    NY rules say the following

You need a Social Security Card or Ineligibility letter to apply for REAL ID compliant license or permit

a letter from the Social Security Administration issued within the past 30 days stating that you are ineligible for a Social Security Number

If you don't care whether it's a REAL ID or not, then I vote for going the learner's permit route; seems like the least resistant route. Otherwise, get the ineligible letter from SSA and meet the more stringent points for REAL ID.

Would you guys know if my situation qualifies for ineligibility? My spouse applied for the SSN along with the I485 and my understanding is that we have to wait a year or more for this before we can receive the green card + SSN so are we ineligible at the moment?

Some States like NY and NJ have recently been doling out DL to anybody regardless of immigration status. Therefore, NY will give you a DL irrespective of your immigration status so go ahead and apply. It won't be REAL ID though.

I'm actually looking to apply for just a regular ID for my spouse, not even a DL but because we don't have the SSN, we don't meet the points of proof requirements. I was hoping to hear from someone who was able to get an ID without a SSN.

  3. I mistakenly thought the standard procedure to file for an SSN was to do so with the I485. Only afterwards, I realized it must be done two weeks after arrival and two weeks before the 90 days are up. Without the SSN which it seems like will not be available until we receive the green card, my spouse does not have enough points to qualify for an ID under the DMV rules. It seems like if you don't have the SSN, you also wouldn't be able to obtain other pieces of proof that the DMV accepts so I'm wondering if anyone has had luck finding a way around this?

  4. We are NYC based and given the directions of where to file our I485, we were directed to file with the Chicago USCIS. I did not realize that there was also a NYC USCIS office until reviewing the processing times just today and now I am confused why we were asked to send our AOS to Chicago when we are in NYC. Either way, how can we know if our case is with the Chicago or NYC office?

  5. My wife and I was not aware we could file for a SSN prior to her AOS and in New York State where we are located, it does not appear we have enough local documents to meet their proof to obtain an ID. Is it sufficient to have her foreign ID, a digital copy of her AOS NOA1 and a digital copy of her passport in case a police officer or ICE asks for identification?

Seems like a gamble at any rate. My lawyer is saying to wait. Wether you can or not is another question but I really don’t want to do anything that can cause a delay or confusion with the embassy as that would most surely end in much more wait time. I get that people are excited but what is 3 weeks after waiting a year and a half.

I'm leaning towards this as well. From the bits and pieces that I can gather, it sounds like people are able to make their appointments. However, I'm curious to know if anyone who has made their appointment before receiving the K packet ran into any issues. Either way, I'll probably wait the three weeks.

  7. We also received a notice yesterday from the NVC that our application was sent/is being sent to the Bogota embassy. Our NOA2 was Feb 4th 2021. I'm in a group chat and there seems to be some debate on whether this notification is sufficient for people in my position to make an interview appointment or whether you have to wait 3 weeks for the Bogota embassy immigration visa unit to send you the K packet instructions. According to the interview appointment website, you are not supposed to make an appointment until the IVU sends you the K packet instructions. However, others are saying that you can do it now and as long as you receive the instructions before your appointment date, you are fine. Does anyone have more insight on this?

Nothing can be done. Only thing they understand is lawsuits unfortunately. I will contact my Congressman to help transfer out of Bogota. My reasoning will be this embassy refuses to open and the limited cases they are processing are not done as specified. Other embassies are processing two months after NOA2. Bogota is getting to two years at this point. There are effectively a non-entity now.

Which embassy are you thinking about transferring to? I'm interested in any options including suing or transferring to accelerate my case but I'd hate to end up in a situation where I might unintentionally delay my case even more, kind of like changing lanes in traffic and seeing the lane you were in end up going faster. Also out of curiosity, is the info in your timeline listed correct? Have you received your NOA2 yet?

No one knows for sure. They just sent december 2020 so that's about 7 months before you. So maybe your case will be sent in 7 months. However, if they continue to ask for 3 months worth of cases at a time like they did this month, it could be in 3 months. No way to know for sure right now.

This is great news, do you mind sharing where you get the information that they are processing 3 months of applications? And are these all types of visas? It sounds like K1s may not be a priority.

Here is a link to the Embassy in Bogota that says they are still processing K-1 visas.

Thanks. Looking back at my email, I received the same response back in April as well. Meanwhile, the Bogota embassy itself has confirmed with me they have been processing visas since March. So it looks like the folks at the NVC either are unaware of this OR they're just using that as a default response to get people to stop asking them questions.

  11. I received a notice from the NVC on July 27th saying the embassy is closed for routine visa services. Does anyone know why they would close after being open for 4+ months and the covid situation improving?

Due to COVID-19 concerns, the U.S. Embassy or Consulate General in BOGOTA, COLOMBIA suspended routine visa services. The National Visa Center will not forward K1 visa petitions to BOGOTA, COLOMBIA until they resume routine visa services. The U.S. Embassy or Consulate General will resume visa services as soon as possible, but they cannot provide a specific date.
