You have mentioned petitioning for them before and in this thread you admitted they JUST arrived and already have decided to stay and adjust status. So nobody is going to believe there wasn't an intent before arriving in the US. I don't think they can get denied based off of that alone though. 

    My parents lawyer (he ask the same questions of my parents and told us what will happen if USCIS can prove that they were misguided) said that if they had intend to stay before arriving into the country then they misguided an officer in the US embassy as well as at the Point of Entry and its a huge possibility to be denied a green card at the interview and they will go into deportation proceedings at the time of the interview.

  2. Hello all, 

     

    You all have helped me before when I was going through my Removal of Condition and my US Citizenship. After my experience with USCIS and being done, I turned around to AOS of my parents. We have filed all the applications for their AOS back in Feb 2022. Both of my parents received their EDA cards in early August and finally couple days ago they have received RFE for their medical forms. NOA says that USCIS needs their medical forms to make a decision on their case. The lawyers wants to charge my parents $500 + 10% for shipping supplies (they already charged my parents $9000 for both applications [the only reason why they used a lawyer is because they have been in US for 20 years without legal status and they didn't want to mess their case up so thats the reason why they went with a lawyer and paid that kind of a money]) to mail the forms. I think I can do it myself as its only an envelope with the forms insides and as well as RFE notice.

     

    Anyone thinks that I need to add a cover letter to the RFE or just RFE notice and medical forms are enough?

     

    The notice states, "You must either mail the requested information to the address shown below or scan and upload your response using your USCIS online account (if applicable). You must submit the requested information by Feb 9th, 2023, to attention of Officer [NAME] located at [specific floor] Adjustment of Status Unit. 

     

    Also, last Friday they received letters stating that their I-130 has been approved and their lawyer said that this is "Great News". I'm trying to understand why is that a great news, as the letter just establishes a legal relationship between petitioner and the beneficiaries. 

     

    This place always been great to me and there are many people on here who have a lot of knowledge, so thanks for the advice in advance.

    I didn't want to do expedite, I don't care about the wait time as I'm not going anywhere anytime soon.

    Wow. It will be interesting to see your timeline from i751. That was fast.

    How come you think it was fast? I applied for I751 in January of 2020 and end up getting condition removed Feb 2021 (13 months later or so). I also applied for citizenship in January 2021, got my citizenship Dec 2021 (11 months later)

    Do you have an online account? Because you can look up the letter online as i did as soon as my status changed.

    - The actual interview was Dec 6th.

    - Yes, I have received a letter in October that my interview will be in December.

    - Yes, I had an Oath on the same day, 15-20 min after passing my interview. 

    - I received the Naturalization Certificate 2 min after my Oath was taken, USCIS Naturalization Supervisor told us to go get the appointment as soon as possible and apply for the Passport, because the wait time is 8-12 weeks. I applied 2 days later (my choice) and got a date for Dec. 28th to apply for passport as I am using a USPS Passport Center instead of regular USPS office.

     

    I hope all this explains everything properly.

    It then took a logistical miracle to arrange for a helicopter to divert to the oil rig on which he was on to bring him back to Aberdeen very early the next morning (Thursday). From the heliport, he run to the international airport next door  and got on a early morning flight to London then onwards to New Orleans. 
     

    He was back in Aberdeen by Tuesday afternoon after getting his passport expedited and back offshore by Thursday. No rest for the wicked. 
     

    Sorry I don’t have that power anymore to arrange for a helicopter for your wife but thought I’d share the story…

    Amazing story. If this was me in this situation I would move earth in order to make it because I know how USCIS works, but I also understand what has happened to the OPs wife and work schedule. You can only hope and pray that they will reschedule to Jan. 2022, because USCIS is very on part with delaying a lot of things, but with the exception of cashing those checks for all the fees they get. I wish you and your wife goodluck and I really really hope that USCIS will schedule her Oath for Jan. 2022.

    Thank you very much, this is a huge moment for me as well as it is for my family. It just feels amazing to be a US Citizen after almost 20 years and started from being brought here by my parents on a tourist visa, then undocumented, getting married, EAD card (I cried to hard after I got my EAD card because I felt huge weight drop of me), green card, and finally a US Citizen.

