She can certainly try, it appears her ban is up. The maximum ban would be 10 years. Well assuming there is nothing else in her record.
You have listed quite a few reasons they would say no and no obvious reason they would say yes.
Nothing else on record. No criminal record in Mexico. What would be obvious reasons as to how they could ONLY say yes?
In my opinion, she’d need to show proof she’s been with her boyfriend for 6 years in Mexico. She’d need to show her deed to the home she owns in Mexico and also have a longer time at her current job to show stability at that specific job. Would there be anything else you’d recommend?

Freudian slip?
I think children should get their immigration status sorted and visit her back in Mexico.
Not Freudian slip. I am just trying to think like the consular officers. I’m trying to think of the worst of how they could think. For me, it makes sense why she was denied. Not because she would stay, I know she would not. She has a long term relationship and a job and life in Mexico again but from what I’ve gathered from talking to others… she needs a strong case as to why she would NOT stay and how her entire life is in Mexico. That, in my opinion, was not presented well AT ALL with the lawyers they worked with.
i agree her kids should visit her. Thanks

I am looking for info, specifically Mexican nationals that have been previously denied entry to USA on a B1/B2 visa. I am looking for info for my aunt to see if there is absolutely any hope for her. She received a 10 year ban to re enter USA after overstaying a work visa in 2010. She applied in 2015 and (obviously) was denied due to not completing the 10 years. I think they called it asking for a perdon which was not granted. Both her kids and ex husband still live in USA (for me this is even more reason why they would keep saying no to her). Her kids are on the DACA program, not sure on ex husband. She owns a house in Mexico and has a job (though it’s a new job). I find these to be strong evidence that she would have intent to stay in USA as they also think she is single tho she’s been in a relationship with a man for 6 years in Mexico and they have lived together for 5 years.
Is there any hope for someone like this at all? She was just denied on 214b reasoning (which again I completely would agree on that reasoning based on presentation and previous overstay). She has also not seen her children for 13 years, they have never sought out an advanced parole to come visit her. Can anyone help give me insight if you’ve been in this situation???

Woke up today and checked and husbands case is also approved. No interview. Original filing date 11/18/2021. Now to just wait on the card!
Woohoo! We got "card produced" on November 18! My husband just got another "case update" but not seeing what it is yet -- guessing it's card mailed though!! Yay!

Thank you for your response.
Updated timeline.
I 130 also shows "case approved" 2 days after I 485 approval.
I 485 status changed to "card was produced" 5 days after approval
Then "card was picked up by USPS" 1 day after that. It has tracking number of priority mail anticipated to come in 2 business days.
Hopefully everything is done.
Thank you for ur help.
Thanks for the update! My husband got approved on the 15th so maybe next week we will get the card for our one-year anniversary present!!

For those who got approved this month, how long did it take you to receive your greencard in hand?

I spoke with Ask Emma today regarding my husbands case. Informed me that the case is at the local field office and that the interview is marked as waived.
Is this info usually accurate? So far no update in our online account. I'm assuming it will change soon.
For those who chatted with Emma and were told the same thing, how long did it take before you received an update on your status?
I did the same about a week ago and we just got notification that case was approved!

Hello everyone,
My timeline:
March 29, 2021 - I 130 filed (Nebraska)
April 20, 2021 - case being actively reviewed by USCIS for I 130
July 9, 2021 - I 131, I 765 and I 485 filed
September 27, 2021 - Medical documents submitted to USCIS for I 485
December 7, 2021 - finger peints given
December 8, 2021 - case is being actively reviewed by USCIS for I 485
After 1 year-I 765 AND I 131 approved on june 3, 2021
On june 10, 2022- EAD/ADVANCE PAROLE Combo card received.
Oct 1, 2022 file e request for case outside normal processing time for I 130 as it was now pending for 18 months!!!!
Oct 14, 2022 received an email from USCIS saying basically they are sorry for the delay and there is nothing else i can do except wait.
Oct 28, 2022 suddenly recieved an email on case status change and when i logged in it shows that "case closed" for I 765 AND i 131. This confused me as i already had those applications approved about 5 months ago in june 2022. When i searched on forums i saw that it means nothing. At some point USCIS closes those cases that were approved.
Two days later i.e. today oct 30, 2022- i just check my staus and it shows " case approved" for I 485 and approval notice will be sent.
Funny thing is I didnt get an interview. Also, my I 130 is still showing "case is being actively reviewed by USCIS."
MY Questions to all you wonderful people are:
1. What does this mean? Am i done with this endless wait? Or i will still have to go for interview? Or i will still have to wait for I 130 APPROVAL which shows being actively reviewed?
2. If i am done with everything then how long does it take to get the actual green card?
3. Will i get conditional green card (2 years) or 10 year green card? (Marriage was in May 2020= >2.5 years)
Any guidance will be heavily appreciated. Thank you in advance.
It has been a long long long wait for me of almost 19 months since I 130.
I've seen a lot of approved cases without interview lately in the fb group... If you applied after already being married 2 years, then it will be a 10 year card, I believe. Otherwise... you'll need to apply for the 10 year one after this one is expiring.

