    lol, I guess I was just over thinking since my lawyer fail to send all the docs to my husband. Pregnant woman is crazy and having unstable thoughts. It takes 10 months for USCIS to approve my case, what the hell, and I called them every day, every time the representative who picks up the phone do not know anything, transfer me to Tier 2 level officer and no one ever pick up the damn phone, never receive scheduled call backs! 

    Do you mind telling me after your first denial, how long did it take to re-apply? and did you go through the appeal step! If they denied my case I will definitely appeal it after our baby is delivered!

    Don't worry. It going to work out! :D My wife first interview visa was deny but we didn't give up. We got a second interview and pass. Now we have 3 sons, 7 yrs old, 4 yrs old and 22 months!!

     

     

  3. I know the feeling, too. We got denial back in 2008 because of lack of bonafide marriage. Our case was sent back to states (USICS). We have to submit more evidences to USICS. USICS approve the case again and sent it back to Guangzhou for a 2nd interview which she passed. Now she is a US citizen and we have 2 sons (3 yrs old and a 6 months old). Do not give up! Good Luck!

  5. She can choose 2 routes :

    1. Petition her Parents and they will be in IR-5 category and it will take more or less a year to get them to the State , then her Parents will get green cards so they can petition the child by theirselves ( doesn't matter either her dad or her mum can petition ) , however , the child will be in F2B category ( He is over 21 ) which seem take long time , more or less 8 years and make sure he will not be married during the process.

    Or

    2. Petition her Parents and also petition her brother , Her parents will still in IR-5 category but her brother will be in F4 category which will take even longer i'd say prolly 13 years. * Note : In this case he can be married.

    He cannot follow to join , means that he can't go along with the parents , hence , you will and should considering applying for student visa for him.

    I don't think parents with green cards can bring their son to the US. I think their have to be a US citizens.

  6. My wife who will be a US Citizen in a couple of month from now want to know if she can apply her brother along with her parents from China. Her brother is currently in school and wonder if that is possible. Is there some rule that allow him to come with her parents at the same time? He is more than 21 years old and still single but still in school in China. Any guidance will be greatly appreciated.

    Yes, your wife can apply for her brother to come to the US, but will be a long time for him to come over. Another option is one of her parent can become a US citizenship (wait for 3 years) and then the parent with the citizenship can apply for his/her son.

    Need some help on next step, a lot has happened in the last 24 hours.

    1) NVC Case Complete

    2) Interview Date in Guangzhou US Embassy has been set (end of Oct)

    3) My case is electronic processing (GZO****)

    I reviewed and understand the documents list my wife needs to bring to the interview

    But can anyone tell me what is the next step? On the phone the lady wasn't very helpful, she just said wait for email. But I have less than 2 months before the interview and have no idea what to do next.

    1) Will the beneficiary receive snail mail package for the interview details, or is everything via email since we signed up for EP

    2) What about the health checkup? I actually went to the clinic/hospital place in china and they said you can't schedule it unless you have the letter from the us embassy (how do i get this letter?)

    3) Anything else I need to do before my wife shows up on the interview date? I read you need to goto some us embassy website to pay additional fees and bring another cover letter to the interview? But the NVC lady said i don't have to do anything?

    Basically I am asking what other things i need to do besides bringing the required docs to the interview?

    You should receive a letter from NVC. It should state where and when is the interview and what to bring to the interview. It is a 4-page letters. NVC email the letter to me and also got it in mail. My wife is bring her parent (IR-5) to the US. I call NVC on Tuesday morning, the 2rd, to check if case was complete. There told me case was complete and wait for the email. Later in the afternoon I receive the letter by email and on Thursday by mail. You should call NVC again.
