  1. Hello All

     

    I have a question when filing out the form I-751 in page 2, additional information about you item 20.

    I have been deported and waived.  is this something that will count as deteined?  I am not sure if I should say YES or not here.

    I was deported and I had to process waiver which were approved.  I was never in Jail or anything but I am not sure if this counts like any of the specified in the question?

    any suggestions will be very appreacited.

  2. Hello Visajourney friends!

     

    I recieved in April my Green card after adjusting from K1, i was recently offered a Job, and they are telling me I will go trough a background check.

    I was deported before I applied for a K1 Visa, my removal was waived and I have no other issues, but I was wondering if my deportation will show at the background check and if it shows, if you believe this will be a cause of they revoking me the job proposal?

    what do you think should I be worried?

    Thank you Jorge. I understand she was doing her job. I guess I was just surprised that the interview was centered on the transgression but well this is something I brought upon myself. Thank you for your comment... I am glad This processing time is normal. We will wait and see. Guess my case is not that spotless to be approved "on the spot"!

    Hello Visa Journey members.

     

    Yesterday my husband and I attended to my first AOS interview in Oklahoma City office. 

    we showed up with many updated documents, pictures, etc... a big binder!

    The IO was very polite and nice, We were  led to her office in the back and then she asked us to remain standing to swear that all the information we were giving was true.

    After that, the interviewing officer went through the application and asked me to verify my name, date of birth, place of birth, my parent's names, and finally my current address. He asked my husband about his work, and how we met and if we were planning on having kids. 

    My immigration case was not easy, I was deported form the US.  when I met my husband I was on a Turist visa but working without authorization, long story short I ENDED UP deported  when trying to re enter the country ABOUT 5 yrs ago, when they discovered I was working without authorization. SO well because of that I had to be waived before I even got a K1 visa, which I did, it was cumbersome process but my waivers were approved.  well..... the IO showed a lot of interest on this and she asked many things about it, (when I worked wthout authorization in the US, I did it with a fake green card)  and somehow I felt she was trying to make me admit I was claiming to be a citizen back then, which I didnt.... I worked with a fake green card with a made up name...not that I am proud of any of this!  but I didnt work with a citizens card or tried to claim I was one.  so this really made me feel nervous,  because all this was waived a couple of years ago I  didnt think this would be the MAIN subject in the interview. 

     

    She went trought the rest of the application quickly and didnt request any other evidende,  she finally said that everything LOOKED GOOD but she will still have to check some stuff on her side. and that we will get an answer trhough mail. 

    this left me with a bittersweet feeling, she said everything looks fine but DIDNT APROVE US RIGHT THERE, (I have read other experiences where right there they got approved)  my case status still reads "AN INTERVIEW APPOINTMET HAS BEEN SCHEDULED" NOTHING HAS CHANGED SINCE YESTERDAY.   I am worried this means something went wrong somehow.  has someone has a similiar experience where they were not approved right there?  if so how long does it take for the status to update?

    how much longer will it take for my biometrics?? i read that this person got their greencard even without an interview... how is that possible?!!!

    I AM A AOS/K1 FILLER from august 2020. USCIS RECIEVED MY PACKET ON AUGUST 27TH.  I RECIEVED NOAS ON SEPT AND NO RFE AT ALL.... THEN IN FEBRUARY I RECIEVED BIOMETRICS APPOINTMENT FOR FEB 11TH.   MY EAD COMBO CARD WAS RECIEVED ON THE MAIL FEB 27TH.    IM SHARING MY TIMELINE THAT MIGHT BE HELPFUL, THAT RFE COULD HAVE MAYBE DELAYED YOUR PROCESS, HOWEVER ALSO IT DEPENDES ON HOW BUSSY IS YOUR OFFICE.  I THINK YOU PROBABLY WILL RECIEVE NEWS VERY SOON.

  6. So after waiting 44min in the customer service line, I finally got to speak with an agent.

    my name is not hyphenated on the system, but she also told me she didnt know if they could do that, finally she came up with 2 solutions>

     

    1. -TO put a typo request service and I would need to send back the card.
    2. To speak with a higher rank officer so they can tell me if the hyhen proceeds or not on the card.

    I chose B, as I dont want to send the card back if its not needed, and talking with the officer I would have a clarification on the matter.

    so she proceed and then told me it would take up to 14 days to recieve the call!!!!!!!!!!!!!!!!!!  thats outreageous!  

     Like I said before, I really need to travel to Mexico this month, but I dont know what to do....

    ANY ONE WHO CAN GIVE ME SOME CLARITY ON WHAT TO DO NEXT?  any one with a simmilar experience!!???

    well I finally recieved my EAD/ADVANCE PAROLE COMBO CARD last saturday 27th .

    When I got married I changed my last name, I hypenated my mexican lastname with my husbands lastname , so  my name on my Marriage Certificate is  for example Jane  Perez-Doe

    all the applications and evidence sent to USCIS incluiding my marriage license, have my name like that  (Hyphenated) how ever my NOAs arrived with the last name separated PEREZ DOE, no hypen or dash.  when I had my biometrics, I brought this up and they told me that the system didnt allowed HYPHENS/DASH but that my final cards will have it. 

    NOw....I RECIEVED THE COMBO CARD and the last name is still NOT HYPHENATED: JANE PEREZ DOE.  

    this is really concerning me.... I tried calling USCIS CUSTOMER SERVICE NUMBER 1800 375 5283 and there is no WAY I can get an agent to speak to me...the automatic reply system, doesnt allow it. all I could come with is a link for a TYPO CORRECTION on USCIS website.  