    Thanks Sebat4!  Personally, I would rather not change our ID's addresses with the DPS. I've had the same address on my ID for 20 years. I've probably moved 6-7 times and I've never changed it.  It's to a UPS store.  I have my own personal reasons for not wanting to change my ID's address. I get it, with USCIS she's required to tell them where she physically live, which we have done... but it's not the same address as her ID and the list of requirements doesn't ask for an ID.  She mentioned that they might ask for ID when she enters the building. I have told her that her green card should suffice as that is a Federal ID.  You used the abbreviation IO. I am unfamiliar with that term. What is an IO?

Here's a quick explanation how this happens if you live in NJ, as this almost happened to me and this nice lady behind the counter stopped me from registering to vote couple month back (April 2021). When you apply for license or renew and you are at the counter, they will tell you to use the Credit Card pad and say YES or NO to the questions. One of the questions is "Do you want state of NJ to register you to vote..." (also its a long ### statement that most people dont care to read, as I didn't either but the lady told not to hit YES, as I was about to press YES, because this is to register to vote and as a GC its illegal to register for me). This question is right after you answer if you want to be a donor and also another question so some people just press quickly without realizing what the question is asking and people who are working for NJ MVC dont really care to explain what it says on the screen, but just tell you to answer questions. That's the reason why most people register by accident in NJ, so much for that.

  11. My wife had a prior divorce before we got married and I have stated that on the online for as I also uploaded her Divorce Decree to the Evidence. I wasn't ask about it at the interview but I had it with me just incase the IO wanted an original file (I actually had all original files that I have provided for my N400 with me while at the interview, and IO never looked at any of them except his copies that were the printouts of the files I have submitted online).

    USCIS says to wait 3 days before applying so if you send by mail by the time it arrives it will be within the time, online I would wait till Friday this week to apply.

    - I would do onine for this one as its easier to upload all the files and I read few instances before where after 1-2 months the form arrived but the check wasnt cashed, also the application is instantly delivered and in the system (in line to be reviewed) while the paper one needs to arrive and USPS these days loses bunch of mail.

    - USCIS cares more about TAX transcripts as it has your both names and SS# on it and its a proof that was received by IRS and paid in full (or payment plan and that also needs to be proved to IRS)

    I was nervous as hell, but interview went smoothly. The interviewer did go through quite a lot of questions off the N-400 form, but that went fine in spite of my fears. The only documents I was asked to show was my passport.

    I'll need to postpone my oath ceremony until February due to travel plans.

    Before the interview starts your wife should notify the IO that she made some mistakes on her application and ask politely if those could be corrected. Most IO's dont have a problem correcting all the mistakes done on the application. He will ask your wife what was the reason behind saying yes to the tax question and now chaning to NO. I would tell her to just say "due to my husbands medical issues we have filed our taxes late using IRA filing extention and I thought that the question didn't include filing late, but a lawyer explaint to us that it is OK to say NO, because we still filed the taxes on time within the tax filing season". That would be my explanation as this is legal IRS allowed move to file in Oct. as long as you file for extention. I had to explain why we dont have health insurance anymore so yes, they will ask and she needs to know answer, even if you write a letter your wife needs to know how to explain it in the shortest way but on point.

    On another note, I saw her watching videos to study for the test last night and one of the questions was, name 1 of the 3 branches of government. She said, "Congress," and the answer said Congress, the Courts, and the President. In my view that is incorrect. The correct answer should be Legislative, Judicial, or Executive branch.  Technically yes, the video is kind of correct with Congress, Courts, and President, but the answer is really Legistlative, Judicial, or Executive Branch, no?  She doesnt know how to answer that question now if she gets it.

    Drivers license or state issued ID is for the IO to check if its you for sure as this is your everyday ID. It's not on the list of items but I use it everyday to ID myself so I had it with me and he asked about it. You can go online to the DMV website and request address change, submit and you should have a document to print proving that you have changed the address with DMV agency, I did bring that too as we have moved not long ago and it was one of my evidence document. Also, you want to bring the DL/State issued ID because you are supposed to have a proof of you moving too. 

     

    About the video, your wife is correct. Those are acceptable answers, because there are people here who speak english but sometimes they cant think of as I like to say $20 words and they only throw $5 words, that is acceptable and she can say congress because it is legislative branch of the government. People say President instead of Executive as this is allowed, or Courts instead of Judicial, all are allowed. There is one question that asks about 2 things that only US Citizens can do (not exact questions) and the answer is vote or vote in federal election both are acceptable. To prove that it is acceptable answer, you can go to the USCIS website and print USCIS study guide and they have those answere there, even the one that your wife said "congress" as acceptable answer.
