  1. Dennis, I am sorry you are so confused and worried about the situation you are in.

    As said in a previous post, your wife will have a conditional card if her card was applied for before the 2 year anniversary of your marriage. This would been in Oct 2007, so if she arrived in Feb that year I imagine you would have applied before 7 months had elapsed and you yourself would have had forms to sign, do you have copies of them so that you can check?

    Your wife may not be aware that the card is conditional on your marriage being confirmed after 2 years. There is another application needed that you would need to file jointly, for her to remain here legally if her card gives her "conditional" residence. I know the legalities may have been overlooked as the rules can be very difficult even for those with English as their 1st language to get their heads around.

    There's nothing that says one must stay in the marriage just because one has a green card. So the mere fact that she's left doesn't tell us much of anything.

    What we'd need to know is two things: whether her permanent residency is conditional (it's not clear when you married, or if she'll need to remove conditions), and whether you suspect that the marriage was entered into primarily for immigration benefit.

    We married in China Oct. 17th 2005. She came to the US in FEb. 2007. We lived happily together for eight months, until she got the green card. At that time she went back to China for three months. Returned to US Feb. 14th this year and one week after returning said she was leaving to go to work in California. Left on the 28th. I paid airfare. She said before leaving that she loved me and did not want a divorce. She has never been affectionate to me. I just feel I was used to get here and get legal and then bye, bye! She has permanent residency for ten years. I don't know if she has to remove conditions as I never got to see the card or letter with it. I did see the notice they sent before mailing it and it said nothing about removing conditions. Thank you for your input!

  2. The I 751 I sent to Texas on the 10th March must have got there, the cheque/ck was cashed on the 14th. No return receipt yet though.

    I am going to use the waiting time getting my head round the naturalization procedure, I am led to believe it may be a while before Texas gets through the backlog.

    I will be watching for you Angela, and Densusan, I dont mind waiting this time, just as long as I get my flight back to Briz in May!

    wow we got our noa for removal of conditions today and the check was cashed yesterday so now comes the waiting

  3. Hi Angela and all you other luscious Aussies, just a quick note

    Aussies living overseas can get on the overseas electoral roll and still choose to vote,

    they dont get fined if they fail to vote but they may be removed from the roll for the next election.

    Many choose to get a postal ballot if they live too far from a consulate, and if you dont enrol as an overseas voter before 3 years has passed you wont be eligible.

    Hope this helps, but if you want to return to Australia to live it may be more important to you.

    or you can fax it to the Embassy on +1 202 797 3331, if you havent enrolled to vote while you are overseas, you need to apply before 3 years have elapsed, the forms are on the AEC site to complete and then you have to mail them downunder. There is a enrollment checking thing on the site so if you are still enrolled at your old addy, you should be right for a postal vote.

  5. Good luck Kath, I m sure u will do fine on the licence. What a horrible experience after work, good job Robbie came looking, I bet you were pleased to see him.

    Congrats on all the marriages, the pics look wonderful and have given me some ideas for when we get back to Oz and do it all again for the family over there.

    Uscis gets you, after a while, I took some time off after my Greencard arrived, but now I am preparing the paperwork that I will need in March to lift conditions. Just gathering and getting ideas, not actually organising it yet. I wonder if they are as exact about how it needs to be filed as they were in Sydney.

    thanks for the well wishes...will tell ya, all kinds of thoughts were going through my mind that night..like hell in oz they take your name and number if your ringing a cab..and its such a long walk home lol i know its only 2.4 miles but damm that a long walk at night ...lol..

    jess have you looked in the phone book to see if there are any others that do the same thing.. or ring hubs insurance to see if they have any contacts for that course...wonder if one of the colleges have night classes for that too...have you asked about the reprocical (cant remember how to spell it) thing i was talking about where you can just take the learner's test and then later on take the driving test...also ring them to find out what is asked of you to do in the actual driving test im sure they will let you know..

    tomorrow i go for my test 11am gawd i hope i get the other fella this time round he is the nice one ..lol..

