    Thank you thank you. Yes agree my I-130 June 2017 medical is no longer valid.

     

    Last time, it took me a few weeks to go around different places to get vaccinated.


    So wondering if there is just a law / rule of when each required vaccination expires to meet USCIS requirements. Surprised this info on validity of each vaccination is not available and believe it cannot be subjective by a civil surgeon.

  2. Friends - did my medical exam in June 2017 when filed for I-130. Doctor did some vaccinations that I did not have done in my home country and that expired.

     

    now with vawa case - Does anyone know how long vaccinations are valid for? Do you feel if I did my med exam for I-130 last time in June 2017 (3 years ago) - I should be good with vaccinations’ validity? Probably won’t be having my I-485 interview anytime soon though.

     

    could not find definite answer on USCIS site as to when and what vaccinations expire if at all do.

    USCIS is going to look at the final decree. If it doesnt mention anything about abuse (on either side) that is fine. Its only a problem if it says abuse (on your side towards him). They also do not care much about the specifics of the finances and property distribution. Of course if its something crazy like you will pay him 1 million dollars or buy him a Mercedes they may question if you are 'paying him off' (marriage fraud) But a standard divorce where assets are split reasonably (and you pay his legal fees) is not anything out of the ordinary. 

     

    When I divorced my first husband I ended up agreeing to a settlement for similar reasons. I just wanted it to be over. Money didnt matter when compared to the stress of having to interact with him. 

    Thank you so much and sorry for what you went through. I myself still depressed and cannot believe it has just been happening. Having someone you trust in the beginning makes world look like why it happened to me...

     

    As for attorneys fees it’s around $8,000 to pay to my ex-husbands attorney but in monthly installments. No abuse or infidelity or any other language from either side in the final divorce degree. Just “in-supportability”. Though I know he cheated. Also we did sign a prenup agreement as I have been in medical field as icu nurse and was making more than him and plus parents helped me with buying a first small house in the USA. So we signed a prenup before marrying and when divorced  final divorce degree says something like “parties divorced in accordance with prenup”. So these 2 things: will paying his legal fees and having prenup be a red flag like you said as like marriage being a fraud and stuff (which is absolutely not right as it’s him just used me and abused me) to USCIS? I was too stupid to believe him.

     

    i think yesterday my attorney told me that I just got I-360’s “card being processed” update as it means I will get c31 ead soon. Attorney did send the divorce degree right after the divorce was finished like 1.5 months ago and I had an RFE from USCIS at that time. And so we included it with this RFE response.
     

    In short, does it mean USCIS made its decision already and at I-485 interview they won’t survey me again on the divorce degree and details of marriage / divorce and why there was prenup and I paid his legal fees...last thing I want to go over in my mind and mentally in front of a stranger officer again as it hurts even more. Writing an personal affidavit was the most painful thing I did in my life already.

     

    sorry for my long message but just needed to speak away all what is going on in my head now. I am trying to spend more time with friends to just disconnect and worry less.

In the US court system there is a general policy of 'innocent until proven guilty'. Now divorces are not criminal matters, but its the same theory. Any accusations in divorce proceedings are just accusations. The only thing that matters is the final divorce decree declarations. 

    Thank you are awesome. I meant to just seal different accusation petition and forms but have the final decree public.

     

    yes finally degree is just we have restraining order (like keeping distance and not talk etc) for the rest of life seems like. Also - since my husband was making way less I am paying some of his attorney costs per degree (yes I know it’s stupid with what he has done to me and just used me but I wanted it all to be finished after emotional and physical abuse). What do you think it will look ok for USCIS?

     

    do you mean divorces were criminal matters? Omg I thought they are civil

    95% chance they will not need any of these details, they most you can expect if for them to ask if you're divorced and if not to explain why not - tell them about your spouse being uncooperative, threatening you etc.

    i ead even going to seal my marriage case but ex husband does not let me. Was worried that uscis can think he was right though he was the tiran . He abused me but claimed in the divorce that I cheated on him and even put physical abuse towards him and that I frauded him to get into marriage. All of that is lie. He just wanted me to suffer since I could not bear him anymore. 
     

    We just finished the divorce and it ended as just “incompatibility”. All the accusations he had just did not go to the divorce degree.

     

    still dont know if I should fight to seal the case - it is costly and know that he will fight back as he usually does. What do you guys think?

    I feel your pain... I've been in the US 7 years and still battling with USCIS for a GC.

    Thank you - i think there are no rfe for medicals nowadays as USCIS just sends courtesy letter?

     

    yes I have been 10+ years of this instability - laws change every year with immigrants not welcomed in general.

At NBC they do some more background check and see if you have all the documents for your I485 (usually they note you're missing medicals cause the initial ones expired and sometimes birth certificate too). Then after NBC it's supposed to go to your local office to wait for the interview. I know that as of May 15th my case was still in NBC. Meaning it's been 3.5 months since I360 has been approved, and it is still in the process of getting to local office. Once in local office the case gets in line with all other I485s for an interview.

    are I-485 rfes common? My I-485 status saying “fingerprints were rechecked or something” after I-360 said “card is processed” - took place in mid April.

     

    i was too focused on I-360 package and evidence. What are main things to go with I-485 if anyone has quick knowledge.

     

    for line in local office - mine is like 2.5 years now so I seem to look to have a chance to get green card in 2-3 years. Adding 2 years of I-360 it will get me to 5 years. Sometimes I wonder if this hassle is even worth it.

  8. Sorry - another question as I am confused. If I did my medicals in May  2017 for I-130 marriage case - does it mean I should not worry about various vaccinations and stuff for vawa case? I know USCIS can send a courtesy letter before interview to get medicals done. Just would not want to run in rush to have vaccinations done last minute. Wonder if anyone was in this situation as obvisouly  I have no clue when and what vaccinations expire or not.

    At the interview they usually ask standard questions about your info, parents' names, "no" questions about terrorism etc, sometimes can ask if you're been divorced. I haven't read of anyone saying officer was asking any deeply personal questions about marriage/abuse.

    Not sure about the list of what to bring, someone else may give advice on that. But I would bring all my passports, DL, birth certificate + translation.

    Your case is approved, you may receive an approval letter within 1-3 months of the card status, but some people never do. That will not change anything, since the card produced date your case has been approved even if you don't have the approval letter.

    i will be finalizing the divorce soon. Is an officer at interview asking for details of divorce? Does uscis check divorce records like discovery, petitions and etc or they just look at divorce agreement? Do they they check family court records? My divorce is very nasty and my soon to be ex husband is threatening me and wanted to annul the marriage first blaming that I frauded him since he does not want to accept that he was abusive. He even blames me I abused him and cheated on him.

    Super helpful - thank you. Is there an actual interview for naturalization? Know there is one for green card and there is ceremony for naturalization.

  13. God bless all of the wonderful people here. I have been a wife of a us citizen who has been abusive to me. I-130 and I-485 were filed and currently waiting. I am considering to file for Vawa as cannot bear him anymore. He is a very mean person to me. If I file I-360 form my friend told me I can use priority date from I-130 so that uscis will review I-360 quicker. Is it possible and how is it helpful to make the process go quicker?