     

    NOW... I dont know if I should make the change or not?  if my marriage certificate has it, my COMBO AND GREEN CARDm should be hyphenated as well correct?  I am afraid this will translate in future problems.... with any of my future credit cards, employment, etc.THIS IS all agravated because  I need to travel to Mexico this month and I am afraid that if I make the correction on the website, this will mean I need to wait for the card to be reprinted/changed for who knows how long....and if I take the risk and go to mexico with my combo card as it is....would I have problems re/entering the country?

     

    any one with similar experiences?  I have ready many cases FROM older years here at VJ, but with NO CONCLUSION. any one with a suggestion?  anything could help!

    My AOS PACKET was received on 8/28 and my NOA1(I-797C) for my i-485, i-131 and i-765 arrived to my mail today (tho I received an email and text msg on 9/28)

    the issue is.... my legal name was changed to  Daniela Ayala-Trail  (WITH A HYPHEN) when I got married! and all my forms were sent to USCIS with the hyphenated name.

    I received the NOTICES and my name has no hyphens.... just: Daniela Ayala Trail (SEPARATED WITH A SPACE, NOT HYPHENATED)

    is this something comun with USCIS?  do they print Hyphens on the NOAS or not?  can someone advice?  should I call to USCIS NUMBER or is THIS normal??

  9. Hello Everyone! 

     

    My packet was recieved this MORNING AT USCIS CHICAGO (Attn:FBAS 131 S DEARBORN ST3RD FLOOR) 

    SO... KUDOS to UPS, dlivery was uneventful. I feel much more relaxed, as I wanted the packet to arrive before my visa expired (the 90 days).

    I was RECEIVED BY: MENDOZA.   and also says LEFT AT: MAIL ROOM.... I HOPE THAT IS NORMAL WHEN SENDING THROUGH THIS METHOD !

    state of USPS right now. I think it was a good idea for OP to send with UPS instead.

    great!!!! GOOD TO KNOW.  I experienced something like that on my original submission, it was a USPS second day delivery and it ENDED UP turning into a 5 day delivery!

    UPS was expensive!  but in this case, I needed to try everything to make it arrive on time!  I hope it will.  I will let you know how UPS ends up working!

    USPS service in the Chicago area right now is not in good shape. There's a lot of reports of issues with delays and mail bouncing around before reaching the right place. Normally it's fine, but right now it may be better to use another service IMO.

    As noted, generally UPS and FedEx won't deliver to a PO Box (only certain services that kick back to USPS for the last leg of delivery support this). So you would have to use the other address if sending via those couriers.

    I decided to send it UPS as suggested.  I used the adress 131 South Dearborn and sent it next day air!  hope it makes it tomorrow. 

    thanks for metioning about the new form I-765 I also had the chance to include the most recent one!

    2) No. 1) Date physical received is what matters for the filing date, and 2) Overstay as the spouse of a USC is not  a bar for AOS purposes.

    The main issue is you won' t have evidence of your authorized stay until the NOA1 arrives, in the very rare case that you run into ICE.

     

    3) The same order is fine, with that one page on top. NOTE: A new I-765 form was just released. Make sure you use the new form when refiling. They will not accept the old one.

     

    4) it is a brand new filing. Use the current address for filing the I-485 for the mail service you select.

    I would not suggest sending via UPS/FedEx/DHL to the USPS-only address. Namely, I don't believe they deliver to PO boxes.

    USCIS  IS ACTUALLY ASKING ME TO SEND IT BACK TO THE USPS PO BOX (that were I originally submited to)  SEE:

    I dont know if using another method could possibly mess with the application! I also thisnk USPS takes longer than other services! :(

    I am under a K1 visa, I arrived the USA  june the 2nd, got married in June 30 and sent my AOS packet on August 10 th! now....My AOS packet got rejected, I received it today, a couple hours ago actually... 

    INCREDIBLY.... I FORGOT TO SIGN THE MAIN APPLICATION!!!!  I PUT TOO MUCH CARE in other details but forgot the most important! 

    Questions

    1. There is also a part of my rejection Notice (attached) that reads  "Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed at the bottom of this notice."Then there's a list of documents that may be provided, which include I-130, I-140, I-360 or an I-797 if one of those or an I-526 has already been filed or approved . i AM A K1 VISA HOLDER AND SUBMITTED MY NOA1 and NOA 2. so I am not sure if they are requiring something here! can someone help?

     

    2. my  Visa K1 visa time expires this sunday the 30th! * the 90 days!  so Im sending the packet AGAIN tomorrow at first hour so it can be received on Friday 28th!  if it gets received before the 30th do you think I will face any problems date related????  im so scared!!!

     

    3. the packet came back with forms and supporting docs stappled& grouped in a logic that I cannot understand, but I guess USCIS does and with printed codes/numbers in the bottom of all pages.  I have been reading in different posts that I can resubmit (in this case I will be just signing the form I-485)  without reassembling it as the original submision but instead I can just send it as it is stapled. (I just need to place the green page on top) what do you recommend?  someone with a simmilar experience?

     

    4. I sent the original submission via USPS, and USCIS is asking me to re send the new submission to the same Address, I was wondering if I can Use UPS or FEDEX to send the packet as URGENT to the USPS ADDRESS!  or should I stick with sending it via USPS?? I just want to make sure it arrives on time to the POBOX!

You sent it within 90 days of arriving. Also, in the letter apparently they did receive my packet within a week of it being delivered but they just didn't get around to putting it in the system. From my understanding as long as they acknowledge that they got it, you're good. Good luck!
