sorry sir, but your answers are very abstract. It is not even answering the question that I asked. But that is a shame on me. I guess I will have to just call NVC like i should have in the first place. I thought I made it clear was to add the disability or not. I understand about 2008. This would be the current since there is only 11 days left to file taxes, so I will have to use 2008 as my current income.

    So are you saying to put what is ever on my W2 stub minus the disablitity for my total income? Because what it seems to me is that the disabilty benefits would also count since I was out due to a illness. So this should be added to the W2 stub for the year 2008.

    Please read carefully and interpret literally. That goes for my response and the questions on any affidavit of support. Your 2008 income is not necessarily your current income. What question are you answering? I'm unfamiliar with the income documentation for the "N/A" visa.

    I would state annual income in present tense terms. If your salary is $35K, that's your income. If you're hourly, multiply the gross hourly rate by 2080 and claim that. If directly asked for last year's income, it's $31,000.

  5. I was off 3 months on state disability insurance from 09/08 thru 12/31/08. My base gross income subtracting these months came just under $27,000.00. I had around $4,000 in disabilty claims. This would give me around $31,000.00 for my current gross income. Should I include this in my current income for my i-864 packet?

    I take it also that the disabilty is taxable income. Is this correct? I want to add as much as I can and be as accurate as possible since I don't want any problems.

  6. Hello, I am a confused on the petitioner packet instructions on filling out a i-864. Do i fill out a AOS for each applicant or just one and mail in all the necessary documents for each case in one envelope with the barcode sheet on the front of each case. It sounds like i have to fill out one for my wife and one for her child. Is this correct? The link instructions on the NVC website are something to be said for.

  7. Hello, I just mailed in my AOS processing fee for $70.00. They received it and emailed me back a PETITIONER PACKET, Affidavit of Support (AOS) Processing Fee Bill Invoice for $70.00, and a IV FEE AGENT bill for $400.00. I am confused here. Do they also send a hard copy thru the mail with all the necessary documents for AOS processing or is it all online now? I thought I read that they were going totally online, but I am not sure if that has taken place yet. Also in the IV FEE AGENT bill, they only listed my wife and not her child. Do I just pay the $400.00 that covers them both or is it $400.00 a piece?

  8. Hello everyone. I have just recieved notice thru email that they are sending out my I-864 packet. My concern is that my job is ending in June 2009. I will probably be on unemployment for awhile unless I can pick up another job.

    My taxes are in the poverty guideline for eligibility. But with my job ending, is this going to be a problem? I have read that I have to get a letter head from my employer showing that I am currently employed. Should I just get it now with the date probably being a little lapsed by the time I get the packet together and tax forms to send back? I know that my company won't just leave the dateline blank. It's just too big of a corporation. Is the proof employment mandatory?

  9. I was told by NVC that if I email the ds-3032 to my wife's email address in the philippines. She can fill out the choice of agent and just send it to the NVC from there thru email. Is this right? I think she would get fouled up and do it wrong. Her english is very poor. And just for her to get down to a internet site would be really tough. I would be afraid she would do something wrong.

    So I was thinking if I could just get the ds-3032 form from the NVC website, I could email it myself. I was told that she wouldn't have to sign it but they would go by her email address. But it would be sent from the states. Is this legal to do? Would they check a IP address? I was told by NVC that by doing it this way she wouldn't have to sign it and this would save a lot of time since I am mailing my I-864 tommorow.

    The safer way would be for her to just sign the ds-3032 that they sent to her and have it sent to me so I could send it off.

    any ideas?

  10. Hello everyone, I have been away for awhile due to some health problems. I started my I-130 petition back in 03/2008. But ran into some difficulties due to a ex-wife and having to be in the hospital for 4 months. I really wasn't in a hurry to get this done because I am waiting for a buyout from my job in June of this year. So I will be unemployed unless I find another job by June.

    I am at the I-864 bill phase and am ready to send this in so hopefully I can get this wrapped up by June and I can just go over and meet my wife and bring her back together instead of separately.

    I am really struggling with the economy and my with my job, my ex is getting child support and alimony from me, so it doesn't leave a lot to live on. But with this buyout, this might be the only time for a long time to get my wife to the U.S.

    So, I know that that after I pay the I-864 bill, how much time am I looking at to get this wrapped up? By looking at the time lines, it looks like another 6 to 7 months. From the NVC to the interview dated. Does this sound about right?

    Also, what about my tax forms? Do they need to be from the IRS, or can I use the copies that I printed off Turbo Tax? Do I need to get a letter head from my employer verifying my employment?

    I know it's a lot of questions, but I want to get thing going before my job ends. I qualify for the past 3 years of my employment.

  11. Hello everyone, I haven't been here for around 5 months due to an illness. But now that i have recovered from this, I want to continue to get my wife and her child over here to be with me. But I have to wait until I get a buyout from my job that is coming to a end in June, 09.

    Thanks to everyone's advice on getting my wife over. I talked to her aunt last night and she told me she really wants to get over here with me so I am going to go to next step here real soon and get things rolling.