  7. Hi guys, you certainly are some busy writers, I get so busy reading, I dont have time to reply but congratulations to all of you who have moved on in your visa journey.

    My latest news, is that finally I went and got my Florida Drivers licence. They issued it for the full 6 years, where I was afraid it would only be valid until my conditional greencard's expiry date. So now I can drive around without worrying about getting pulled over. It was so easy compared to my last one sooo many years ago in Brisbane. No parallel park or emergency stop, of course no hillstart and we didnt go out of the car park, so I was very chuffed.

    I still cant get into my timeline, I have contacted the admin people 3 times, and dont know what else to do.

    Anyway, keep your chins up all of you

    I dont think your alone with the nerves about an interview...you have done you part in the journey now its all up to the aussie and with it being out of your hands it can be a bit nerve racking thinking .. have they got it together ..lol

    i just want to reiterate to those that have gone for or going for their medicals plz ask for a copy of the medical for your own records .. the vaccination sheet is needed for the AOS for K1 and K3 journey's...also remember you can get blood tests done by your local doctor to determine what you are ammune to and put on medicare..but make sure you have a letter from the doctor stating the results to take to the medical...i have read quite a few aussie posts where they didnt get a copy and have to either get it done again over here or ring oz to get a copy sent over...

    loke loke loke sighhhhhhhhhh lol.. i will have you know i got my licence in 1978 in oz and i didnt have one accident or ticket lol...so your safe mate...with saying that robert always sez to me .. its not your driving im worried about its the other idiots on the road lol..so your safe mate...my test is on the 31st...went there on the weekend to have a look at the area and see what this maneuverability test is all about.. looks more confusing on the car park than in the book lol...i dont know if this thing is for every state but ohio has to do it.. they dont even do a parellel parking test..lol...

    well robbie's first day back to work today...sighhhhhhh... then middle of this week am ringing k-mart to see when i am going to start work...

    p.s. jonathon..make sure you have things like bank statements leases a letter from your employer stating what date your expected back to work...your itenary...anything that shows you have ties to australia to help at your POE on your visit to the states...which state you coming over to?

  8. Hav you considered DCF in Australia, last I heard visitors could.

    Direct consular filing is possible in Australia, however that wasn't the best for us given our circumstances. We did consider several routes to take once we decided to marry and the K1 was the best for us. And the thought of starting something over from the beginning...well just can't seem to fathom it. Plus, we would need to marry first, is my understanding.

    Has it been ok'ed again, I know there was a hold on it a while back, so it will be better to call and verify if you do decide to marry 1st

    Hi Kath thanks for the welcome. I arrived in Florida on a K1 in April 2005, so I now dont have to deal with USCIS except to file an AR11 (change of address) until the lifting of conditions which wont be until March 2008.

    I am a Queenslander (Gold Coast) so not a huge difference from 1 climate to the other. I have no problems driving here, I can head off down the freeway with no drama's and when we went back to Qld last month, I found it reasonably easy to switch back, so the only thing left is to go for the Florida license.

    I can see you are a great help to the Aussies waiting for their paperwork, it's great to have a shoulder while the paperwork and the waiting apart seems so daunting, so well done!

    i know the feeling about struggling with bureaucracy, I immigrated to Oz many years ago. Now after our journey to get me to the US we have to decide on the timing to do the reverse for De-jay.

    I know how you feel about the grandbaby's, my 1st grandaughter was born just after Christmas, after 4 grandsons!

    I am hoping to pick others brains about spouse visa's for Oz, but good luck with your reverse, its all difficult, this changing the country where you live

    I will be going to Denver too! It's my hometown, but Melbourne has been home for just over the past three years. My hubby and I were married at the registry in Melbourne and just recently had our 3rd anniversary. I went through so much paperwork to get my permanent residency here in asutralia and the thought of going through it in reverse to get to Denver is quite intimidating. But with my father's declining health and my mother needing me closer, it looks like I really don't have much choice. I so hate the fact that they have done away with the DCF!
