Hi all - new to the forum.

I have a bit of a unique situation...I couldn't find any posts with something like this.

I am an American citizen, and my fiancee is a Brazilian national currently residing in the United Kingdom.

But, she has been there longer than the 6 month allotted time. She is staying with her parents (who have been there even longer), but her father is awaiting his Italian passport. Once he receives it (which could take a long time), she will be able to apply as a dependent, and receive a visa to extend her legality in the country.

I have been researching K-1 and K-3 visas for a few months now (we got engaged in December), and I have a basic idea of how they work.

To my understanding, if she is not legal in the UK, then we cannot get married there. But, if she travels to a different country in the European Union, then she will be able to stay there for 6 months legally, and then we can get married.

She would rather not have to travel back to Brazil, and I agree, since I would have to get a visa just to get over there.

Does overstaying her visa in the UK hurt our chances of getting a K-1 or K-3?

If we get married anywhere in the EU, does she still have to return to Brazil to get the visa?

If anyone can give me any advice, I would really appreciate it...

I really was hoping I could be with her by the end of this year.

If she leaves, will she then be able to reenter? I think this is a question that needs to be resolved.

me too, and today I heard I am approved for my 10 year greencard, only a few more hurdles and we can go home. I thought homesickness would get better after a few years, so far not, does it ever?

Nothing had changed since biometrics in April last year, I had started to check daily about a week ago and this was the first touch.

I was reading about Melrose Plant getting email in the middle of the night, so went to do my daily check of USCIS and there instead of 2008 is a 02/05/2009. I could hardly believe i had been touched, so I opened the page and there looking back at me is the message

Hubby checked his email this morning and there was notice that his 10 year Green Card had been ordered! and we were getting worried since we hadn't heard anything since we sent in more info for our RFE!!

I am so excited!!!!!!!!!!!!! Just checked my email and there it was "On January 29th.,, 2009, we ordered production of your new card."

This means it took a few days over 11 months. I have been checking my status online everyday lately and I had no touches since 16th., March 2008 until today where my status has also changed.

Goodluck to everyone still waiting.........hope it will be very soon for all of you. I am glad this journey is finally over!!!! I will not be filing for naturalization because in the next few years we plan on a move back to Australia.

I am active on several sites and a lawyer posted he got a memo from AILA yesterday. AILA is American Immigration Lawyer's Association. The memo can only be read by members but this gentleman was gracious enough to post the following information.

Here is the information and hopefully it means that some of us stuck at VCS from 2007 and early 2008 will have our cards shortly.

the most important thing I learned was how I needed to go over and over everything dotting the I's as it were.

When I went to the *interview* (which is like a bank counter, not in an office like i imagined) it was noticed that in the 2 full packs of documents that I tended 1 page that was meant to be an original with the dr's siggy was in fact a copy. Even though I had the original Dr's siggy on the sheet in my sons application the copy in mine meant I had to get that 1 sheet (the original) which meant I didnt get my visa the same day.

So now, every application we put together, we double check, then do it all over again. We make a copy of the whole submission in case its lost in the post, and I can see how I made the initial mistake but it cost me, so now I am even more careful!!

so my advice for what it is worth, is check, check and double check, but you will be right...

good luck and dont forget to save EVERYthing relevant to your relationship, cos you need all the paperwork again when you apply to adjust status (AOS) then again when you lift the condition to replace the 2 year card with a 10 year one

Mara, thanks so much for your reply, and i send you big hugs as i know how hard it is to be separated, just putting the paperwork together has been stressfull, as i am still not sure i have enough to send, we have been supported by wonderful friends and family who have taken the time to get Affidavits and Stat Dec's done and witnessed, copies of photographs, phone bills, emails and airline stubs and receipts while traveling, filled in all the forms that we have gone over 10 times that we can remember as we prepared all those while Leonard was here, then waited on friends and family to get their witnessed documents to us.. I have followed the guidelines from this website and just hope and pray, that because we have known each other for so long ( and not like the chap who posted he was marrying one woman submitted K-1 then broke up during submission, "allegedly" fell in love with somebody else and wanted to use the original K-1 to be with the second woman all within a six months time span, im sorry but that made me laugh lol) and that we have spent time with each other, getting to know families and friends on both sides, experienced time in both countries first before deciding which way to go, that we will have no trouble, now we are getting close to submitting its kinda frightning to know that someone has your whole life in their hands, just reading what we send in..

Is it worthwile including a statement from myself explaining my financial Status, ie property, superannuation funds? I havent seen anywhere that says that is required, i just thought it may help?

I sure hope you get a reply and soon, but think of it this way, January is nearly OVER and in February it will be SIX MONTHS so you must be due a reply soon, will keep an eye out to hear how it goes.. so please keep in touch and thanks again for your reply..will be keeping You and Chris in my thoughts and prayers for a quick response.

My case seems to have been approved! We got a message through email:

Today Jan 14 it was touched again with the same status information. Hopefully the card is on the way!