  12. basing on your timeline you have already been approved few months back, doesn't it have expiration date? If you would take so much longer you will have to start over again. :(

    I'm hearing you on the "tough times" in america. It is indeed tough times for most of us here. I don't really have a sound advice in your case, I would want to say Love will conquer all but when stomach is growling and you would hardly make both ends meet especially with a child in tow, it will be sooo hard. I am keeping you and your wife in my thoughts and prayers. (F)

  13. Hello everyone, I haven't been here for around 5 months due to an illness. But now that i have recovered from this, I want to continue to get my wife and her child over here to be with me. But I have to wait until I get a buyout from my job that is coming to a end in June, 09.

    I am worried about bringing my wife over because of uncertainty of my financial situation. I have enough money to get here over here but I don't know if I am going to be working or in the unemployment line with so many other people that are out of work here.l

    But with this buyout that I am getting from my job, it might be the only time for a long, long time that i would be able to pay for everything that needs to be paid to get my new family here.

    Some people say I should just get her here and things will work out and that Filipinos are resilient and find some way to make it work wherever they are. There are a lot of Filipinos where I live in the S.F. bay area so maybe that would make things easier for here.

    My only other option would be to just take a trip over there after my job ends and spend some time with her and try to bring her over here when things get better. I am just afraid it's going to turn into a big disaster if I don't have enough money to take care of them.

    I miss my wife so much. It's going on two years since i have seen her and she really wants me to get things going here. I know she isn't going to wait forever although she said she would.

  14. I am just wondering if anyone other than myself is trying to get there spouses and kids to the U.S. without any money in there bank account. I live from paycheck to paycheck trying to get by here in this messed up economy. And to be truthful, I really don't know if it's a really good idea to bring them over here without any backup.

    I am in such a financial mess right now with a ex-wife and the IRS, that it scares the hell out of me if I couldn't be able to take care of them. I qualify with my job for support but I will be losing my job next year due to outsourcing. I will be getting a buyout from the company in which I was going to use to get them over here, but I am having a hard enough time of taking care of myself let alone two other people. They might be better off staying where they are until I get it together. It would break her heart though since I know she is really counting on me getting her over here.

    Has anyone else been through this situation and has made it work? I am just curious. I was almost thinking about just forgetting about getting them over here right now until things change for me financially. It looks like most people that just make the poverty guidelines have family to fall back on if something goes wrong. I have known whatsoever that I could depend on if things got really bad. I hate to sound so negative about this but I am just trying to be realistic and not make a huge mistake of getting my loved ones over here and them depending on me to take care of them and I won't be able to. I am have a hard enough time of taking care of myself right now.

    I just don't know if I should just keep the process going and hope that things turn around for me or just put it on hold for now and wait a few years if she wants to wait that long for me.

    I can see from your timeline that your spouse is from the Philipines. You don't mention how old you are, or how many kids are coming over with her. I think you're doing a good job in thinking of their welfare and as Peggy says, being responsible. While you could change the actual visa to a CR-1 so that she could work right away, you'd have to consider how her job prospects look. Is she trained for anything? Is her English good enough to find a job here? Again, depending on how many children you have, daycare might be not affordable, and it may mean she can't work. However, if you can't find a job, and she could, then she could work and you could stay at home with the children.

    It's sad to say that 90% of failed marriages in North America are over finances. Just barely getting by financially yourself is different than exposing your new wife and children to the same. Have you talked about this with her? She's your wife and should be part of this decision making process. I'm sure she would be sad and hurt, but if you both can get together a reasonable plan for some financial security for the future and work towards that, then it might not be that long before she can be with you in the USA.

    Depending on your circumstances, you may want to look at you moving to the Philippines. I know there have been a few members that have left the USA to live there, and have started up their own business.

    Would it be advantageous for you to move to another State to find better reemployment opportunities for yourself before bringing your wife and children over?

    Sorry, again, I don't know your circumstances. I do feel for you however, and hope you both can find a way to talk about this before her getting the visa. I think it woud be a shock to her to think one thing if you weren't honest with her about your financial situation, and to find out that you're getting food from the food bank after she arrives.

    My personal feeling would that it would be a major disaster to bring her here. I just don't have it together to support her. This was was the major cause of my first divorce was over finances. When you have have a spouse that has no job skills it makes it very, very hard. I was in the Roofing industry for the past 30 years but have been run out of the business by fierce competition from other company's. I can't make a living at it anymore. So I myself don't even have any skills. I have to go back to school.

    Moving over there might be optional after I retire, but that isn't for six years from now. I don't know it she wants' to wait that long. I guess I could take trips over there from time to time but I don't think it's very fair to her.

    A lot of of it will depend on what kind of buyout I get next year from a job that is coming to a end due to outsourcing. Most likely I will take a trip over there and get to see her and we can talk about our future.

  16. You have to pay the $70 per case for the AOS Fee Bill. She has to send it to you, because enclosed is the Applicants case number & Barcode which you need to attached upon paying & enclosed also is the return envelope which you will be using.

    I was told by the NVC that I only pay $70.00 once with both files in one envelope. One for my wife and one for here daughter. They both have different case numbers though. Could they be screwed up?

    Maybe fill out the DS 3032 choice of agent and the DS 230 visa application for both her and her daughter?

    If so HAVE her sign them BEFORE she sends them to you.

    That is what I am thinking. I should just have here sign them and send them back to me.
