    All you have to do is to type "live chat" (or could be "live agent" instead. has to be one of either) as soon as you open up EMMA. Then it will ask you what category and you will have to choose "Green Card". After that, you will be connected to a live agent. Just ask which service location your case is and they will answer. At least this is how I got mine...

     

    Btw, USCIS case tracker does not show anything related to interview on my case. It's still on fingerprint taken.

    Not much of an update but through EMMA, I just learned that my I-485 case is finally in the local field office (no update on appointment though).


    It’s just a matter of how quick (or rather how slow) the Charlotte, NC office is now... :)

    We had both EAD and advance parole approved and sent around 10 days after biometrics for my spouse and our son. Perhaps you can expect same around.

     

    The reason why I am still waiting for my I-131 is because I applied for it separately at a later date but I received my EAD same time with my dependents.

    In other news, today at 12:08AM got an email from USCIS notifying my I-485 case was "Ready to Be Scheduled for An Interview".

    I hope you get your I-131 soon, I am also waiting for mine to be approved.

  6. I received a letter for I-131 yesterday about “biometric reuse”. Application date for my I-131 is on Nov 27, 2020
     

    Here’s what the letter says;

     

    U. S. Citizenship and Immigration Services (USCIS) has received your form and is currently processing your application, petition, or request. This notice informs you that USCIS is able to reuse your previously captured fingerprints and other biometrics. USCIS will run the same security checks and use your biometric data as in the past, however, it is not necessary for you to appear at a USCIS Application Support Center (ASC) for a biometrics appointment. The biometrics fee will not be refunded.
    USCIS is continuing to process your application, petition, or request. USCIS will contact you in writing if any additional information is necessary to resolve your case.
    This notice is not an approval of your pending application, petition, or request.

I was not able to find much information especially for North Carolina state on this subject when I needed it before heading to DMV previously but good news that I had my driver's license renewed today based on only I-797 receipt notice. So, I wanted to put it here for anyone who seeks this information in future...

     

    Here's a summary of my case;

     

    • Arrived US on L1 visa
    • Visa expired 3 months ago
    • My REAL ID driver's license (North Caroline) also expired the same day the visa expired)
    • No EAD or any other visa on hand for 3 months
    • Applied for I-485 (EB3 GC) and I-765 (EAD)
    • Received I-797 C receipt notices for both I-485 and I-765 applications a few days ago
    • DMV in Charlotte area accepted my I-797 C receipt notices (they asked for I-94 as well which was already expired along with L1 visa)
    • Renewed / extended for 6 months starting from the notice date of I-797 receipt notification (Not the date my visa expired)
    • DMV used "Notice date" on the I-797C instead of the "Received Date" to renew/extend for 6 months which is super nice
    • Not sure if I will be receiving a REALID or regular driver's licence but I couldn't care less about receiving it either way..

     

    I hope this sheds some light for those who wonders about this matter. As I mentioned, I was not able to find this information on internet including DMV website of North Carolina.

    There is no such thing as “filing under 245k”. It’s USCIS’ responsibility to determine which policy applies in the case of 245k. Also, you do not file anything additional along with I-485 package to be eligible for 245k.
     

    Once more... noting for future reference so correct information stays in the post. This information is literally in the link I sent you on the post that you quoted. Additionally, I noted about 245k on the last post before  you posted.
     

    I am not here to start an argument or anything like that as that’s the last thing we need here but please stop commenting on things you have no idea of for the sake of quality of the information in the forum. I just asked a question that’s completely unrelated to your discussion and I’d rather talk about the original question from this point on. Thanks.

    Sorry, that’s not correct. As I mentioned in previous post, per INA245k, you are allowed AOS being out of status for less then 180 days in EB related application.

  13. Good afternoon to all,

     

    Immigration attorney of the company that I work for recently filed I-485 package for us as a family.

    Category is EB2 and I have been out of status for more than a month since my work visa is already expired AND visa extension is also denied. Thankfully, I became current in October 2020 Bulletin and we applied for AOS

     

    However, he (attorney) avoided and told me it is not recommended at all for my case to apply for I-131 (advance parole) even though I asked for it but only applied for EAD. So, package that was fully prepared by him (the attorney)  is sent without I-131 already. 

     

    So, I have a few questions based on this situation and I'd be glad if you could share your valuable opinions;

     

    • Any idea why I would not be eligible or not be recommended to apply to I-131? What could be the reason or law behind this?
    • Can I apply to I-131 after receiving application notification (for I-485) for myself and keep it to myself as in, not informing the attorney? I honestly don't feel comfortable with the idea of being stuck until GC finally is approved and we all know how long I-485 step takes overall.