Just to share this with you. I believe someone who has similar time frame should receive their approval soon too. Ours is VSC.

Hi Shane, although it was a while ago, I went to an "interview" at Sydney, the pictures were not even an issue. the interview is at an open window much like seeing a bank teller. The questions were not that probing just basic where did we meet, when did we see each other last and they asked my son (16) what he thought about going to the US, Not quite what I had imagined and nothing like a job interview. I think in the aussie thread you will find some more recent experiences. hope it eases your mind a little

We're currently waiting for my fiance to get her papers in the mail from consulate and are in the process of putting together documentation for proof of ongoing relationship.

Originally with the petition we were only able to submit about 6 photos of us together due to losing a digital camera, which we explained the documentation.

We've only got about another additional 10 photos of us together from my trip to see her again about 2 months ago. Is this going to look bad at the interview, only having around 15 photos together?

I've seen many others talk about how they brought 50-100 photos to the interview. Consulate is Australia btw, so im not sure if thats due to stricter screening at certain consulates?

Does anyone know if an Australian would need a visa from the American Consulate in Sydney if they had relinquished permanent residency but later wished to spend a month with their USC in the USA visiting family?

Would a visa waiver is still be an option? Obviously a return ticket would be purchased but if retired, I am not sure how one would prove ties to Australia.

could you each write your will? send copies of both your drivers licenses if they have same address, or any other credit cards etc. (I sent copies of both our shopping club cards)

just wondering if you have your tickets, or a lease from oz... do you have phone calls to one another, or phone bills showing both your phones. Did you send the back and front of the green card?

I would send the papers from your pets, and if you have vets bills here, are they in your name?

Hello all

Today my husband and I received a request for more information to show communal living. We have received our NOA1 and my husband has had his biometrics appointment. We are racking our brains as to what else to send them. Hubby has been in the USA since 06' (we were married in April 06) – however I have owned the home we live in since 2002, and all bills were already in my name. We didn't add him to any of these things, which looking back at now obviously we should have. However, as you can see in the list of evidence that we sent in below we have joint bank, car insurance, health insurance etc.

It is just so frustrating, I guess they probably aren't to happy with the fact I didn't change my maiden name or that we don't have children!

Joint Car Insurance 2006 – 2008

Joint Tax forms 2006 – 2008

Joint ING Statement (investments) 2006 – 2008

We did some home renovations right away and we are thinking of receipts that show he spent money on the home.

We shipped our pets from Australia to here in the USA maybe we could send those invoices?

A letter explaining in more detail that I owned our home prior to our marriage, I stated this in the cover letter with items we already sent.

On our case most people would assume our language skills are very similar, me having learnt only English as my first (and embarassingly only) language in an overseas country and my USC who speaks what he thinks is English. This isn't so, we have daily interactions where more explanation is necessary due to the many slang and colloquialisms that Aussies use. I often have to explain why I have used a specific word, and my USC is well educated not "thick"  at all. 

We often have a lot of fun with our respective arguments about each others "correctness". 

As for being teachers and patient, perhaps the experience of standing in anothers shoes will really allow you to see it from a different perspective. Often in my travels I have noticed friends who have learnt English as a second language often seem more precise.

Once you are together, facial and other gestures will add to your repertoire of understanding one another, so it wont be as difficult as others have mentioned before me.

Hi Dave I can appreciate exactly what you are saying and hope you and your wife can discuss the options you have,  you could both live in a few different countries, and maybe both be happier. It isnt much fun when you see so many things that are disagreeable, here.

Christmas is particulary poignant time of year and I find it one of the most difficult to deal with being away from home. Perhaps in the New Year you may feel more positive.

Although like you I cant make my forever, permanent home here, culturally I find it so so different. Luckily for me, our plans include returning to Australia as soon as its is feasible.

Merry Christmas and a happy New Year, and have a happy holiday with seasons greetings for those who dont celebrate.

For me I think I have reached the stage where I don't really care anymore if I get approved or not. I love my wife but the longer I remain in the US the more I find myself wishing I was back in Europe. The obsession with the dollar and the disposable way people are treated here increasingly sickens me. I have a good job, have no problem driving on the right and have a wonderful family but I just can't adapt, mentally, to the culture here. I think Linda may want to try Europe but if she doesn't then I have some serious thinking to do.

Hi, if you read the faq's and guidelines at the top of the page, you will get a lot of information to help with the choices you have. I may be misinterpreting, but if you intend to apply for a k1 then your "fiancee" needs to be single on entry to the USA. If you have married by then the K1 visa will no longer be applicable. The dates will become important when your SO applies for AOS, so it is important to read all the information before you make any decisions.

I had a question regarding getting married in a foreign country....I want to marry my fiancee in her native country but I know that it will take much longer to go there (we planned for it in april) then wait for a k-3 application to be approved after the event. Wouldn't it be easier to just send out our k-1 package now and then just get married in april quietly while awaiting the approval for that one and then let her come on that visa? Or am I wrong? Maybe there is something or some downside that I am not seeing here....Please any thoughts about this.
