  1. Hi everyone 🙂

     

    So my husband has officially received his immigrant visa this week.

    We are both in Colombia and we plan to move to the US in November but he has to travel to Miami this weekend to get his covid vaccine since in Colombia there are no 2nd shots available right now. 

     

    So these are my questions:

     1. Is it easy for him to enter as immigrant and come out of the US 2 days later while he still hasn't received his residency card?

    2. When filing the paperwork since I had to prove US residency I sent a letter saying that I would enter the US on or before the date he would enter the country. Would it be a problem and will they know that I am still in Colombia??

  2. Hello Guys,

     

    My husband finally has his interview in the US Embassy in Bogotá Colombia this august. When they sent me the appointment letter they also sent an evidence list that asks for a "registro de defunción" (death certificate). But he has never been married before. His mom did pass away many years back but the requirement does not say who they need a death certificate from. Do you guys know if this is just a general list they send to everybody and I can disregard it? or should he take his mom's death certificate?

    If my co-sponsor is married and files taxes jointly but solely on her income she meets 125% of poverty guidelines. Does her husband need to fill out a i854 or i854A as well and be her household member??? does he need to also attach: W-2, pay stubs, transcripts, passport, etc???

    Since being married does she need to attach a marriage certificate??

  4. Hello guys!

     

    So I am finish up my i-864 form but I have some questions on how to fill out some parts. Can you please advise?

     

    1. Part 2 Item 5 and 6: I filled the spouse application online. Do I have a USICS account number or A#?? I do not see any of this on the USICS Portal. Where can I find these?

     

    2. Part 4 item 12 and 13:  Does my husband have a USICS account # or A #? 

     

    3. Part 5 Item 1, 3, and 8: If the sponsored is my husband, do I enter 1 for item 1 and then also 1 for "if you are currently married" item 3??? then the number for the total entered on household size would be 3. Is this correct? we don't have children or anything. (household really is just 2)

     

    4. Part 6, Item 7: My current individual income is for 2020 or the one shown on 2019 tax return?

     

     

    5. Also, I have a co-sponsor who is married. He has to fill out the i-864, but does his wife need to fill out a i-864 as well or an i-864A o neither?

    I believe an apostille/certificación si not neccessary at the NVC stage, unless it's requested. Searched around the site and it seems to be the case. Maybe at time of interview double check with the US embassy in Colombia just to be sure? (assuming that'd be where the interview will take place).

     

    (If required after all; Colombia, United States and Argentina are all part of the apostille convention, so I would think having an apostille is the way to go, more than a certificación consular. )

    In short, even if the procedures vary greatly, they all seem to indicate one should put/write "[Autoridades estadounidenses] con excepción al Art. 51 del código penal" on the "para ser presentado en:/para ser presentado ante:".

     

    "En dicho sitio se indica que deberán solicitar este certificado de antecedentes penales mencionando específicamente "con excepción al artículo 51 del Código Penal". Aquellos que incluyan esta mención podrán hacerlo en el formulario de solicitud de antecedentes en el campo "PARA SER PRESENTADO ANTE.......".

     

    If that works, then it might not even be needed to do the "correction" after getting it in .pdf form since it'll say the phrase already? 🤔 

     

    Thank you this is super helpful. I requested the certificate to be presented to "The National Visa Center con excepción al art. 51 del Código Penal argentino". Do you think this exact certificate can be presented at the interview or for the interview it should be specified that it is to be presented to "U.S.IMMIGRATION"??  will it matter that it says "National Visa Center". 

     

    I know it sounds like I am obsessing over the small details but this is my only chance at getting this certificate since they are doing a huge exception for my husband to issue the certificate as a Colombian even though he is also Argentinian because his DNI and argentinian passport are both expired and can't renew now due to the pandemic.

    Hi! thank you, that is very nice of you. Actually yes, I do have a question.

     

    So my husband has an appointment on friday at the Argentinian consulate to get his fingerprints taken for the "certificado de antecedentes penales" that will then be available online as a PDF. Should I get a certificación consular, or an apostilla? or both?

    Does your husband have an Argentinian DNI?

    If he does, he can get the police certificate online here: https://www.argentina.gob.ar/justicia/reincidencia/antecedentespenales

    Your husband needs a DNI and a "clave fiscal nivel 2". In that link are the instructions for getting that "clave fiscal" online, as well. 

     

    I got that clave fiscal in person years ago so I don't know much about the online procedure, but I hope this helps.

     

    Edit: Also, if he's successful in getting the police certificate online, there's another extra step he must do to get the art. 51 exception written in the .pdf. I explained it here:

    Hi Peony! you are the best. thank you for this, I had this big doubt about this requirement since the consulate says this is not a thing that can be specified on the certificate. You have saved me a lot of trouble.

  8. Does anyone have experience getting police records from Argentina while being outside of Argentina??

     

    I am getting together all the papers for NVC for my husband who lived in Argentina after he turned 16, but it has been impossible. We are in Colombia and we are not getting any straight answers from the argentinian embassy in Colombia. It seems as if he will have to travel to Argentina for this 1 document.

     

    Anyone has any ideas?? Thanks!!

I am still confused because on the "country specific" documents page Colombia, for police records, it says this "Any applicant who has a police record that states "Actualmente no es requirido por autoridad judicial alguna" (in English, "currently not wanted by any judicial authority") must bring their complete court records, along with an English translation, to the embassy on the day of their interview. Applicants who fail to bring these court records and the English translation will be required to return to the embassy for a second interview."
