    I got the following response today, they say “Our records do not show that we received your petition.”

    When I checked NVC processing timeframe it says “Current case creation time frame: As of 26-OCT-2020, we are working on cases that were received from USCIS on 19-OCT-2020.”

     

    According to this looks like I should just wait for an update from NVC as they are still creating application cases for 19th. 
     

    Any other thoughts or advise at this stage !?

    I had emailed them to update our email addresses as well and got the same response. It essentially means NVC hasn't received your case from USCIS.

    I also tried calling them on Monday, and they said: we haven't received your case 'maam' lol. 

    My NOA2 was October 5. Will try calling in 2 weeks. Though they state that it will take at least 6 weeks now.

    Benefit requestors may request USCIS to expedite the adjudication of their applications or petitions. The decision to grant or deny an expedite request is within the sole discretion of USCIS.  

    I am curious what you mean by point 2: 'NVC they expedite K-1 visas already' 

  3. so, once your case has been forwarded from USCIS to NVC (before covid hit, it would have typically took 1 month for your case to get to NVC).

     

    Then you could call NVC and ask them to update your email addresses and give you a case number to fill out DS160. 

    After that NVC forwards your application to your consulate to schedule a medical and interview. However, due to COVID, there is a huge huge waitlist for interviews.

    For example, in Canada, they are just starting to reschedule k1 interviews that have been canceled in March/April. 

     

    If its been 4 weeks, I would give NVC a call to see if your case is there (for your peace of mind), or you can wait if its been less than 4 weeks. 

     

    Hope that helps! I am also waiting for case to be forwarded to NVC. And will wait another week before giving them a call.

    If we get it yesterday it will be 3 months past the  first VJ forcast date.  But I worry it easily could be 9 months more to K1 after NOA2 ,rather than the old.4-5 months after Noa2.

    I really could use some good 3 new.

    ITs great so see a few March folks getting NOA2's 

    The NOA1 date is the Notice of Action date not the received app date. Also, I was using the casetracker app to see my application relative to those with a similar time frame as me. Although a double edged sword; may drive you crazy if you're checking it daily. Your NOA2 will be here sooner than you know! Sending you good vibes 

  5. Thanks for sharing with us your experience! I am a little worried about my vaccination records. I got my records from my province, but not sure if they are up to date etc. How do they go about that - the vaccines and boosters being up to date? or how did you go about that?

    This is the response I got back from the consulate: 

     

    "You do not have to apply for a Consular Report of Birth Abroad (CRBA), but it is a handy document to have as it replaces a U.S. birth certificate.  In order to get a SSN for baby, SSA will often ask for the document.  Most families will apply for the CRBA and the U.S. passport at the same time.  However, both the CRBA and the passport have to be applied for in person."

  7. Then THIS?! was also posted under all that. What gives? So I can just skip the CRBA and apply for the Passport!?

     

    (Note: It is not necessary to obtain a CRBA. If it is more convenient, you may apply for a passport in lieu of a CRBA. In Canada, please consult the Apply for a Passport section of this website.   8. Hi everyone! Was wondering if anyone had insight into this matter. 

     

    Consulate website recommends that CRBA be filed right after birth of baby. However, it also says that they have until baby is 18 years old to file. 

     

    I don't really want to be flying with a new baby during this time to an interview across the country. Would like to wait out the pandemic a little longer.

     

    Thoughts? Pros and cons for filing immediately after birth or when the baby is a little older?

    Income per pay period x number of pay periods in one year= annual income

    Weekly income x 52= Annual income

    Monthly income x 12= Annual income

    If he knows that his pay will increase within a year, he can include the increased amount if he has documentation to verify that (such as a contract, etc).

    Do you think that we need to also provide his previous year tax return despite him not having an income? 

  10. Just a house keeping day today. 

     

    The fiance has not been employed for the past 2 years as he has been in school. However, has since started working this June 2020. And makes well over the poverty amount. 

     

    My question is: What documentation is sufficient to prove that he can support me? Or would it be more indicated to have a joint sponsor fill out the I-134?

     

    I've read mixed things about this. Anyone have a similar predicament?

    The issue will arise when you file for AOS.

    You will receive an RFE and then you can request for a vaccination waiver due to religious belief or moral conviction, which will be granted at the immigration officer's discretion.

    So when I go get the medical done, I can tell the civil surgeon that I decline the vaccines and will deal with it later?

    That is sufficient for getting my petition approved at the consulate?

     

     

  12. Hi everyone! Hope you're all keeping sane during this crazy time in our lives. 

     

    I have not received NOA2 yet; I am just trying to gather the documents I need for the interview as things are closed and things are taking longer than usual to process. 

     

    Regarding the vaccines for the K1 visa - there are a couple of them that I do not have; please refrain from starting a moral debate. 

     

    Would a note from my family physician be sufficient to be a waiver for exemption?

    Theyre probably looking at the p3 list that is provided for us, but not the official p3 list that montreal sends you personally (which I hope theyre waiting for)

    No! I haven't received my NOA2 yet, and yes, it's not the official p3 list Montreal has provided. Just the list that is provided on the Montreal consulate right now.

    'So, my fiance (petitioner) just finished his graduate degree in which he has not working for the past two years. However, he just got a job and satisfies the 125% above HHS poverty line. 

     

    My question is: Should we have him submit documentation for his current work to show that he meets the minimal income or should we use a joint sponsor as he has not had income for the past 2 years.

    Has he been living in the US? If so, I doubt they would be questioning domicile. Montreal is very strict with domicile, but even then it's typically it's only an issue when they have been living abroad for some time.

    Great to know. Yeah, he has been in the US the whole time, just in different states every couple months.

    Also, we need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. When we look at the left column and can't determine your timeline OR your Embassy it's hard for us to give you a factual answer. Our answers will sometimes be tailored to a specific Embassy hence the reason for you to complete your profile. If you look at the profile of others here, they have a flag for their country, so it makes it easy for us to reply as we can quickly determine their Embassy. The country that should be used is the country where the interview will take place.

  18. Hi all, just at the beginning stages of this P3 package. 2 questions for you all :) 

     

    1. What is used for providing evidence for domicile in the US?

    2. The petitioner has a different mailing address than what the USCIS has on file - as he has been moving around doing clinical rotations in the country. Is this a problem?

    Q-6 If you can get a copy and present it at the medical exam it makes things a little easier on your wallet, your arm and the Doctor.

    Q-7 DS-3025, Vaccination Documentation Worksheet will be included in your packet that you will receive with your visa. It's what is referred to as the "Do Not Open" packet that will be given to immigration once you arrive at your POE here in the states.

     

    Being a student of the PDF, you missed the most important item and that where you can get a copy of the P3.

     

    Thanks for your response! I've gotten a chance to read over the PDF now; I am the beneficiary. 

     

    So, I will fill in the details as I go through the steps. However, if I can break it down into broad steps that would help me see the bigger picture of what is going on. 

     

    1. After we receive the NOA2 approval, USCIS sends my application to NVC

    2. The NVC will then produce a case number.

    3. The NVC will then send my application to the Consulate (Montreal for me).

    4. The consulate, will then send me INSTRUCTIONS for the P3. Of which, the first step is to complete the DS-160 and then sign and date the P3 checklist.

    5. Email the confirmation receipt for DS160 and completed checklist to the Consulate. [The documents indicated on the P3 will then be brought to the interview when time comes?]

    6. After that, the Consulate will send the beneficiary P4 on how to schedule for medical and interview.

     

    Is there anything I am missing in this process? 

     

    In the meantime,

     

    I will start prepping the documents needed for my P3 and Affadavit.