Good luck for him. That's fine. However for informational purpose, it's mandatory only for 18-24 year olds though adults over 25 whether new or old can also choose to take this route.
In Texas, they required him to take that course. He called DPS and told him he is over 25 but was told it would be necessary to apply.

Going on 4 months of "actively reviewing" arghhhh

Good thing. So your husband under 25 to take the 6 hr course?
No, he had to do an online course (6 hour course) + exam which replaced his written exam, he is over 25 but it is required for first time DL holders in TX. He'll have his driving test next week!
-
Thank you crazycat and arken! I did find out that he will need to take the drivers test both written and driving test. The written one can be done in advance, by taking a 6 hour course and passing the exam. The drivers test can be done if there is someone there same day, otherwise will need to be scheduled.
-
Hello,
I am wondering if anyone from Texas could answer this. We have received my husband's SSN + EAD and now made an appointment to get his drivers license. He has an international drivers license but will he need to take the paper exam + drivers test on day of his appointment? I am just wondering so he can start studying if so!
Thanks!

Did you have to take the written exam or driving test??

Hi everyone.
I received my EAD card, however it is not the combo card, it says this Not valid for reentry to U.S.
I applied for I-485, I-765 & I-131 together. I-485 says my case is being actively reviewed, I-765 I received my card, but I-131 just says that they received my application.
I filed with a K1 visa.
Has anyone who applied similarly received their EAD without the combo card? Has anyone received the combo card?
Thanks...
Same here! Received EAD a couple weeks ago but I-131 just shows "received."

Hello all! Need some help. We recently filed I-130
and I-485. How long does AOS usually take? Can we apply for EAD while we wait even if he doesn’t have an SSN yet? Sorry I’m quite naive so please be kind!
EAD took 150 days to show "Card being produced" for us!

For what forms? ours says case was received on the I-130
Actively reviewed on the I- 485 this one change after biometrics
Ahh ok so it changed after biometrics? It seems our field office, San Antonio takes awhile to schedule biometrics so maybe that’s why. Also yes, on i-485.

I was looking at the case numbers (about 100) around me and almost all minus about 4 say, "Case is Being Actively Reviewed by USCIS". Ours says "Case was Received and a Receipt Notice was Sent" still... Just curious about anyone on the forum in November AOS experience with these two statuses??

Yes, normally they take 2 weeks to process the application but in case of verification of valid immigration status needed from USCIS it takes more than 4 weeks. I applied in the last week of October 2021 and received in 1st week of December. For me, it took around 6 weeks approx.
In between i called at local SSA office many times and they said it's pending on USCIS end and they can't do anything about it, once verification is done from USCIS they will send SSN via mail.
Thanks, we’re 7 weeks, 8 on Friday since our appointment so hopefully get something in the mail soon!

Has anyone applied for their SSN by going to the SS office? We applied December 3 and have yet to receive the number and have called countless times and they say we are in 'Step 3' of verification process... not sure what we can do... because my husband is going to risk losing his health insurance if we dont get the number in the next 7-10 days!

Ours was on our I-797 Action Paper... We received four pages, 3 receipt pages and a I-797 Notice of Action with information on how to do the online account.

hey... I contacted savecheck customer service, they clearly mentioned that there is nothing called manual verification at DHS. Everything is electronically verified, ideally soon after our documents are submitted documents should be verified. If that doesn't happen, status shows pending and if your savecheck shows "returned to agency" only local ssn can help. But these ssn guys are not knowledgeable, only few are aware of this specific case. I continuously called them and asked about the status, everyone kept on saying pending verification. Finally one agent answered call, initially told pending verification and I told her about savecheck status, she checked something else and told me that my documents are verified and status is cleared. She mentioned I would receive card in a week. Call them , luckily you should get one or reach out to state congressman. They can help you.
This is good to know! We just went yesterday for my husband's SSN and I checked on SAVE and it shows returned to agency... Hoping that means it's cleared for issuance... I really need his SSN to get him on my health insurance before end of year!
Have you ever been approved entry after being denied?
